The whole system is rigged honestly. They deny claims hoping people won't appeal. But if you do appeal and have documentation you mentioned, you should be fine. Downsizing is clearly not misconduct - that's just corporate BS they're trying to pull.
Just wanted to add - if you're having trouble getting through to NYS Department of Labor to confirm this, I recently used claimyr.com to actually reach a real person. They have this system that calls you back when an agent is available. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Might be worth it for peace of mind since you want to make sure you're handling this correctly.
I was unemployed for 6 months last year and what worked for me was focusing on the positive aspects. I mentioned that I used the time to take care of family responsibilities and also to be strategic about my next career move. Most interviewers seemed to respect that I wasn't just jumping into any job.
The whole system is so confusing honestly. I filed three weeks ago and I'm still waiting for my first payment because they said my claim is under adjudication whatever that means. The website just says pending with no explanation of how long this takes.
Adjudication means they're reviewing your claim to determine eligibility. This can happen if there's a question about why you lost your job or if you have earnings from multiple employers. It can take anywhere from 2-6 weeks depending on the complexity of your case.

Update your resume and LinkedIn profile immediately. Also document any specialized skills or certifications you have - this will help with both job applications and qualifying for training programs. NYS Department of Labor's skills assessment can identify transferable skills you might not realize you have.

The system is rigged anyway. These retraining programs just shuffle people between low-paying jobs while companies get tax breaks for moving operations overseas. But I guess it's better than nothing if you're facing layoffs.

•I get the frustration but some of these programs actually do lead to decent paying jobs. The key is picking training in fields that are actually growing in New York.
