Just want to add that you'll still need to file your weekly claims even on standby status. A lot of people think they don't have to do anything until they get called back to work, but you absolutely have to keep certifying every week or you won't get paid. The only difference is you don't have to provide proof of job search activities since you're attached to your employer.
Your neighbor sounds like one of those people who complains about everything without understanding how it actually works. Don't let her make you feel bad about collecting benefits you earned!
omg this reminds me of when my aunt tried to tell me the same thing! She was like 'you're taking money from hardworking people' and I was like no aunt susan thats not how this works lol. some people just dont understand the system
THE WHOLE SYSTEM IS A MESS!!! They make you jump through hoops and then some random person decides your fate. I got denied even though my employer laid me off and it took MONTHS to get it overturned. The appeals process is ridiculous too.
OMG I've been trying to call NYS Department of Labor for WEEKS about this exact question and can never get through! The phone lines are always busy or I get disconnected after waiting forever. It's so frustrating when you just need a simple answer about whether you can collect both benefits.
I had the same problem reaching them until someone told me about this service called Claimyr that helps you get through to NYS Department of Labor agents. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. It was honestly a lifesaver when I needed to talk to someone about my claim status. Way easier than spending hours trying to get through on my own.
Just make sure when you file your weekly claim you report your social security as 'other income' if they ask. I think there's a section for that but I'm not 100% sure how it affects the calculation.

The whole system is rigged in favor of employers!! They know most people can't afford lawyers to fight these cases so they just throw around accusations hoping you'll give up. Document EVERYTHING and don't let them intimidate you into withdrawing your claim.

•I mean, there are legitimate cases where people do get fired for good reasons though. But yeah, some employers definitely abuse the system.

Keep filing your weekly claims even during adjudication! If you win your case, you'll get backpay for all those weeks. If you stop filing, you could lose out on benefits even if the decision goes in your favor.
