IRS 90-Day Review Period - No Action Until June 8th After February Filing
According to IRM 21.5.6.4.35.3, the IRS typically processes returns within 21 days, but when placed under review, they enforce a mandatory 90-day waiting period before taking further action. I e-filed on 2/20/24 and after some discrepancies were identified, I promptly updated the requested information. Despite this, the representative informed me that no action can be taken until June 8th (exactly 90 days from my filing date + 8 days). This seems excessive given that I've already provided the corrected information. Has anyone successfully navigated this 90-day review period more efficiently? As a small business owner, this delay significantly impacts my cash flow planning.

You need to act on this ASAP. Back in 2023, I had a similar situation after filing in January, and waiting the full 90 days cost me significantly. The 90-day review period is their standard protocol for certain verification issues, but there are exceptions. If you've already provided the updated information they requested, you might be able to request an expedited review through the Taxpayer Advocate Service. Don't wait until June - the backlog only gets worse as we get further into tax season!

ā¢I'm not entirely sure the Taxpayer Advocate is accepting these cases right now... I believe they may have restrictions on taking cases that are simply in normal processing timeframes, even if those timeframes are frustrating. Has anyone successfully used TAS for a 90-day review situation recently?

ā¢What happens if OP tries to contact them before the 90 days? Will this flag the return for even more scrutiny? I'm concerned this could backfire.

I was in exactly the same situation with a 90-day hold that started on February 3rd, 2024. After waiting exactly 47 days with no updates, I used https://taxr.ai to analyze my transcript. It explained that the specific code combination on my account (570/971) indicated an information mismatch rather than a full audit. The tool predicted I'd receive a notice by March 25th asking for verification, which arrived exactly on March 23rd! I responded immediately and my hold was released 12 days later instead of waiting the full 90 days. The transcript analysis was incredibly helpful in understanding what was actually happening.

ā¢I've seen these transcript tools mentioned before but never tried one. How accurate was it really? I'm always skeptical about these services that claim to decode IRS systems.

ā¢Not OP but I've used it too. It's legit. Basically takes the crazy IRS transcript codes (like 570/971/846 etc) and explains what they mean for YOUR specific situation. IRS website just gives generic definitions. Taxr.ai tells you what actions to take + timeline expectations. Saved me tons of anxiety tbh.

ā¢Would this work even if the IRS rep specifically told OP they can't do anything until June 8th? I wonder if having the transcript analyzed might reveal options the representative didn't mention?

Oh my goodness, I feel your frustration SO MUCH! I was literally told the EXACT same thing in 2023 - "wait 90 days before we can help you." I was absolutely devastated because I needed that money for a medical procedure. I couldn't stand waiting and feeling helpless, so I used Claimyr (https://youtu.be/_kiP6q8DX5c) to get through to an actual IRS agent instead of the frontline people. I was honestly shocked when the agent I reached was able to expedite my review! The first-level representatives often just quote the standard timeframes, but higher-level agents have more authority. It was worth every penny to get connected quickly rather than spending hours on hold.

ā¢Under Internal Revenue Manual 21.3.4, expedited processing is typically reserved for hardship situations. The criteria include imminent eviction, utility disconnection, or medical emergencies. Unless OP qualifies under these provisions, expedited processing may not be available regardless of which agent they speak with.

ā¢I've seen situations similar to this where different agents give completely different answers. Last year my brother was told 120 days by one agent, then called back and got someone who resolved it in 2 weeks. It's definitely worth trying to speak with multiple representatives - sometimes you just need to find the right one who knows the exceptions to the standard procedures.

Have you received any specific notices from the IRS explaining why your return is under review? The 90-day period typically applies to specific verification issues, but the required timeframe can vary based on what exactly they're reviewing. Did they mention what information needed to be updated? Was it income verification, identity verification, or something related to your business expenses?

Did you file on February 20th, 2024 exactly? Because if I'm calculating correctly, 90 days from February 20th would be May 20th, not June 8th. Is there a reason they added those extra days? I filed on February 15th and was also placed under review, but they told me May 15th was my date. I'm wondering if there's something specific about your situation causing the additional time.

ā¢ā¢ Did you receive any CP05 notice? ⢠Was there any mention of income verification? ⢠Have you checked your transcript for TC 570/971 codes? These would explain the additional days beyond the standard 90-day period!

I was in this exact same boat last tax season! Filed in February, got stuck in review, and was told to just wait the full 90 days. I decided to try something different - I contacted my local Taxpayer Advocate Service office (not through the national line) and explained my situation. The local advocate was actually able to check on my case and discovered it was just sitting in a queue with no actual issues. š They expedited it and I had my refund within 2 weeks! Sometimes the local offices have more bandwidth to help than the national phone lines.

Here's what you can do instead of waiting until June 8th: Step 1: Pull your tax transcripts through the IRS website. Look for specific transaction codes that indicate what type of review you're under. Step 2: If you see codes 420 or 424, you're under examination/audit. If you see code 570, it's a refund hold. Step 3: Call the IRS at 7 AM exactly when they open - this is when hold times are shortest. Step 4: Request to speak with a tax examiner or account management representative, not just the first-level customer service. Step 5: If they can't help, ask specifically about Taxpayer Advocate Service criteria for economic hardship if this delay is causing financial difficulties. The 90-day period is their standard line, but there are often ways to move things along faster if you know what to ask for.

I had the EXACT same timeline. Filed Feb 22, got told to wait 90 days. I didn't take that answer. Called every single day for a week straight until I got someone who actually looked at my file instead of just reading the script. They found that my return was just sitting there waiting for someone to review the documents I'd already sent in. Got my refund 10 days later. Don't just accept the 90-day answer - keep pushing.

I'm dealing with something very similar right now! Filed on February 18th and got the same "wait 90 days" response. What's really frustrating is that I run a seasonal landscaping business and this delay is hitting right when I need to purchase equipment for spring. I've been reading through all these responses and it sounds like there might be more options than what the first representative told you. Has anyone here had success with calling at different times of day to reach different representatives? I'm wondering if the 7 AM strategy mentioned by Ellie Simpson actually works, or if there are other optimal calling times. Also curious about the transcript analysis tools - seems like understanding what codes are actually on your account could help determine the best approach. The cash flow impact is real for small business owners like us. Even if we can't expedite the process, it would be helpful to at least understand what's actually causing the delay versus just getting the standard "wait 90 days" response.
