Can I file for unemployment another time after previous claim ended?

My unemployment benefits ran out about 8 months ago and I've been working part-time since then, but now that job ended too. Can I file for unemployment another time or do I have to wait a certain period? I'm confused about whether I need to start a completely new claim or if there's some kind of waiting period between claims. My previous claim was regular UI benefits that lasted the full 26 weeks. Has anyone been in this situation before?

Yes, you can absolutely file a new claim! Since you worked after your previous claim ended, you should be eligible to file a new unemployment claim. The key is that you had qualifying earnings during your base period. You'll need to file a new initial claim through the NYS Department of Labor website, not just reopen your old one.

Thanks! Do I need to wait any specific amount of time between claims or can I file right away?

You can file immediately - there's no waiting period between claims as long as you meet the earnings requirements. Your new benefit amount will be calculated based on your recent work history, including that part-time job you mentioned. Make sure you have all your employment information ready when you file.

That's really helpful. I was worried I'd have to wait a year or something like that.

I've filed multiple times over the years and it's pretty straightforward. Just make sure you report the part-time work accurately when they ask about your employment history. The NYS Department of Labor will use your most recent earnings to calculate your new weekly benefit amount.

If you're having trouble getting through to someone at NYS Department of Labor to ask questions about your eligibility, I used a service called Claimyr (claimyr.com) that helped me reach an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Really saved me hours of calling and getting busy signals.

Interesting, I might need that if I run into issues. The phone lines are always so busy.

Just filed my second claim last month after working for about 6 months between claims. Super easy process, took maybe 15 minutes online. Your previous claim history doesn't affect your ability to file again as long as you worked and earned enough money.

I was in almost the exact same situation last year! My UI ran out, I worked part-time for about 7 months, then that job ended. I was able to file a new claim right away with no issues. The important thing is that your part-time work should count toward establishing a new base period, so you should definitely be eligible. When I filed my new claim, my weekly benefit amount was actually a bit higher because it included wages from both my previous full-time job and the part-time work. Don't overthink it - just go ahead and file online as soon as possible since there's usually a one-week waiting period before benefits start anyway.

That's so reassuring to hear from someone who went through the exact same thing! I was really worried about the gap between claims but it sounds like as long as I worked in between, I should be fine. Did you have to provide any special documentation about why your part-time job ended, or was it pretty standard?

I'm in a similar boat right now - my benefits ended about 6 months ago and I've been doing gig work since then, but it's been really inconsistent. From what I understand reading everyone's responses, as long as you've earned enough during your base period from that part-time work, you should be good to file a new claim. The fact that you worked for 8 months between claims definitely helps establish new qualifying wages. I'd recommend gathering all your pay stubs from the part-time job before you file online - they'll ask for employment dates and wages. Good luck with your new claim!

Thanks for sharing your experience with gig work! That's actually really helpful to know. I've been wondering if different types of work between claims might affect eligibility differently. My part-time job was more traditional W-2 employment, so I'm hoping that makes the process even more straightforward. I definitely have all my pay stubs saved - learned that lesson from my first claim when I had to scramble to find documentation. Really appreciate everyone sharing their experiences here, it's making me feel much more confident about filing.

I went through this exact situation about 2 years ago! My regular UI benefits ended, I worked part-time at a retail job for about 10 months, then got laid off again. I was able to file a new claim immediately with no waiting period. The process was really smooth - I just went to the NYS DOL website and filed as a new initial claim (not a reopened claim). One thing that surprised me was that my new weekly benefit amount was calculated using wages from both my original job that qualified me for the first claim AND the part-time work I did in between. So even though the part-time job paid less, having those additional earnings in my base period actually helped. The only advice I'd give is to make sure you have your separation paperwork from the part-time job ready when you file, just like you would for any unemployment claim. You've got this!

This is such valuable information, thank you! It's really encouraging to hear that the additional earnings from your part-time work actually helped increase your benefit amount rather than hurt it. I was worried that having lower wages from part-time work might somehow reduce what I'd be eligible for, but it sounds like the system takes all qualifying wages into account which is great. I do have my separation paperwork from when my part-time job ended, so I should be all set there. Really appreciate you taking the time to share the details of your experience - it's exactly what I needed to hear to feel confident about moving forward with filing right away!

Just wanted to add my experience since I see a lot of great advice here already! I actually had a similar timeline - my UI ended about 9 months ago, worked part-time for most of that period, then that job ended last month. I just filed my new claim two weeks ago and it was approved without any issues. The online application took about 20 minutes and I had my first payment within 10 days. One thing I'd suggest is filing as soon as possible since even though there's no waiting period between claims, you still have that one-week waiting period before your first payment. Also, don't worry about your benefit amount being lower because of the part-time work - mine was actually higher than my first claim because they use your highest earning quarter in the calculation. The system really is designed to help people who are working and contributing, so you should be in good shape!

This is so helpful to hear from someone who just went through the process recently! I was definitely overthinking this whole situation, but hearing that you filed just two weeks ago and got approved quickly is really reassuring. The tip about filing ASAP to get past that one-week waiting period is smart - I hadn't thought about that timing aspect. And it's amazing that your benefit amount was actually higher! That really takes away my worry about the part-time wages somehow hurting my case. I think I'm going to file this weekend when I have time to sit down and do it properly. Thanks for sharing such recent and detailed info!

I'm in a very similar situation right now - my benefits ended about 7 months ago and I've been working at a small office part-time since then, but they just had to let me go due to budget cuts. Reading through all these responses is incredibly helpful! It sounds like the consensus is that I can file immediately without any waiting period, which is a huge relief. I was honestly worried there might be some kind of penalty for filing multiple claims or that I'd have to wait a full year between them. It's especially encouraging to hear from people who recently went through this exact process and had positive outcomes. I'm planning to gather all my employment documentation from the part-time job this week and file online. Thanks to everyone who shared their experiences - this community is so valuable for navigating these situations!

I'm so glad this thread has been helpful for you too! It's really amazing how many of us have been in this exact same situation - it makes me feel like this is just a normal part of how unemployment benefits work rather than some unusual circumstance. The fact that multiple people have confirmed there's no waiting period between claims and that recent filers got approved quickly is such a relief. I was also worried about potential penalties or restrictions for filing multiple times, but it sounds like the system is actually designed to support people who are working between claims. Good luck with gathering your documentation and filing - it sounds like we're both going to be just fine!

I just wanted to chime in as someone who works in workforce development - you're absolutely right to file a new claim! Since you worked for 8 months between claims, you've definitely established new qualifying wages that should make you eligible. The great thing about New York's system is that it recognizes when people are trying to work and supports them when those jobs don't work out. One small tip: when you file online, make sure you select "file a new claim" rather than "reopen existing claim" since this will be treated as a completely new application. Also, keep in mind that your weekly certification process will start fresh, so you'll need to be available for work and actively seeking employment just like with your first claim. The whole process should be much more familiar this time around though! Best of luck with your new claim.

Thank you so much for the professional perspective! That tip about selecting "file a new claim" rather than "reopen existing claim" is really important - I definitely would have been confused about which option to choose. It's also good to be reminded about the weekly certification requirements starting fresh. I've been keeping up with job searching anyway, but it's helpful to know I need to be ready to document that actively again. Having worked in workforce development, do you know if there's typically any difference in processing time for people filing their second claim versus first-time filers, or is it pretty much the same timeline?

I'm actually going through this exact same situation right now! My UI benefits ended about 6 months ago, I worked part-time at a restaurant, and now that job just ended last week. Reading through everyone's experiences here has been incredibly reassuring - I was so worried that I might have waited too long or that there would be complications filing a second claim. It's amazing to see so many people confirming that you can file immediately with no waiting period between claims. I'm planning to file this week and feeling much more confident about it now. Thanks to everyone who shared their stories - this thread is going to help so many people in similar situations!
