That's mostly correct. Religious organizations and certain non-profits can be exempt, but they can also choose to participate. Agricultural employers have different rules too. But for a typical small business like a marketing firm, they absolutely have to pay unemployment insurance taxes to NYS Department of Labor.

•Unemployment benefits are definitely taxable income at the federal level. There was a special exemption for part of 2020 unemployment due to COVID but that's long over. You should probably check if you need to file amended returns for any years you didn't report UI benefits.
