Anyone get their 2020 Employee Retention Credit check yet? Filed with 941-X in 2021 and still waiting...
So our small business filed for the Employee Retention Credit back in 2021 using Form 941-X for the 2020 tax year. We submitted everything correctly (I triple-checked all the paperwork), but here we are years later and still no check from the IRS. We qualified during Q2 and Q3 of 2020 when our revenue dropped by almost 60% due to the shutdown. We kept all 12 employees on payroll even though we barely had any customers. The credit should be around $85,000 which would be HUGE for our business right now. I've tried calling the IRS a few times but always get stuck in the phone tree or get disconnected after waiting for hours. Has anyone who filed for the 2020 Employee Retention Credit using Form 941-X actually received their refund check? If you did get it, how long did it take? I'm starting to wonder if they're even processing these anymore.

The IRS is definitely still processing Employee Retention Credits, but they're extremely backlogged with 941-X forms, especially for the 2020 tax year. I'm a bookkeeper with several clients in your situation. The current processing time for 941-X forms for ERC claims from 2020 is running between 9-12 months at minimum, but many are taking much longer. One client just received their check last month after filing in early 2021 - so almost a 3 year wait. The IRS announced last year they were reallocating resources to process the backlog, but progress has been slow. Make sure you keep copies of all your documentation showing your revenue drop and payroll records. If you haven't received anything yet, I'd recommend calling the IRS Business Tax Hotline directly at 800-829-4933. It's hard to get through, but they can at least confirm your 941-X is in the system and hasn't been lost.

Your best bet is calling that Business Tax Hotline number I mentioned, but try early morning right when they open - around 7:00-7:30am Eastern time. That's when wait times are shortest. If you filed with a tax professional, they might have access to the IRS Practitioner Priority Service which sometimes can get better information, but even they're experiencing long wait times these days.

Then it automatically calls you and connects you to that agent. You still "wait" the same amount of time overall, but you don't have to physically sit on hold for hours. I was super skeptical too! But I was desperate after trying for weeks to reach someone. It works because they're essentially just automating the hold process. They don't have any special access to the IRS or ability to jump the queue. They just save you from having to personally sit on hold which is absolutely brutal when wait times are 3+ hours.

My advice is to keep detailed records of EVERYTHING - copies of your 941-X submissions, proof of mailing, documentation of your qualification (revenue decline or shutdown orders), employee counts, wage calculations, etc. The IRS is scrutinizing these claims very carefully now because of all the ERC mills that were filing questionable claims. One thing that seemed to help was sending a polite inquiry letter (certified mail) after the 12-month mark. I referenced my specific EIN and 941-X submission dates. Got my checks about 2-3 months after that letter.

•The Taxpayer Advocate Service (TAS) is currently not taking ERC cases unless you can prove financial hardship. I tried last month and they turned me away saying ERC delays aren't considered emergencies unless your business is about to close or you're facing eviction/foreclosure as a direct result.
