Look, if you're having trouble getting through to NYS Department of Labor to actually file your claim, there's a service called Claimyr that can help you reach an agent. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. I used them when I couldn't get through the phone lines for weeks. Much easier than spending hours on hold just to get disconnected.
Just file the claim already! You paid into this system through your paycheck deductions and your employer has been paying their part too. It's not charity, it's insurance you've earned. Don't let guilt stop you from getting benefits you're entitled to.
Keep filing those weekly claims no matter what! Even if approval takes a while you'll get back pay for all the weeks you were eligible. I made the mistake of stopping my weekly claims thinking it didn't matter and lost out on 2 weeks of benefits.
Don't forget about the work search requirements! Even if your initial claim gets approved, you can lose benefits later if you don't do enough job searching or turn down work that NYS Department of Labor considers suitable for your skills and experience.
ugh this system is so stacked against workers. they make it impossible to get benefits even when you legitimately need them. good luck OP, hope your situation is more straightforward than mine was
Had to deal with something similar when my claim got stuck in adjudication and I couldn't get through to anyone at NYS Department of Labor for weeks. Finally used this service called Claimyr (claimyr.com) that actually got me connected to a real person. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and getting hung up on.

tell him to file no matter what!! the worst they can say is no but if he doesn't file he gets nothing for sure. I got fired for being late too much and still got benefits because they couldn't prove it was willful misconduct

This whole system is so confusing. I thought if you get fired you automatically can't get unemployment. Good to know that's not always true. The NYS Department of Labor really needs to make this stuff clearer for people.

•It's definitely confusing but the basic rule is that you can get benefits unless you were fired for misconduct. Things like poor performance, attendance issues without warnings, or company downsizing usually don't count as misconduct. Only things like theft, violence, or repeatedly ignoring direct orders typically disqualify you.
