Why does a minimum wage job result in unemployment eligibility issues with California EDD?
So I've been trying to wrap my head around something that's been driving me crazy with my California EDD claim. I worked a minimum wage job for about 14 months at a small retail shop, and after getting laid off I filed for unemployment. Now my claim is stuck in some kind of review and I'm not sure if it's because of how little I was earning. Does anyone know why does a minimum wage result unemployment eligibility problems? Like, is there a base period earnings threshold that minimum wage workers sometimes fall below? I worked full time the whole time but I'm worried my weekly benefit amount is going to be really low or worse, that I might not qualify at all. The UI Online portal isn't giving me any details and I genuinely don't know if the adjudication I'm seeing is connected to my wage level or something else entirely. Has anyone else dealt with this when coming from a low-wage position?

Okay so first thing — earning minimum wage doesn't automatically disqualify you from unemployment. California EDD uses a base period calculation that looks at your earnings across four calendar quarters. As long as you earned at least $1,300 in your highest quarter OR at least $900 in your highest quarter AND your total base period wages are 1.25x that amount, you should qualify. For someone working full time at minimum wage in California, you'd almost certainly clear both thresholds easily. The minimum wage in CA is $16/hour for most workers right now, so full-time hours would put you well above the minimums. Your adjudication is probably about something else entirely — maybe your separation reason or an issue your employer raised.

AuthorThat's actually really reassuring to hear. So you're saying the wage level itself isn't likely the problem?

Zara Rashid
Correct. A full-time minimum wage worker in California earns roughly $2,700+ per month. That's more than enough to meet EDD's base period requirements. The weekly benefit amount will be lower than for higher earners, but you should still qualify.

Yeah I second this. I came from a minimum wage gig job and had no problem qualifying for UI, my weekly benefit was just on the lower end around $280/week or so.

The confusion about minimum wage and unemployment is super common. People think because they didn't earn much they won't qualify, but California EDD's thresholds are designed to include low-wage workers. What matters more is whether you were laid off vs. quit, whether your employer is contesting the claim, or whether there are any issues with how you reported your earnings during the base period. Any of those could cause the adjudication status you're seeing.

AuthorI was definitely laid off, they reduced the whole department. Could my employer still contest it even when it was a real layoff?

Technically yes, employers can respond to EDD's notice even for layoffs, and sometimes they do for reasons that aren't always obvious. It's not super common with genuine layoffs but it does happen. Your best bet is to try to get a live EDD agent on the phone to find out exactly what's in your claim file.

omg my employer contested my layoff claim too, said it was a 'voluntary separation' when it was 100% not. took forever to sort out

Getting through to a live EDD agent when your claim is in adjudication is honestly the hardest part of this whole process. I was in a similar situation a couple months back and spent literally days trying to get someone on the phone. A friend told me about Claimyr — it's a service that basically navigates the EDD phone system and holds your place in line, then calls you when an agent is available. I was really skeptical at first but it worked and I finally got answers about my claim. You can check it out at claimyr.com and they have a video showing how it works: https://youtu.be/JmuwXR7HA10 — seriously saved me so much stress.

AuthorWait this actually works? I've been calling every morning for a week and either getting the 'high call volume' message or getting disconnected after waiting 45 minutes.

That was literally my exact experience before I tried it. The disconnection after a long hold is the worst. Claimyr handled all of that for me.

Does it work for adjudication questions specifically? Like will the agent actually be able to tell you what's holding up your claim?

To answer the original question more directly — minimum wage itself doesn't CAUSE unemployment, but it can affect the benefit amount you receive. California EDD calculates your weekly benefit amount as roughly 60-70% of your average weekly earnings during the base period, up to the maximum. For minimum wage workers that calculation will produce a lower weekly check, but it's still a valid claim. The system is set up so that lower earners actually get a slightly HIGHER replacement rate percentage than high earners, which is intentional to help lower-income workers more.

Sean Doyle
AuthorOh I didn't realize the replacement rate was actually higher for lower earners. That's kind of good news I guess.

Yuki Ito
Yeah it's one of the more fair parts of the system actually. At minimum wage you're probably looking at somewhere between $250-$330/week depending on your exact earnings history.

Carmen Lopez
This is accurate. The benefit schedule is tiered so the percentage of wages replaced is higher at the low end. It's not a huge amount but it's better than nothing while job searching.

wait so if someone works minimum wage part time do they still qualify?? asking for myself not related to OP but i worked like 25 hrs a week at $16/hr for most of last year and just got laid off
0 coins
Zara Rashid
Part time can still qualify as long as you hit the base period earnings thresholds. At $16/hr x 25hrs/week you'd be earning about $1,700/month which should get you above the minimum requirements. File and see — worst case EDD reviews it.

okay filing today thank you!!

Make sure you report your hours accurately on the weekly certifications. Part-time history doesn't disqualify you but you need to be accurate about availability and job search activities going forward.

I went through this exact thing last year. Worked retail minimum wage for about a year and a half before the store closed. Was terrified I wouldn't qualify but I did, my weekly benefit came out to around $305. The adjudication I had was actually about whether the store closure counted as a 'layoff' under EDD's definition, which was weird to me because obviously the whole store closed. Eventually got resolved after EDD contacted my former employer.

AuthorHow long did your adjudication take to resolve?

Took almost 5 weeks which was brutal. I'd really recommend calling EDD to check in if you can get through, it helped move things along once I actually talked to someone.

Author5 weeks... that's really stressful. Did you have to stop filing weekly claims while waiting?

No! Keep filing your weekly certifications no matter what. Even in adjudication you have to keep certifying or you lose those weeks of potential benefits. That's really important.

This whole thread is giving me anxiety lol. I'm about to file and was also worried about the minimum wage thing. It really seems like the amount isn't the issue, it's usually something with how the separation is classified right?
0 coins
Yuki Ito
That's the most common cause of adjudication — separation reason disputes. EDD basically has to verify you were laid off and didn't quit or get fired for misconduct. When in doubt, document everything about your layoff if you can.

Zoe Papanikolaou
I have an email from my manager saying the position was eliminated. Should I keep that?
0 coins
Yuki Ito
Absolutely keep that. Screenshot it, print it, back it up. That's exactly the kind of documentation EDD may ask for during adjudication.

CAN SOMEONE EXPLAIN why EDD makes this so complicated?? Like if someone got laid off from a minimum wage job they clearly need help and the system just throws up walls everywhere. I've been in adjudication for 6 weeks now and my situation is even simpler than OP's — worked the same company for 2 years, laid off when they downsized, it's not complicated!! The phone lines are a joke, UI Online tells me nothing, and every week I certify into what feels like a black hole.

CosmicCruiser
Six weeks in adjudication is a long time and you really need to talk to an actual agent. This is exactly why I ended up using Claimyr — the regular EDD phone line was impossible and I was getting nowhere. claimyr.com got me connected to an agent who actually looked at my claim and flagged it for faster review. Not saying it's a magic solution but it got me actual human contact with EDD.

It's pretty simple to use, they just work with the EDD phone system on your behalf. Check the video demo at https://youtu.be/JmuwXR7HA10 to see how it works before deciding.

A few things worth clarifying for anyone reading this thread who's worried about minimum wage and unemployment eligibility in California: 1. The base period typically covers the first four of the last five completed calendar quarters before you file 2. You need either $1,300 in your highest quarter, OR at least $900 in your highest quarter with total base period wages of 1.25x that amount 3. A full-time minimum wage worker easily clears these thresholds 4. Your weekly benefit amount is determined by a formula based on your highest quarter earnings 5. Adjudication is almost always about separation reason or eligibility issues, not wage level Also — continue your job search and document it. California requires at least three job search activities per week, and that requirement continues while your claim is in adjudication.

Sean Doyle
AuthorThank you for laying this out so clearly. I've been doing my job search activities but wasn't sure if I needed to keep logging them during adjudication.
0 coins
Carmen Lopez
Yes, absolutely keep logging them and keep certifying every week. The job search requirement doesn't pause during adjudication.
0 coins
Zoe Papanikolaou
wait you have to do 3 job search activities per week?? I thought it was just 2. Let me double check my certifications...
0 coins
Carmen Lopez
It's been 3 per week for standard UI claimants in California. If you're on standby status it can be waived, but for regular claims it's 3. You can verify on the EDD website but definitely make sure you're compliant.

I kind of went down a research rabbit hole on this topic because I had the same question when I filed. The short answer to 'why does minimum wage result in unemployment issues' is — it doesn't really, at least not in California. The myth probably comes from states where the wage thresholds are higher or where the benefit formulas work differently. In California, the thresholds are low enough that even part-time minimum wage workers often qualify. The bigger barrier is usually the separation reason requirements, which catch people who quit without good cause or were fired for misconduct.

Sean Doyle
AuthorThat's interesting that it might be more of a myth than reality for California specifically. Good to know.

Yeah different states have very different rules which causes a lot of confusion online. California's system is actually relatively accessible for low-wage workers compared to many other states.

Update: I was in a similar situation (minimum wage retail worker, adjudication for 3 weeks) and just got my claim approved yesterday!! The hold was because my employer initially marked my separation as 'voluntary' on their end when I was absolutely laid off. EDD reviewed both sides and sided with me. For anyone going through this — keep your documentation, keep certifying, and try to get someone on the phone if you can.

One thing I want to add that nobody's mentioned — if your adjudication drags on past 5-6 weeks, you can contact your California state assembly member's constituent services office. It's a free resource that a lot of people don't know about. They have staff specifically for helping constituents navigate EDD issues and they can sometimes escalate cases that are stuck. It's not a guarantee but it's another avenue worth knowing about alongside trying to reach EDD directly.

I feel like the whole 'minimum wage workers don't qualify for unemployment' thing is genuinely one of the most persistent myths I've seen. So many people I know at my old retail job just didn't even bother filing because they assumed they wouldn't qualify. EDD's communication on this is terrible, they don't do nearly enough to reach low-wage workers who absolutely should be claiming these benefits.
0 coins
Sean Doyle
AuthorHonestly I almost didn't file for exactly that reason. So glad I did and found this community.

Please always file! The worst they can say is no and you've lost nothing. The threshold is really low in California.

This is such an important point. Billions in eligible unemployment benefits go unclaimed every year partly because of exactly this misconception. File first, ask questions later.

sorry if this is dumb but does the minimum wage affect the maximum unemployment you can get? like is there a cap on how much someone can receive weekly
0 coins
Yuki Ito
Yes there's a maximum weekly benefit amount — right now California's max is $450/week. Low wage workers won't hit that cap though, they'll receive less. The max caps HIGH earners, not minimum wage workers.

Mei Lin
okay that makes more sense. so minimum wage workers get less but not zero

Yuki Ito
Exactly. Less, but definitely not zero if you meet the base period requirements.

went through a minimum wage adjudication thing about 8 months ago. it sucks but it does eventually resolve most of the time. what really helped me was writing out a very detailed statement of why i was laid off and submitting it through UI Online messages — like really specific with dates and what my manager said. the more detail the better, don't assume EDD has any context about your situation

I work in HR and see this from the employer side sometimes. When EDD sends an employer a notice about a claim, they ask about the separation reason. Some employers — especially smaller ones — don't fill these out carefully or mark things wrong without realizing the impact. It's not always intentional. If you're in adjudication, there's a decent chance it's just an administrative mismatch between what you reported and what your employer reported, which EDD then has to investigate.
0 coins
Sean Doyle
AuthorThis is really helpful context. My employer was a small business so this might be exactly what happened.
0 coins
Amara Nnamani
Very possible. Small businesses often don't have dedicated HR and the owner just fills out whatever form EDD sends without really thinking about the implications. It doesn't mean they're fighting your claim, just that there's a discrepancy EDD has to sort out.

QuantumQuasar
This happened to me too — my employer wasn't fighting me, they just filled out their form wrong. Once EDD clarified with them it was resolved quickly.

Update from OP — I finally got through to an EDD agent this morning! Turns out it was exactly what a few of you predicted: my former employer filed their separation paperwork late and marked the reason incorrectly. The agent flagged it for expedited review since I'm past three weeks in adjudication. She said I should see movement within 7-10 business days. Thank you all so much for the help and reassurance — this community is genuinely incredible. And yes I did end up using Claimyr to actually get through, spent two days trying the regular line with zero luck before trying that. It worked exactly as described.

Jumping in late but one thing nobody mentioned — if your weekly benefit amount ends up being really low because of the minimum wage earnings history, you can sometimes qualify for additional state programs. California has some supplemental assistance programs and you might also look into whether you qualify for CalFresh (food assistance) during the period you're on unemployment, since receiving UI doesn't automatically disqualify you from that.
0 coins
Sean Doyle
AuthorI had no idea about supplemental programs. I'll look into CalFresh while waiting for this to resolve.

Fatima Al-Suwaidi
Definitely worth it. A lot of people don't realize they can receive UI and CalFresh simultaneously. The income from UI does count toward CalFresh calculations but you may still qualify especially at the lower end of UI benefits.
