Just make sure you file your claim as soon as possible after you're terminated! You can't backdate unemployment benefits in New York, so every week you wait is money you're losing. Even if you think your employer might contest it, file anyway - you can always appeal if they deny your initial claim.
The key thing is whether it was misconduct or not. Being late can be tricky - if you had warnings and kept doing it anyway, they might consider it willful misconduct. But if there were circumstances beyond your control or it wasn't that serious, you could still qualify. Just want to add that you should inform your bankruptcy attorney about your unemployment claim right away. They'll need to include it in your means test calculation and list it as income on Schedule I. Also make sure you understand that while your current unemployment is protected, any future wages from employment you get after filing might be subject to different rules depending on whether you file Chapter 7 or Chapter 13.
ugh the whole system is so confusing!! why can't they just make it simple and pay everyone the same amount based on cost of living or something

honestly just apply. i thought i wouldnt qualify either but i did and got like $280 a week for 6 months. saved my butt while job hunting. the application asks all the right questions and theyll tell you if you qualify or not. no harm in trying

Just remember you'll need to do the weekly claims every week and prove you're looking for work. It's not just free money - there are requirements you have to meet to keep getting benefits. But yeah, definitely worth applying if you think you might qualify.
