Can I recertify for NY unemployment after benefits expire while working part-time?

I've been working part-time for several months while collecting partial unemployment benefits in NY. My current benefit year is set to expire this week and I'm not sure what happens next. Can I still recertify after the expiration date? Will I need to file a completely new claim? I'm still working the same part-time job but definitely need the additional support. Anyone know what I'm supposed to do? Thanks!

When your benefit year expires, you'll need to file a completely new claim, not just recertify. Since you've been working part-time, you likely have enough earnings to establish a new claim. Go to your NY.gov account and select 'File a New Claim' rather than the weekly certification option. The system will guide you through the process and determine if you're eligible for a new benefit year.

Thanks for the info! Will all my information transfer over or do I need to start from scratch? I'm worried about having a gap in payments.

Same thing happened to me last year. You definitely need to file a new claim not just recertify. There might be a week or two gap in payments while they process the new claim tho. Just a heads up.

Did you have any issues with the new claim? I'm stressed that they'll deny me even though I'm still in the same situation.

Nah they approved me no problem. Just make sure to report your part-time work accurately when you file the new claim. They'll calculate a new weekly benefit amount based on your earnings.

THEY WILL MAKE YOU FILE A NEW CLAIM!!! And then you'll probably get stuck in pending hell for WEEKS! I was working part time too and my benefit year ended in Feb and I had to file a new claim and it took 5 WEEKS to get paid again!!! The system is completely broken and they don't care at ALL about people who need help!!!

Oh no, that sounds awful! Was there anything you could have done differently to avoid the delay?

I tried calling literally 50+ times and could never get through!!!! Eventually I just had to wait it out. The worst part is they never tell you WHATS WRONG they just leave you hanging!!

I went through this exact process in January. Here's what you need to know: 1. You must file a new claim when your benefit year expires (not recertify) 2. Having part-time work actually helps you qualify for a new claim year 3. They'll look at your earnings in your base period (usually the first 4 of the last 5 completed calendar quarters) 4. If approved, there's typically a 1-week waiting period before benefits resume 5. Continue claiming weekly while your new application processes One important tip: take screenshots of your work and earnings history before filing the new claim. Sometimes the system doesn't accurately transfer this information over.

Thank you for the detailed explanation! This is really helpful. I'll definitely take screenshots of everything before I start the process.

my sister had same problem she ended up having to go to the office in person because the online system kept crashing when she tried to file a new claim

Oh great, another thing to worry about. Was she able to get it resolved at the office?

After weeks of trying to get through on the phone for a similar issue (my claim expired while I was still working part-time), I found this service called Claimyr that got me connected to an actual NYSDOL rep in about 20 minutes. Was definitely worth it because the agent fixed my new claim issue right away instead of me waiting for weeks. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE - their site is claimyr.com if you're interested. Saved me a ton of frustration!

That sounds promising! I've been dreading the phone call ordeal. Did they explain the process for moving from an expired claim to a new one while working part-time?

Yes! The rep was really helpful. She explained that with part-time work, they review your earnings during the base period to calculate your new benefit amount. She also flagged my account to process faster since I was transitioning from an expired claim. Having a direct conversation made everything so much clearer than trying to figure it out from the website.

I'm in almost the exact same situation! My benefit year ends next month and I'm also working part-time. I'm super nervous about having to start over with a new claim... Did you end up filing yet? How did it go? I'm worried they'll calculate my benefits differently and I'll get less money.

I'm going to file tomorrow morning. I'll let you know how it goes! I'm worried about the same thing.

Quick update based on the 2025 rules: When filing a new claim after expiration while working part-time, make sure to have the following ready: 1. Accurate records of all part-time earnings (weekly breakdown) 2. Documentation of your work search activities (even while working part-time) 3. Your current employer's information 4. Any separation documents from previous employers The new monetary determination will be based on your earnings during the base period, so your weekly benefit amount may change depending on how much you've been earning at your part-time job.

UPDATE: I filed my new claim yesterday and it was actually pretty straightforward! The system recognized I had an expired claim and guided me through the process. It asked for details about my part-time work and calculated a new weekly benefit amount - it's about $15 less than before, but not terrible. They said there might be a 1-2 week processing period, but everything looks good so far. Thanks everyone for the advice!

Great to hear it went smoothly! The slight reduction in benefit amount is normal since they're calculating based on your more recent earnings including the part-time work. The 1-2 week processing is standard for new claims. Make sure you continue certifying weekly during this period.
