Is it legal to charge sales tax in nexus states without having a sales tax permit?
Hey everyone! I work for a small e-commerce business that sells handcrafted items across the US. We recently hit the economic nexus thresholds in several states (mostly through increased holiday sales), which means we now need to collect sales tax there. The problem is, getting sales tax permits in these states has been a complete nightmare - so many forms, different requirements, and the processing times are ridiculous. My manager wants us to start charging sales tax in these nexus states immediately, even though we don't have the permits yet. Her thinking is "better to collect it now than owe it later." But I'm really concerned this might be illegal. I've tried researching this but keep finding conflicting information. Does anyone know definitively if it's legal to collect sales tax from customers in states where you have nexus but haven't received your permit yet? And if it's not legal, is there a specific law or resource I can point to? We're trying to do the right thing, but the permit process is taking forever and we're making sales in these states daily.

Tax professional here. Your instinct is correct - collecting sales tax without a permit is generally illegal in most states. This is considered "impersonating a tax collector" since only authorized businesses can collect tax on behalf of the state. When you hit nexus in a state, you should immediately apply for a permit, but you should NOT collect sales tax until that permit is active. The permit registration dates are important because they establish when your collection obligation legally begins. If you collect before having a permit, you're essentially collecting money under false pretenses. What you should do is keep detailed records of all sales made to customers in those nexus states during this interim period. Once your permits are approved, you'll likely be responsible for the uncollected sales tax from the date nexus was established, not from when you received your permit. This is a business expense you'll need to plan for.

•Thanks for the info! Do most states have a grace period between when you hit nexus and when you're required to start collecting? Or are you technically out of compliance the day after you cross the threshold?

•Most states don't offer an official grace period, unfortunately. Technically, your collection obligation begins once you exceed the threshold. However, states understand the practical reality that registration takes time. What they typically expect is that you register promptly (within 30 days of crossing the threshold) and then begin collecting once registered. The real issue is that if you wait too long to even apply for registration after crossing nexus thresholds, states may look at that as intentional non-compliance, which can trigger penalties beyond just the uncollected tax.

I went through this exact same headache last year with my online art business. After hitting nexus in like 5 states, I was completely overwhelmed trying to figure out all the different registrations. I found this service called taxr.ai (https://taxr.ai) that completely saved me. They analyze your sales data and tell you exactly where you have nexus, when you reached it, and help with the registration process. The best part was they provided me with documentation showing I was actively in the permit process, which helped when I had to explain to a state why I hadn't been collecting. They also calculated my potential liability for the period I wasn't collecting so I could set aside the right amount. Worth checking out since you're in the same boat I was!

•How long did it take for them to get your permits squared away? I'm in a similar position with nexus in 8 states and the thought of doing all that paperwork makes me want to cry.

•Wait, do they actually file the permits for you or just tell you where you need to file? Because knowing where I have nexus isn't the problem, it's dealing with all the different state websites and requirements.

•For most states, they had my permits completed within 2-3 weeks, though a couple problematic states (looking at you, California) took almost 6 weeks. Still way faster than me trying to figure it out myself. They don't just tell you where you have nexus - they actually handle the registration process for you. You give them authorization, and they complete all the required forms and submissions. They have specialists who know each state's quirks and requirements, which saved me from having applications rejected multiple times. They also set up filing calendars so you know exactly when returns are due in each state.

Just wanted to update that I decided to try taxr.ai after seeing this thread, and wow, it was even better than described. I was literally pulling my hair out trying to figure out Colorado's system (why is it so complicated??), and they handled everything. They also gave me this really detailed liability report showing exactly what I'd owe for the period before I had permits, which helped me budget for it. Their dashboard keeps track of all my filing deadlines across states too, which was something I didn't even realize I needed. Definitely recommend if you're dealing with multi-state nexus issues like I was!

Something nobody has mentioned yet - if you're struggling with getting answers from state tax departments about your permits, try Claimyr (https://claimyr.com). I was stuck in permit limbo with Texas for MONTHS, couldn't get anyone on the phone. Watched their demo video (https://youtu.be/_kiP6q8DX5c) and signed up. They got me connected to an actual Texas tax department person in under 15 minutes when I'd been trying for weeks. The rep was able to tell me my permit was approved but the notification got lost in the mail. Saved me from potentially being non-compliant for even longer.

•How does this actually work? Do they have some special line to the tax departments or something? I've spent hours on hold with Pennsylvania and would pay almost anything to skip that.

•This sounds too good to be true. I've been calling Florida for three weeks straight and can't get through. You're saying this service actually gets someone on the line for you? I'm skeptical.

•They don't have a special line - they use technology to navigate the phone trees and wait on hold for you. When they finally get a human, they call you and connect you directly to that person. So you don't have to waste hours listening to hold music. I was skeptical too! But it works because they're basically just handling the worst part (waiting on hold) for you. Once they get a representative, you're the one who talks to them directly. I used it for Pennsylvania too actually, and got through in about 30 minutes when I'd previously given up after 2+ hours on hold.

Wanted to eat my words and say I tried Claimyr after posting my skeptical comment. Absolutely blown away. I had literally called Florida's Department of Revenue 7 times before with no luck. Claimyr got me through to a live person in 43 minutes (they texted me updates while they were on hold). The agent was able to tell me my permit application had an error that no one had bothered to contact me about, so it had been sitting unprocessed for weeks! Got it fixed on the spot and my permit was approved two days later. Would have been waiting indefinitely if I hadn't been able to speak to someone. Honestly kind of a game-changer for dealing with state tax departments.

Have you looked into a sales tax service like Avalara or TaxJar? They integrate with most e-commerce platforms and handle the calculation, collection, and filing for you. They can't solve your immediate permit problem, but they make compliance much easier once you're set up. We use TaxJar for our Shopify store and it automatically adjusts the tax rates based on the delivery address. They even handle filing the returns in most states so we don't have to remember different filing frequencies and deadlines for each state.

•Thanks for the suggestion! We actually do use TaxJar for calculations, but the issue is still around whether we can legally turn on collection in states where we don't have the permit yet. Seems like from what others are saying, we definitely need to wait until the permits are approved. I'll mention the filing service to my boss though - might help lighten the load once we're up and running!

•That makes sense! Yes, definitely wait for the permits. One other tip - many states will give you a registration date that's earlier than the date you actually receive the permit. This is normal and means you can start collecting as soon as you get approval, even if you're "technically" registered as of an earlier date. Just make sure to keep good records in the meantime!

Just a caution from someone who learned the hard way - even if your permits are delayed, set aside the amount you'd be collecting in sales tax anyway. When you finally get approved, several states will expect you to pay the tax on sales made after you established nexus, regardless of whether you collected it from customers. I had to pay about $3,800 out of pocket because I wasn't setting money aside while waiting for permits in 3 states. Don't make my mistake!

•Oof, that's rough. Which states hit you with backdated liability? I'm currently in the permit process with NY, NJ, and California.

•California was the worst offender - they backdated my liability to exactly when I crossed the threshold ($500,000 in sales or 200 transactions). Illinois and Massachusetts did something similar, but they were more reasonable about waiving penalties since I registered promptly after exceeding the threshold. Just be especially careful with California - they track your sales somehow and knew almost exactly when I hit nexus!
