What happens when your unemployment claim expires - NYS Department of Labor benefits ending
My unemployment claim is set to expire in two weeks and I'm still actively looking for work. I've been collecting benefits for about 10 months now and I'm worried about what happens next. Do I automatically lose all benefits when my claim year ends? Can I file a new claim right away or do I have to wait? I'm getting conflicting information online about whether NYS Department of Labor automatically starts a new claim or if I need to do something. Has anyone been through this process recently?

When your benefit year ends, you'll need to file a new initial claim if you're still unemployed. NYS Department of Labor doesn't automatically roll you over. You can file online through my.ny.gov starting the day after your claim expires. Make sure you have your employment history from the past 18 months ready, including any part-time work you might have done while collecting benefits.

•Thanks! Do I need to wait for my current claim to completely end before filing the new one, or can I file it early?

i went through this last year and it was confusing AF. you definitely have to file a new claim but they base your new weekly benefit amount on whatever wages you earned during your benefit year, which might be way less than your original amount if you only had part time work

•Wait, so if I didn't work at all during my benefit year, what happens? Do I just not qualify for a new claim?

You need to file a new claim, but there's an important detail most people miss. If you didn't earn enough wages during your benefit year to qualify for a new claim, you might be eligible for an extension of your current claim instead. This is called a benefit year ending extension. The NYS Department of Labor should automatically review your case, but it's worth calling to confirm. If you're having trouble getting through to them, I used a service called Claimyr (claimyr.com) that helped me reach an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really saved me hours of calling.

•I've never heard of a benefit year ending extension. Is that something new? I'll definitely look into that Claimyr thing too since I can never get through on the phone.

The whole system is designed to screw people over. They make it so complicated on purpose so people give up and stop collecting. I've been fighting with NYS Department of Labor for months about my claim and they keep giving me the runaround. When your claim expires they'll probably find some excuse to deny your new application anyway.

•That's really pessimistic but I understand the frustration. The system definitely has its problems.

To clarify the extension question - yes, there are circumstances where you might be eligible for an extension if you don't qualify for a new claim. This typically happens when you haven't earned sufficient wages during your benefit year. The extension would continue your current weekly benefit amount rather than starting fresh. However, you still need to file the new claim application first so NYS Department of Labor can determine if you qualify for a new claim or an extension.

•Exactly right. And definitely file that new claim application as soon as possible after your benefit year ends to avoid any gaps in payments.

Just went through this exact situation 3 months ago. File your new claim the day after your benefit year ends - don't wait! I made the mistake of waiting a few days and it created a gap in my payments that took weeks to resolve. Also keep detailed records of all your job search activities during the transition period because they might ask for verification. The new claim process is pretty much the same as your original application, just make sure you report any work you did during your benefit year, even if it was just a few hours here and there.

•This is really helpful advice! I'm curious about the gap in payments you mentioned - when you say it took weeks to resolve, did you eventually get backpay for those missed days or did you just lose that money completely? I want to make sure I don't make the same mistake when my claim expires.
