Can a family member claim me as dependent if I have no job or insurance but live with them?

So for the last year and a half I've been living with my brother who's been supporting me financially. I don't have a job, health insurance, or any income really. I'm just wondering if he can claim me as a dependent on his taxes? I'm 29 years old if that matters. I've had some health issues that have kept me from working and he's been helping me get back on my feet. Just want to make sure we're doing our taxes correctly this time around.

Just to add, make sure you don't file your own return claiming a personal exemption if your brother plans to claim you. That'll trigger a flag in the IRS system.

Good point! And remember that even if you file a return (like to claim a refund of withheld taxes from earlier in the year), you need to check the box that someone can claim you as a dependent.

I was in a similar boat last year when my nephew was living with me. The key thing the IRS looks for is that you provide MORE THAN HALF of the persons support for the year. If your brother is paying for your housing, food, utilities, clothing, medical expenses etc and it totals more than half of your total support needs, then yes he can claim you as a qualifying relative. Your age doesn't matter for this type of dependent.

Nobody's mentioned the gross income test yet! For 2023, you need to have made LESS than $4,400 for the entire year to be claimed as a qualifying relative. If you made more than that, even if your brother supported you, he cant claim you.

Then you should be all set! Just make sure that if you do file a return (not required with no income but some people do to get stimulus credits etc), you check the box that says someone can claim you as a dependent.

My tax guy told me that just providing housing to someone isn't always enough to claim them as a dependent. Your brother needs to be providing more than 50% of your TOTAL support. So lets say your total support costs for the year were $20,000 (housing, food, medical etc) - he would need to have provided over $10,000 of that. If you had any other income/support from anywhere else like gifts from other family, that counts against his percentage.

Then you're good! Just keep some kinda records in case of audit. Doesnt have to be fancy - even just bank statements showing he paid the bills, rent etc.

dont forget the residancy test! For qualifying relative they need to live with you ALL YEAR (with some exceptions for parents, kids etc). If OP only lived there part of 2023 it might be a problem

i'm a tax preparer and see this situation all the time. your brother CAN claim you as a qualifying relative dependent if: - you lived with him all year - your gross income was under $4,400 (for 2023) - he provided more than half your total support - you're not filing a joint return - you're not being claimed by someone else the tax benefit for him would be a $500 tax CREDIT (not deduction) for other dependents.

good question! for a qualifying relative who lives with you, they dont actually have to be related by blood/marriage. Roommates CAN claim each other IF all other tests are met (which is rare since usually both have income). But the relationship test is satisfied by living together all year.

Make sure he files right! My mom tried to claim my brother as a dependent and got audited because she picked the wrong dependent type on her return. There's 'qualifying child' (which has an age limit) and 'qualifying relative' (which doesn't). She checked the wrong box and it was a huge hassle.

Btw don't forget that if he claims you, you will NOT be eligible for any stimulus payments or tax credits on your own. Those would go to him as your supporting taxpayer. Just something to consider if more pandemic relief ever comes around.

i just went through this!!! make sure your brother keeps receipts for everything he pays for you - rent, food, utilities, medical expenses, etc. My dad claimed my sister last year and got audited, and we had to prove he provided more than half her support.

One thing nobodys mentioned - having no HEALTH INSURANCE doesnt matter for dependency status. The shared responsibility payment (penalty for no insurance) was reduced to $0 starting in 2019. So that part of your question isn't relevant to whether he can claim you.

Age restrictions only apply to "qualifying child" dependents. For "qualifying relative" dependents (which is what OP would be), there are no age restrictions. They just need to meet the income test, support test, and residency test.
