Can I file a new NY unemployment claim after benefits ended while working part-time?
My unemployment benefit ended on March 12, 2025. Can I apply for a new claim? I'm still working part-time and don't earn more than $604 weekly. I started this part-time job on November 19, 2024. Does anyone know if I qualify for a new claim since my benefits ran out? I'm still not getting enough hours to make ends meet and really need some help figuring out what to do next.

It depends on whether you've earned enough in your base period to qualify for a new claim. Since you've been working part-time since November 2024, you might have enough wages in your base period to qualify for a new claim. The base period in NY is the first 4 of the last 5 completed calendar quarters before you file. You should apply anyway - the system will determine if you're eligible based on your earnings. Make sure you report all your part-time wages accurately when you certify weekly.

•Thank you! Do you know how much I need to have earned to qualify? And will they count my part-time wages from the entire time I've been working?

I had almost the exact same situation last year. Was on unemployment, benefits ran out, but was only working part-time making about $580 a week. I went ahead and applied for a new claim online and got approved! The key is having worked enough quarters to establish a new claim. The NY unemployment website was impossible to navigate though - kept getting error messages and couldn't get through on the phone for DAYS. I finally used a service called Claimyr (claimyr.com) that got me connected to an actual agent in about 20 minutes. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE - saved me so much frustration!

•Yes! I was super skeptical too but it definitely worked for me. The agent I spoke with was able to look at my claim history and confirm I was eligible for a new claim based on my part-time work.

You NEED to have earned enough in your base period to qualify for a new benefit year. In NY, you must have earned wages in at least 2 calendar quarters in your base period, received at least $2,700 in one quarter, and your total base period wages must be 1.5 times your high quarter wages. ALSO IMPORTANT: If you're still working part-time, you MUST report ALL earnings when you certify each week. If your weekly wages exceed $604, you won't receive benefits for that week. But as long as you earn less, you can still get partial benefits.

•Thank you for the specific numbers! I think I might qualify then since I've been working steadily since November. Do you know if there's any waiting period when filing a new claim after benefits end?

I'm in a similar boat right now - my benefits just ended last week and I'm trying to figure out what to do. I'm also working part-time but barely getting enough hours. Did you end up applying? Did they approve you? The whole system is so confusing and I'm worried I'll get denied and waste all that time applying.

•I was in this exact situation in January and got approved for a new claim! Just make sure when you apply that you list ALL your employment from the last 18 months. They calculate your benefit amount based on your highest earning quarter.

The system is RIGGED against part-time workers!!! I tried to file a new claim after my benefits ended and they gave me a TINY weekly amount that wasn't even worth the hassle of certifying. They don't care about people trying to get back on their feet. I spent HOURS trying to reach someone who could explain why my benefit was so low, but the phone system is deliberately designed to keep us from talking to real people!!!

•I felt the same way until I finally got through to someone who could actually help. Have you tried using Claimyr? It's the only reason I was able to get my issue resolved.

•No but at this point I've given up. The whole system is broken and they don't care about us.

To answer your question about waiting periods - yes, there is typically a one-week waiting period when you file a new claim. This is unpaid and happens at the beginning of your benefit year. Also, make sure you have documentation of all your part-time work ready when you apply. This includes pay stubs and contact information for your employer. The more prepared you are, the smoother the process will be.

•Thank you so much for this information! I'll gather all my pay stubs before applying.

my cousin had this happen and he said if you worked enough hours they will approve you for a new claim. i think its like 2 quarters of work or something? anyway he said the key is to make sure you report your income correctly each week when you certify or you could get in trouble later. good luck!

I just wanted to update everyone - I applied for a new claim yesterday and the system said I'll hear back within 2-3 weeks. The application asked for all my employment history from the past 18 months, so I included my part-time job. Fingers crossed I get approved! Thanks for all the helpful advice.

•Great! Keep checking your online account and your email for any requests for additional information. Sometimes they need more documentation to process your claim. Hope it all works out for you.
