Does NYS Department of Labor unemployment back pay to original filing date?
I filed my unemployment claim about 5 weeks ago but just got approved yesterday after adjudication. My claim shows as approved now but I'm only seeing payments for this week. Does unemployment back pay to when I first filed or do I lose those weeks? I was laid off in early December and filed right away but it took forever to get through adjudication. Really hoping I don't lose all that money since I've been struggling to pay rent.

Yes, NYS Department of Labor will back pay you to your original filing date as long as you were eligible during those weeks. You should see the retroactive payments within a few days of approval. Make sure you completed your weekly claims for all those weeks during adjudication - that's required to get the back pay.

•I did file all my weekly claims! Thank you, that's such a relief. I was worried I'd lost 5 weeks of benefits.

•That gives me hope! My benefit amount is $380 per week so I'm expecting around $1900 in back pay.

The key is making sure you certified for benefits during the adjudication period. If you missed filing any weekly claims, you won't get back pay for those specific weeks. But if you kept up with your weekly certifications, NYS Department of Labor will automatically issue the retroactive payments once your claim is approved. Check your payment history in your online account - the back payments usually show up there first before being deposited.

•What if someone forgot to file one weekly claim during adjudication? Can they still get that week's payment somehow?

•Unfortunately no, you can't get benefits for weeks you didn't certify for. The weekly claim is what establishes your eligibility for that specific week. That's why it's crucial to keep filing even during adjudication.

I had trouble reaching NYS Department of Labor to check on my back pay status when this happened to me. Ended up using claimyr.com to get through to an actual agent who confirmed everything was processing correctly. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Made it so much easier than trying to call myself and getting hung up on constantly.

•How much does that service cost? I might need to check on my payments if they don't show up soon.

•It's worth checking out their site for details. For me it was worth it just to get peace of mind that everything was processing normally instead of worrying about it.

The NYS Department of Labor system is SO SLOW with back payments! Even when they say it's approved it can take another week or two to actually see the money. I was approved on a Thursday and didn't get my back pay until the following Tuesday. Just be patient but definitely keep checking your account daily.

•That's good to know about the timing! I was getting worried when I didn't see the back pay immediately after approval. I'll keep checking my account daily like you suggested. Did you get all your weeks at once or did they come in separate deposits?
