Can I file a new NY unemployment claim after benefits ended while working part-time?

My unemployment benefit ended on March 12, 2025. Can I apply for a new claim? I'm still working part-time and don't earn more than $604 weekly. I started this part-time job on November 19, 2024. Does anyone know if I qualify for a new claim since my benefits ran out? I'm still not getting enough hours to make ends meet and really need some help figuring out what to do next.

It depends on whether you've earned enough in your base period to qualify for a new claim. Since you've been working part-time since November 2024, you might have enough wages in your base period to qualify for a new claim. The base period in NY is the first 4 of the last 5 completed calendar quarters before you file. You should apply anyway - the system will determine if you're eligible based on your earnings. Make sure you report all your part-time wages accurately when you certify weekly.

Thank you! Do you know how much I need to have earned to qualify? And will they count my part-time wages from the entire time I've been working?

I had almost the exact same situation last year. Was on unemployment, benefits ran out, but was only working part-time making about $580 a week. I went ahead and applied for a new claim online and got approved! The key is having worked enough quarters to establish a new claim. The NY unemployment website was impossible to navigate though - kept getting error messages and couldn't get through on the phone for DAYS. I finally used a service called Claimyr (claimyr.com) that got me connected to an actual agent in about 20 minutes. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE - saved me so much frustration!

Yes! I was super skeptical too but it definitely worked for me. The agent I spoke with was able to look at my claim history and confirm I was eligible for a new claim based on my part-time work.

You NEED to have earned enough in your base period to qualify for a new benefit year. In NY, you must have earned wages in at least 2 calendar quarters in your base period, received at least $2,700 in one quarter, and your total base period wages must be 1.5 times your high quarter wages. ALSO IMPORTANT: If you're still working part-time, you MUST report ALL earnings when you certify each week. If your weekly wages exceed $604, you won't receive benefits for that week. But as long as you earn less, you can still get partial benefits.

Thank you for the specific numbers! I think I might qualify then since I've been working steadily since November. Do you know if there's any waiting period when filing a new claim after benefits end?

I'm in a similar boat right now - my benefits just ended last week and I'm trying to figure out what to do. I'm also working part-time but barely getting enough hours. Did you end up applying? Did they approve you? The whole system is so confusing and I'm worried I'll get denied and waste all that time applying.

I was in this exact situation in January and got approved for a new claim! Just make sure when you apply that you list ALL your employment from the last 18 months. They calculate your benefit amount based on your highest earning quarter.

The system is RIGGED against part-time workers!!! I tried to file a new claim after my benefits ended and they gave me a TINY weekly amount that wasn't even worth the hassle of certifying. They don't care about people trying to get back on their feet. I spent HOURS trying to reach someone who could explain why my benefit was so low, but the phone system is deliberately designed to keep us from talking to real people!!!

I felt the same way until I finally got through to someone who could actually help. Have you tried using Claimyr? It's the only reason I was able to get my issue resolved.

No but at this point I've given up. The whole system is broken and they don't care about us.

To answer your question about waiting periods - yes, there is typically a one-week waiting period when you file a new claim. This is unpaid and happens at the beginning of your benefit year. Also, make sure you have documentation of all your part-time work ready when you apply. This includes pay stubs and contact information for your employer. The more prepared you are, the smoother the process will be.

Thank you so much for this information! I'll gather all my pay stubs before applying.

my cousin had this happen and he said if you worked enough hours they will approve you for a new claim. i think its like 2 quarters of work or something? anyway he said the key is to make sure you report your income correctly each week when you certify or you could get in trouble later. good luck!

I just wanted to update everyone - I applied for a new claim yesterday and the system said I'll hear back within 2-3 weeks. The application asked for all my employment history from the past 18 months, so I included my part-time job. Fingers crossed I get approved! Thanks for all the helpful advice.

Great! Keep checking your online account and your email for any requests for additional information. Sometimes they need more documentation to process your claim. Hope it all works out for you.

Good luck with your application! I went through something similar a few months ago and it can be nerve-wracking waiting for the decision. One thing that helped me was setting up text alerts in my online account so I got notified immediately when there were any updates or if they needed additional documentation. The waiting period is tough but try to stay positive - it sounds like you have a good work history with your part-time job since November that should help your case.

Thank you for the tip about text alerts! I didn't know about that feature. I'll definitely set that up right away. It's reassuring to hear from someone who went through the same thing successfully. The waiting is definitely stressful, especially when you're already struggling financially, but your advice gives me hope that things will work out.

I'm in almost the exact same situation - my benefits ended about 3 weeks ago and I've been working part-time since December making around $550 a week. I was hesitant to apply for a new claim because I wasn't sure if I'd qualify, but reading everyone's experiences here has been really helpful. It sounds like as long as you've worked consistently for a few months, you should have a good chance of qualifying. I'm going to apply this week and hope for the best. Thanks for posting this question - it's exactly what I needed to see!

I'm glad this thread helped you too! It's reassuring to know there are others in similar situations. When you apply, make sure you have all your pay stubs from December onwards ready - they'll want to verify your earnings. Also, don't be discouraged if the online system seems glitchy or slow. From what others have shared, it's pretty common but the applications do go through eventually. Keep us posted on how it goes!

I was in a very similar situation last year! My benefits ended in February while I was working part-time at a retail job making about $580/week. I was nervous about applying for a new claim because I wasn't sure if my part-time wages would be enough to qualify. I ended up applying online and was approved for a new benefit year! The key things that helped me were: 1) I had been working consistently for about 4-5 months before my original benefits ended, 2) I made sure to have all my pay stubs organized before starting the application, and 3) I was completely honest about all my earnings. My new weekly benefit amount was lower than my original claim (since it's based on more recent, lower earnings), but it was still worth it given that I was only working part-time. Just make sure when you certify each week that you report your exact earnings - even being off by a few dollars can cause issues. The application process took about 3 weeks for me to get a decision, so try to be patient. Good luck - it sounds like you have a solid work history since November that should help your case!

This is super helpful! Thanks for sharing your experience. I'm wondering - when you say your new weekly benefit amount was lower, do you remember roughly how much lower? I'm trying to get an idea of what to expect since my part-time earnings are probably similar to what yours were. Also, did you have any issues with the waiting period, or did benefits start right away once you were approved?
