Effective date issue on ny unemployment claim - receiving less benefits than expected
Hi everyone, I'm really confused about my NY unemployment claim effective date issue. I applied on January 3, 2025, but they somehow used January 17 as my effective date. This has resulted in my weekly benefit amount being $143 less than what I should be getting based on my wage history. I've been trying to call NY unemployment for THREE WEEKS straight with no luck getting through to a real person. The automated system just keeps telling me about pending claims and then hangs up! When I check my account online, everything looks 'processed' but with the wrong effective date. Has anyone dealt with something similar or know how to fix an effective date? This difference is costing me over $570 a month that I desperately need for rent.

This is a common issue, especially during busy claim periods. The effective date should be the Sunday of the week you filed your claim. When the system is overloaded, sometimes the wrong date gets assigned. You need to speak with a claims specialist to get this fixed - they can adjust your effective date which will recalculate your benefit amount. Try calling right when they open at 8am or just before they close at 4:30pm when call volume is typically lower. Have your wage documents ready to verify your correct benefit calculation.

I was dealing with the EXACT same issue last month - wrong effective date and $115 less per week. After two weeks of not getting through on the phones, I tried Claimyr (claimyr.com) which got me connected to an agent in about 20 minutes. THE WHOLE SYSTEM IS DESIGNED TO SHORTCHANGE US!!!! They DELIBERATELY use wrong dates, wrong wages, wrong everything to pay us less and hope we don't notice or give up fighting it. I had FIVE different issues with my claim and spent MONTHS getting it fixed. They owed me over $2,600 in backpay and I had to threaten to call my assemblyman before they finally processed it! DON'T GIVE UP! Document EVERYTHING - dates you call, who you speak to, what they say. The system is BROKEN ON PURPOSE!

Just wanted to follow up - were you able to get through to a representative? If not, besides the suggestions others have mentioned, you can also try contacting your state senator or assembly member's office. They often have direct contacts at NYSDOL and can escalate cases like yours. Many unemployment issues get resolved quickly once a legislative office inquires about them.

I had a very similar experience with my NY unemployment claim - they used the wrong effective date which put me in a different base period and reduced my weekly benefits by about $125. After weeks of trying to get through the main phone line, I finally got it resolved by calling right at 8:00 AM on a Tuesday and staying on hold for almost 2 hours (I know, brutal). When I finally reached a representative, they were able to see the error immediately and corrected my effective date while I was on the phone. The key thing is to be very specific - tell them you need your effective date corrected to the Sunday of the week you originally filed, and ask them to recalculate your base period wages using the correct date. They should also process backpay for the weeks you were underpaid automatically once they make the correction. Don't give up! The system definitely has issues during high-volume periods, but once you reach someone who can actually help, they can usually fix it pretty quickly. The waiting is the hardest part.
