Anyone Dealing with CP59 Non-Filing Letter? Need to Know Acceptance Dates and Transcript Status
Got hit with the IRS non-filing letter (CP59) and it feels like being called to the principal's office when you thought you'd already turned in your homework. Two quick questions for anyone in the same boat: 1) When was your return accepted by the IRS? (Mine shows March 2nd) 2) Do you still have the non-filing letter showing on your transcript, or do you have a due date now? I'm trying to figure out if I'm stuck in some kind of tax purgatory or if this is just normal processing. My transcript is about as informative as a fortune cookie right now.

I went through this exact nightmare last year! My return was accepted February 15th but I still got a CP59 in April. Turns out the IRS systems don't always talk to each other properly - one department sends out automated notices while another is still processing your return. My transcript showed the non-filing notice for about 3 weeks after I got the letter, then magically updated with a processing date. I called them in a panic when I first got the letter and waited on hold for 2 hours just to be told "wait and see" - which wasn't very reassuring but ended up being correct.

This happened to me too. Got the letter even though I filed. Called them and they said it was already being processed. The left hand doesn't know what the right is doing there.

While this may be true for some cases, I've seen multiple situations where a CP59 actually indicated a legitimate non-receipt of the return. The IRS doesn't issue these notices until at least 6-8 months after the filing deadline according to Internal Revenue Manual 21.6.1.6.14. If you received one now, it's likely for tax year 2022, not 2023.

I received my CP59 on April 1st (felt like a cruel April Fool's joke) after my return was accepted exactly 42 days earlier on February 18th. The IRS transcript system is completely disconnected from their notice generation system. The CP59 letter timing is really confusing this year. Last year, my parents got one in November for the previous tax year, which made more sense. This year, people are getting them right in the middle of filing season which is causing a lot of confusion. Based on my experience with the IRS notice system, the CP59 you're seeing is probably for your 2022 return, not your 2023 return that you just filed in March. Have you checked which tax year the CP59 is referring to?

This is an excellent point! When I looked more carefully at my CP59 from last year, it was actually for the previous tax year. I had filed an extension but then completely forgot to file the actual return. Felt pretty silly after panicking about it!

You're absolutely right - I've seen exactly 8 cases of this in the tax prep office where I work. In 7 of those cases, the CP59 was for the prior year, not the current filing season. The IRS typically issues these notices 6-10 months after the filing deadline.

I received a CP59 notice three weeks ago despite having filed my 2022 return last October. According to IRS Publication 594, the IRS is required to send notices when their records indicate a taxpayer had filing requirements but no return was received. I was so stressed about this because I NEED my refund for some medical bills. Called the IRS and after 3 hours on hold, they confirmed they had my return but it was in the "error resolution" department. My transcript updated last week with a due date finally.

I've dealt with this issue multiple times with clients. Here's exactly what you need to do: 1. First, determine which tax year the CP59 is referring to (check the top right corner) 2. If it's for 2022, verify you actually filed that return 3. If you did file, you need to call the IRS at the number on the notice 4. Be prepared to wait hours OR use Claimyr (https://claimyr.com) to get connected quickly 5. Once you reach an agent, ask them to check if your return is in processing 6. Request they place a hold on any further notices while they investigate I've had several clients use Claimyr to get through to an IRS agent within 20 minutes instead of spending days trying to get through. The agent can see if your return is actually in their system but just not processed yet, which is crucial information.

Your situation is similar to what happened with my brother-in-law, but different from what happened with my cousin. My brother-in-law received a CP59 for 2022 in March 2024, even though he had filed in April 2023. His return had been selected for manual review (similar to an audit but not officially an audit). Compared to my cousin who never filed and got the same notice, the resolution was completely different. My brother-in-law's transcript updated after about 4 weeks with no action needed from him, whereas my cousin had to actually file the missing return and pay penalties. The non-filing letter disappeared from his transcript about 2 weeks after the update.

IMO ur best bet is to check WMAR (Where's My Amended Return) if u filed an amended return, or check WMR (Where's My Refund) if original. The CP59 notice sometimes gets triggered when there's a mismatch btwn ur SSN and the name format on ur return. Had this happen to me when I got married and changed my name but the SSA hadn't processed my name change yet. Another option is to request ur wage & income transcript from the IRS to make sure all ur W-2s and 1099s were properly reported under ur SSN.
