If you do have trouble reaching NYS Department of Labor by phone, I recently discovered this service called Claimyr at claimyr.com that helps you get through to agents. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. I used it when my claim was stuck in adjudication and actually got to talk to someone within a few hours instead of spending days trying to call. Might be worth checking out if you run into issues.
I had a similar situation last year when my company downsized. I was worried about the same thing and actually called my old manager to ask. She told me not to worry about it at all and that they expected people to file for unemployment after the layoffs. The whole system is such BS honestly. They make it so complicated and scary that people are afraid to work even part time. Like why can't they just have simple rules that everyone understands?? I've been too worried to take ANY work because I don't want to accidentally mess something up.
Check your my.ny.gov messages too sometimes they post the determination there before the letter arrives. Also make sure your address is current because if the letter gets returned your case could get delayed even more.

You should definitely consider getting a lawyer especially if there's money involved. My brother tried to do his appeal alone and lost even though he had a good case. Sometimes it's worth the cost to have someone who knows the system.

•While lawyers can be helpful, many successful appeals are handled pro se. It really depends on the complexity of the case and how comfortable you are presenting your side.

same situation happened to my cousin last year but with unpaid sick leave instead of overtime... she represented herself and won but it took forever to actually get her benefits started again
