If there are any issues with her claim like questions about why she was laid off, it might go into adjudication. That's where NYS Department of Labor investigates further and it can take weeks or even months to resolve. Sometimes they contact the employer to verify information. Just be patient if this happens - calling constantly won't speed it up but I found a service called Claimyr that helped me get through to an actual agent when I needed answers about my adjudication. Also make sure you file your initial claim as soon as possible after becoming unemployed. There's a one week waiting period before benefits start, and any delays in filing can push back when you receive your first payment. The weekly claims have to be filed every week even if your initial claim is still being processed.
The whole system is a nightmare honestly. They make it as difficult as possible on purpose. I've been fighting with them for months over an overpayment notice that makes no sense. Good luck getting any real help from their customer service - if you can even reach them!
Don't listen to the negativity - most people get their benefits without major problems. Just be thorough with your application and keep good records. The key is filing consistently every week and responding quickly if they ask for any additional information.
Wait I'm confused about something - do you have to file within a certain time after each week to get your weekly benefits? Or is that different from the initial filing deadline?
The whole system is so confusing. Why don't they just automatically start your benefits from the day you tell them you were laid off? Makes no sense that you lose money just because you didn't know about some arbitrary rule.

•It's because you have due process rights. If the overpayment determination is wrong, you shouldn't be penalized with interest charges while exercising your right to appeal. It's actually pretty standard for government debt collection.

THE WHOLE OVERPAYMENT SYSTEM IS A SCAM!!! They make mistakes all the time and then charge YOU interest for THEIR errors. I got hit with a $3,400 overpayment that took 8 months to prove was wrong but by then I'd already paid hundreds in interest because I was scared not to pay.
