DEO hasn't processed my claim for 10 months - legal options for suing?

I'm at my absolute breaking point with DEO. Filed my unemployment claim TEN MONTHS ago and have diligently claimed 20+ weeks, but still showing as 'processing' with ZERO payments. Not a single cent!!! I've called hundreds of times, sent emails, uploaded every document they've asked for, and nothing changes. The financial impact has been devastating - I've lost my apartment, had my car repossessed, and even lost my driver's license because I couldn't afford to renew it. I literally can't even apply for jobs that require driving now. Does anyone know if there's an official complaint process with DEO that actually works? Or has anyone successfully sued DEO for extreme delays? I've never considered legal action before but this seems like gross negligence at this point. I'm desperate for any advice on forcing them to actually process my claim or holding them accountable for what they've put me through.

Man, I feel your pain. Similar situation but not quite as extreme - 4 months for me. Have you tried contacting your state representative? That was the ONLY thing that finally got movement on my claim last year. Google 'Florida find my representative' and there's a page where you can input your address and get their contact info. Email AND call their office explaining the situation and ask them to inquire about your claim. Many have staff dedicated to DEO issues.

Thanks for the suggestion. I did try my state rep about 3 months ago but their office just said they'd "look into it" and I never heard anything back. Maybe I should try again with a more detailed email? Did you have to follow up multiple times?

I'm really sorry about your situation. Regarding your specific question about legal options, there are a few routes you can take: 1. File an official complaint with DEO's Reemployment Assistance Service Center - they're required to review and respond to all written complaints. 2. Contact the Office of the Inspector General for Florida DEO directly: 1-800-347-3735 or email at OIG@deo.myflorida.com - they investigate mismanagement. 3. Legal action is possible but complicated. Class action lawsuits have been filed against DEO in the past for systemic failures. You might consider consulting with a legal aid organization since you're facing financial hardship. 4. Document EVERYTHING - dates of all communications, claim screenshots, reference numbers, names of representatives you've spoken with. This will be crucial if you pursue legal action. Have you received any determination letters or specific reasons for the delay?

Thank you for these specific options. I haven't received ANY determination letters - that's part of what's so frustrating. The few times I've gotten through to someone on the phone, they just say it's "still in adjudication" or "pending review" with no explanation for why it's taking so long. I'll try the Inspector General route - didn't know about that option.

That's actually a really good idea I hadn't thought of. Which news station did you contact? Did you just call their main number or is there a specific way to reach their investigative team?

As someone who worked through a similar situation last year, I recommend trying Claimyr to get through to a DEO agent. Regular phone lines are nearly impossible, but Claimyr got me connected to an actual DEO rep in about 25 minutes when I'd been trying for weeks on my own. They have a video showing how it works here: https://youtu.be/UzW_hbUy-ss?si=zORd51jeq1GX5Ldj The key is getting to speak with a tier 2 agent who can actually see what's holding up your claim in the system. In my case, there was a single document verification issue that had stalled everything, but no one had bothered to notify me. Once I got through to someone who could explain the specific issue, I resolved it in a day and payments started flowing the next week. Their website is claimyr.com if you want to check it out. For a 10-month delay, you absolutely need to speak with someone who can escalate this.

I second this recommendation. I was in adjudication for nearly 4 months before using Claimyr. The DEO agent I spoke with found out my claim was stuck because of an employer response issue - something no one had bothered to tell me about despite DOZENS of calls to regular customer service. Worth every penny to finally get answers.

Thank you, I appreciate the kind words. Sometimes it feels like I'm screaming into a void with DEO. Did your cousin ever get his situation resolved?

No, I haven't specifically asked about fraud investigation. Thanks for the tip - I'll try calling right at 7:30 tomorrow and ask about that specifically. It's crazy that they wouldn't even notify you about something so important!

One more thing I forgot to mention in my first comment - try emailing DEO.Publicrecords@deo.myflorida.com and request all records related to your claim under Florida public records law. Sometimes this can shake things loose since they're legally required to respond to public records requests. Include your claimant ID, full name, and last 4 of SSN.

This is excellent advice. Public records requests create a formal legal obligation for them to respond, which sometimes gets more attention than regular inquiries. Just be aware it can take 7-10 business days for them to fulfill the request, but it's often worth the wait to see what's actually in your file.

UPDATE: I finally got through this morning using the 7:30am trick! The agent actually told me my claim has been flagged for "multiple employment verification issues" - apparently 2 of my previous employers never responded to DEO's verification requests, and instead of just TELLING ME THIS, they've left my claim in limbo for 10 months!!! She said she's forwarding my case to a supervisor for expedited review, but I'm not holding my breath. I'm going to try all the other suggestions here too - public records request, inspector general complaint, and probably the news station route if nothing moves in the next week. Thank you all for the advice!
