What drug test is required for California EDD unemployment benefits?

So I've been trying to figure out whether California EDD actually requires a drug test when you file for unemployment benefits. I got laid off from my warehouse job about three weeks ago and my coworker mentioned something about having to pass a drug test before you can collect UI. I've been stressing about this ever since because I had no idea this was even a thing. I went through the entire UI Online application and didn't see anything about drug testing but now I'm second-guessing myself. Did I miss something? Is there a separate form or step I need to complete? My first payment is supposedly processing and I don't want it to get held up or denied because I skipped some requirement I didn't know about. Has anyone dealt with this recently?

Your coworker gave you some bad info. California does NOT require a drug test for regular unemployment insurance benefits. There is no drug testing requirement when you file a UI claim with California EDD. You won't find it in the application because it simply doesn't exist as a standard requirement. Your payment shouldn't be affected by this at all.

0 coins

Oh thank goodness. I've been panicking for like two days over this. So there's absolutely nothing drug-test related I need to worry about?

0 coins

Correct. No drug test requirement for California UI benefits. The only federal exception that exists in some states is for certain occupations where drug testing was a standard condition of employment, but California does not implement that provision. You're fine.

0 coins

yeah california is pretty claimant-friendly compared to a lot of other states, no drug testing here

0 coins

To add some important context here - the federal law (Middle Class Tax Relief and Job Creation Act) technically allows states to require drug testing for UI claimants who were separated from work due to drug-related misconduct OR who are seeking work in occupations that regularly require drug testing. But California has not adopted this provision. So you're good.

0 coins

Wait so if someone was fired FOR failing a drug test at their job, does that affect their unemployment eligibility differently? Like could they still get benefits?

0 coins

Great question. Being fired for failing a workplace drug test could potentially make you ineligible for UI benefits because it may be considered misconduct under California EDD rules. But that's a misconduct disqualification issue - it's separate from requiring claimants to take a new drug test to receive benefits. Very different situations.

0 coins

this is actually a really common misconception, lots of people confuse drug test REQUIREMENTS to receive benefits vs being fired for drugs which is a misconduct question

0 coins

I was in the same boat when I filed last year, someone told me I'd have to drug test and I spent forever trying to find information about it online. Couldn't get through to California EDD on the phone to ask either - spent three days trying to call and either got the 'we can't take your call' message or got disconnected after waiting 45 minutes. Eventually I found out through a service called Claimyr (claimyr.com) that actually got me connected to a live California EDD agent. The agent confirmed right away that there's no drug testing for UI. They also have a video showing how it works: https://youtu.be/JmuwXR7HA10 - honestly would have saved me so much stress if I'd used it sooner instead of trying to navigate the phone system for days.

0 coins

I've been having so much trouble getting through to anyone at EDD too. I'll check that out, thanks.

0 coins

does that actually work? i've tried calling edd so many times i've basically given up

0 coins

It worked for me. I was skeptical too but I genuinely got connected to an agent who answered all my questions. Worth it when you're dealing with something time-sensitive.

0 coins

omg i thought the same thing when i filed!! my old boss literally told me edd would drug test me lmao he was trying to scare me out of filing i think

0 coins

Wow that's kind of messed up that employers would do that to discourage people from filing

0 coins

right?? like he knew i'd qualify and just wanted me to not bother lol

0 coins

unfortunately some employers do spread misinformation about this stuff

0 coins

Just to be thorough about this topic since it comes up a lot: California EDD unemployment insurance does not require drug testing at any point in the claims process. Not at initial filing, not during weekly certifications, not during any eligibility interviews. The only drug-related issue that can affect your UI claim is if the reason for your separation from work involves drugs - for example, if you were fired for testing positive on a workplace drug test, California EDD would likely investigate that as potential misconduct which could lead to a disqualification. But even then, it's not a new drug test - it's just a review of the circumstances of your separation.

0 coins

what counts as misconduct exactly? like if someone got fired for failing a test but it was like their first offense is that still misconduct?

0 coins

Misconduct determinations are made case by case. California EDD looks at whether the behavior showed a willful disregard for the employer's interests. A first-time drug test failure might or might not be considered misconduct depending on the employer's policies, whether you had prior warnings, what the job was, etc. If you're in that situation you'd want to make sure you explain all the context when California EDD contacts you.

0 coins

I went through a misconduct determination and it took forever to resolve. The adjudication process for those is brutal

0 coins

WAIT so ive been telling people they need to drug test this whole time?? i feel so bad lol i definitely spread this misinformation to like 3 friends who were filing

0 coins

lol well now you know! easy mistake to make given how other states do it

0 coins

yeah i think i was mixing it up with welfare requirements or something

0 coins

honestly the rules are SO different state to state it's really easy to get confused

0 coins

Since we're clearing up misconceptions - let me also add that California EDD doesn't require you to take a physical exam, medical test, or any kind of screening to receive UI benefits. The eligibility requirements are: you must be unemployed through no fault of your own, able and available to work, actively looking for work (typically 3 job search activities per week), and you must have earned enough wages in your base period. That's it. No testing of any kind.

0 coins

The 3 job search activities per week - does that mean I need to actually apply to 3 jobs or can it be like attending a workshop or updating my resume?

0 coins

Multiple activities count - submitting applications, attending job fairs, contacting employers, using CalJOBS, attending employment workshops, registering with employment agencies. Applying to jobs is the most common but you have flexibility with what counts.

0 coins

Don't forget you need to keep records of your job search activities in case California EDD requests documentation. I learned that the hard way during an audit.

0 coins

honestly i've been collecting unemployment for 8 weeks now and nobody has asked me anything about drug testing at any point. just certify your weekly claims on time, report any earnings, do your job searches and you're good

0 coins

How has the weekly certification process been for you? Any issues?

0 coins

pretty smooth honestly. i do mine on Sunday nights through UI Online. just answer the questions carefully especially the ones about work and earnings

0 coins

same experience here, 4 months in and zero complications as long as you're honest on the certifications

0 coins

I saw someone mention CalJOBS above - just want to flag that California EDD may require you to register with CalJOBS as part of your job search requirements. It's free to register and you can do it online at caljobs.ca.gov. Some claimants get flagged if they haven't registered, so worth doing early if you haven't.

0 coins

I haven't done this yet - is it mandatory or just recommended?

0 coins

For most claimants it is required. When you registered on UI Online it should have mentioned it. I'd go register now just to be safe, takes maybe 10 minutes.

0 coins

Correct - California EDD requires registration with the America's Job Center of California network which uses CalJOBS. Most claimants are required to do this within a certain timeframe of filing. It won't affect your drug test question since there isn't one but it could affect your eligibility if you skip it.

0 coins

ok slightly different question - what if you VOLUNTEER that you use marijuana recreationally, does that affect anything? like if an EDD interviewer asked about your availability and you mentioned something about it

0 coins

California EDD interviewers are not going to ask you about recreational drug use. Their interviews focus on your separation from work, your availability for work, your job search activities, etc. Recreational marijuana is legal in California and your personal activities outside of work are not relevant to UI eligibility unless they affect your ability to be available for work.

0 coins

that makes sense, i was just overthinking it

0 coins

Right - 'able and available for work' is about whether you can accept suitable work, not about lifestyle choices. Unless drug use is actively preventing you from being available, it's irrelevant to your claim.

0 coins

the amount of misinformation about edd that gets spread is honestly wild. i work with a lot of gig workers and so many of them believe stuff like this that just isn't true. the drug test myth, the 'you have to pay back benefits if you find work too fast' myth, all kinds of stuff

0 coins

wait the paying back thing isn't true either?? i've heard that so many times

0 coins

No, that's not how it works. If you find work you just stop certifying. You don't owe money back because you found a job quickly. You might owe money back if you were overpaid due to an error or if you were collecting while working without reporting earnings - but just getting a job doesn't create an overpayment.

0 coins

This thread has been so educational honestly

0 coins

One thing worth knowing - if you ever DO need to talk to an actual California EDD agent about your claim, whether it's about eligibility questions, adjudication status, or anything else, getting through on the phone is genuinely difficult. I've had good luck using Claimyr (claimyr.com) when I need to actually speak to someone. There's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works. Way better than sitting on hold for hours.

0 coins

ok two people have mentioned this now, going to look it up

0 coins

It's legitimately useful when you have a specific question that the website doesn't answer. EDD phone lines are notoriously hard to get through and this actually helps.

0 coins

seconding this, used it when my claim went into adjudication and needed to understand why. got connected pretty quickly

0 coins

Going back to the original question just to make sure it's fully answered: drug test for unemployment in California = does not exist. You will never be asked to take one. The only scenario where drugs factor into your claim is if your JOB required drug testing and you failed one leading to termination, which then becomes a misconduct question during your eligibility determination. That's it.

0 coins

Perfect summary, thank you. And I wasn't fired for that reason anyway, I was laid off due to the warehouse cutting staff. So I have nothing to worry about on that front either.

0 coins

Layoff for business reasons is exactly the type of separation California EDD benefits were designed for. You should be fine.

0 coins

yeah layoffs are basically the cleanest path to UI approval, no misconduct questions, no disqualification concerns

0 coins

lol my cousin told me the same thing about drug testing before i filed last month. i think it's just one of those things that gets passed around as fact. filed my claim, got approved, never heard a single word about any drug test

0 coins

It really seems like this is just one of those persistent myths. Glad I asked before I stressed myself out any more over it.

0 coins

honestly same, i almost didn't file because of it

0 coins

ok so this whole thread answered my drug test question but now I have a different problem - my claim has been in adjudication for almost 5 weeks and I can't get any information about why. I've tried calling dozens of times and can't get through to anyone. Is there anything I can do??

0 coins

5 weeks in adjudication is stressful but not unusual unfortunately. California EDD adjudication times vary a lot. You should make sure you're still submitting your weekly certifications every week even while in adjudication - if you get approved, you'll be paid retroactively for all certified weeks.

0 coins

For actually getting through to talk to someone about your adjudication, try Claimyr at claimyr.com - that's what I used when I was in adjudication limbo. Getting a live agent on the phone was the only way I could actually understand what was happening with my claim. The video at https://youtu.be/JmuwXR7HA10 walks through how it works.

0 coins

thank you both - i'll keep certifying and try that phone service. 5 weeks with no income is brutal

0 coins

Something I want to add for anyone landing on this thread later - the drug test question for unemployment comes up A LOT and the answer in California is always no. But there are states that DO have drug testing requirements for certain UI claimants (Mississippi, Wisconsin, and a handful of others passed laws implementing the federal provision). So if you're reading this from another state, check your own state's rules. But if you're filing with California EDD, you're clear.

0 coins

Good clarification for anyone who might have moved recently or is comparing notes with friends in other states.

0 coins

yeah this is why googling general unemployment questions can be misleading - you might find info from another state that doesn't apply to california at all

0 coins

can I ask something related - what if you work in an industry where drug testing is standard, like trucking or construction, and you're between jobs. does california edd treat your claim differently because of your industry?

0 coins

No. California EDD doesn't differentiate claims based on industry when it comes to drug testing requirements. The benefits determination process is the same regardless of your occupation. The only industry-specific considerations are things like union membership, base period wages, and what constitutes 'suitable work' for your experience level.

0 coins

makes sense, thanks. I was a construction supervisor and was wondering if they'd somehow hold me to different standards

0 coins

The 'suitable work' factor can actually matter in your situation - you don't have to accept job offers that are significantly below your experience level and previous wages, at least early in your claim period. California EDD has standards around this.

0 coins

this thread needs to be pinned honestly. the drug test myth trips up so many people

0 coins

Agreed - I almost didn't file because I believed it. Would have been a huge mistake.

0 coins

same, i know at least 3 people who delayed filing or didn't file because of this exact myth

0 coins

misinformation about edd benefits costs people real money

0 coins

Final note from me: if you have ANY nagging questions about your California EDD claim - drug tests, adjudication status, disqualification notices, anything - the absolute best thing you can do is speak to an actual agent rather than rely on secondhand information. Given how hard it is to get through on the phones, Claimyr (claimyr.com) is the tool I'd recommend. Gets you to a live agent without the endless hold time frustration. Demo here if you want to see how it works: https://youtu.be/JmuwXR7HA10

Really appreciate this whole thread. Started the day panicking about a drug test that doesn't exist and ended up learning a lot about how the whole system actually works.

0 coins

That's what these forums are for. Good luck with your claim - sounds like you have a clean separation so you should be approved without issues.
