Can you draw unemployment if you resign from your job in New York?

I'm thinking about quitting my job because my supervisor has been making my life miserable for months. The work environment is toxic and I'm getting stressed out every day. But I need to know - can you draw unemployment if you resign? I've heard different things from people and I can't afford to be without income for long. Does NYS Department of Labor have any exceptions for quitting? I work in retail management and have been there for 2 years.

Generally speaking, if you voluntarily quit your job you won't be eligible for unemployment benefits UNLESS you can prove you had 'good cause' for leaving. NYS Department of Labor considers things like unsafe working conditions, harassment, significant changes to your job duties, or constructive discharge as potential good cause. You'd need to document everything and be prepared to explain your situation during adjudication.

What kind of documentation would I need? I haven't been keeping records but the harassment has been going on for months.

i quit my last job and got denied for UI benefits. they said i left voluntarily without good cause. had to appeal it and everything but still got denied. unless you have rock solid proof of harassment or something really bad, they probably won't approve it

Before you quit, try to get everything in writing. Document incidents with dates, witnesses, any emails or texts. If your supervisor is creating a hostile work environment, that could qualify as constructive discharge. You might also want to file complaints with HR first - NYS Department of Labor wants to see that you tried to resolve the situation before quitting.

This is good advice. I had a similar situation and HR actually helped resolve it. But if they don't help or ignore you, that documentation becomes really important for your unemployment claim.

I had to quit my job last year due to harassment from my manager and it was a nightmare trying to get through to NYS Department of Labor to explain my situation. Kept getting disconnected or put on hold for hours. Finally used this service called Claimyr (claimyr.com) that helped me actually reach a real person at the unemployment office. They have a video demo showing how it works: https://youtu.be/qyftW-mnTNI. Made the whole process so much easier when I could actually talk to someone about my case.

Did you end up getting approved for benefits after quitting? I'm worried they'll just automatically deny me.

The unemployment system is so messed up!! They expect you to stay in jobs where you're being mistreated just so you can qualify for benefits. It's ridiculous that people have to choose between their mental health and being able to pay bills.

yeah my cousin quit her job and got unemployment but that was like 3 years ago so maybe things changed? not sure about the rules now

The rules haven't changed much, but each case is evaluated individually. Your cousin probably had documented good cause for leaving or the employer didn't contest the claim.
