If your position is eliminated are you eligible for unemployment in California?
So my company just restructured and my entire department got wiped out. My manager called me into a meeting last Tuesday and told me my position was being eliminated effective in two weeks. This wasn't a firing for cause or anything like that - they literally just decided the role no longer existed and that was that. I've been there for almost six years. I'm trying to figure out if I qualify for California unemployment benefits. A coworker told me position eliminations are 100% covered but another person said it depends on whether you were offered a different role within the company first. I was actually offered a lateral transfer to a completely different department doing work I have zero experience in, and I turned it down because the commute would have been an extra 45 minutes each way on top of what I already do. Does turning down that transfer affect my eligibility? I don't want to file and then get hit with a disqualification or end up in adjudication for months because I didn't understand the rules. Anyone been through this?

Good news - position eliminations are generally considered a layoff through no fault of your own, which is exactly what California EDD unemployment insurance is designed to cover. When your employer restructures and eliminates your role, that's a classic involuntary separation and you absolutely should qualify for UI benefits. The transfer question is a bit more nuanced. California EDD looks at whether the job offered was 'suitable work' before determining if declining it affects your eligibility. Key factors include: how similar the work is to your previous role, the pay difference, and yes - commute distance can actually be a legitimate factor in whether an offered position counts as suitable. An 90 extra minutes of daily commuting is significant and could support your case that the transfer wasn't suitable work.

AuthorThis is really helpful, thank you. So when I fill out the initial claim form and it asks why I left, I should be clear that my position was eliminated and explain the transfer situation too?

Dmitri Volkov
Yes, be thorough and accurate on the initial claim. Explain the restructuring, that your specific position was eliminated, and give honest details about the transfer offer including the commute increase. California EDD will likely contact your former employer for their version anyway, so consistency matters a lot here.

also make sure to keep documentation of anything they gave you in writing about the elimination. any emails or letters saying your position was eliminated - save all of that

went through almost the exact same thing last year. position eliminated after a merger, was offered a role in a different city, turned it down. filed with California EDD and got approved no problem. the key thing they cared about was that I didn't quit voluntarily - the position itself no longer existed. that's what matters most

AuthorDid your claim go straight through or did it go into adjudication? That's what I'm most worried about.

mine went into adjudication for like 2.5 weeks but then got approved. they just wanted to verify the circumstances of the separation. once EDD confirmed with my employer that the role was eliminated I was good

I actually just dealt with this situation a few months ago and the hardest part honestly wasn't the eligibility question - it was getting through to a real person at California EDD when I had questions during the adjudication period. I was calling for literally two weeks straight and either getting busy signals or getting disconnected after waiting forever. Someone in a different thread recommended Claimyr (claimyr.com) and it genuinely saved me. They get you connected to an actual EDD representative. There's a video explaining how it works at https://youtu.be/JmuwXR7HA10 - worth checking out if you end up needing to talk to someone directly about your claim status. I was able to get clarity on exactly where my claim stood during adjudication which made the whole waiting process way less stressful.

It worked for me - I was genuinely skeptical too but I had already wasted so much time on hold. Got through to an agent and they were able to tell me my claim was moving forward and what documentation they needed. Huge relief.

seconding this, used it when my claim got flagged and needed to talk to someone. the regular EDD phone lines are basically impossible

Good to know this exists. I've been avoiding calling EDD at all because of how bad I've heard the wait times are

WAIT. Before you file make sure you understand the difference between being laid off and being constructively dismissed. If they eliminated your position specifically to get rid of YOU rather than as a genuine business restructuring that could change things. Do you know if other people's positions were also eliminated or just yours?
0 coins
LilMama23
AuthorIt was definitely a broad restructuring - about 12 people across the department lost their jobs. It wasn't targeted at me specifically.

ok then you're probably fine. i got paranoid when i was in a similar situation because i thought EDD would somehow think i did something wrong. but if it's a genuine layoff they can verify it pretty easily

The suitable work standard in California is actually something a lot of people misunderstand. When EDD evaluates whether you had good cause to decline a transfer or job offer, they consider things like whether the pay is comparable, physical demands, your prior experience, and yes - commuting distance relative to what's customary in your area. A 90-minute increase in daily commute is substantial and would likely factor in your favor. Also worth noting: even if EDD initially questions the transfer refusal, you have the right to appeal any disqualification decision. But based on what you've described, I'd be surprised if you had trouble with this claim.

LilMama23
AuthorThe pay would have been similar actually, just the commute was the main issue. Does the commute factor alone carry enough weight?
0 coins
Raj Gupta
It can, especially combined with the fact that the work itself was in a completely different field from your experience. California EDD looks at the totality of circumstances when evaluating suitable work. Document your commute situation - write down the exact distances and times so you have it ready if asked.

omg this happened to me in March. position eliminated, was offered something else, turned it down, freaked out about EDD. filed anyway and it was fine lol. don't stress too much about it

One thing to be aware of: when you file your initial claim with California EDD, you'll answer questions about your separation. Be really specific when you describe it. Don't just say 'laid off' - actually write out that your position was eliminated as part of a company restructuring, give the date, mention that multiple employees were affected. The more detail you provide upfront the less likely you are to end up in adjudication waiting for follow-up questions. Also make sure to start filing your weekly certifications right away once your claim is submitted - even before it's approved. Your benefit year starts from when you file, not when you're approved.
0 coins
LilMama23
AuthorWait, I can file weekly certifications before the claim is even approved? I didn't know that.
0 coins
Zainab Mahmoud
Yes! This is really important. File weekly certifications every week starting immediately. If your claim gets approved, all those weeks you filed for get paid retroactively. If you wait until you're approved to start filing, you miss out on those weeks entirely.

Gabrielle Dubois
THIS. so many people miss out on weeks of benefits because they didn't know this. file your weeklies from day one.

can confirm, lost two weeks of benefits my first time because I waited. don't make that mistake

I'm kind of confused by something - if you turned down the transfer are you considered to have quit? Like technically you chose not to take another job with the same employer. I feel like EDD might see it that way
0 coins
Raj Gupta
This is actually a common misconception. Declining a transfer to a position that isn't suitable work is not considered a voluntary quit under California unemployment law. The burden is on EDD to show the offered position was suitable before a refusal can be used against a claimant. Given the commute increase and different job duties described here, this seems like a strong case that it wasn't suitable work.
0 coins
Keisha Thompson
oh okay that makes sense. i always assumed if you turned down any job offer from your employer it would hurt your claim
0 coins
Dmitri Volkov
A lot of people think that actually. The suitable work standard exists precisely to protect people from being forced into jobs they can't reasonably accept just to avoid losing benefits.

went through adjudication for 5 weeks after my position was eliminated last year and it was ROUGH. no income, couldn't get anyone on the phone at EDD to tell me what was happening with my claim. honestly the worst part wasn't even the money it was just not knowing anything if you do end up in adjudication, one thing that helped me was keeping a call log of every attempt i made to contact EDD - dates, times, how long i waited. when i finally got through it showed i was being proactive about my claim

eventually got through after probably 30+ attempts. wish i had known about tools like Claimyr back then, honestly would have saved me a lot of stress. you can find it at claimyr.com - it helps you get connected to an actual EDD rep. heard from others in this forum it works pretty well for situations like adjudication where you really need answers

Make sure your employer doesn't classify your separation as anything other than a layoff/position elimination. Sometimes HR will code things differently and that can cause issues with your EDD claim. After you file, if your claim goes into adjudication, one common reason is that the employer's reported reason for separation doesn't match what you put on your claim. You can call your HR department and ask them how the separation is being classified for unemployment purposes - you have every right to ask that question.
0 coins
LilMama23
AuthorOh I hadn't thought about that. I'll reach out to HR and confirm how they're reporting it.
0 coins
Gabrielle Dubois
Good. Get it in writing if you can - even just an email response from HR confirming the classification. Saves a lot of back and forth with EDD later.

just here to say position eliminations are definitely covered by UI. my whole team got cut in a reorg two years ago and all of us filed and all of us got approved. it's literally what unemployment is for

just make sure you meet the base period wage requirements too - gotta have earned enough in the base period to qualify for any benefits at all. but at 6 years with the company you're probably fine

random question but does anyone know how long California EDD takes to process a new claim right now? I just got laid off too (different situation, performance issues - no wait, actually they said budget cuts) and I'm trying to figure out the timeline
0 coins
Dmitri Volkov
For standard claims right now processing is typically 3-5 weeks from filing to first payment if everything goes smoothly and there are no issues. If the claim goes into adjudication it can be longer - anywhere from 2-8 weeks additional depending on complexity. Starting your weekly certifications immediately is crucial regardless of processing time.
0 coins
Paolo Bianchi
ugh okay. and if they said budget cuts but there were also some performance conversations before, does that matter?
0 coins
Raj Gupta
The reason for separation matters a lot for EDD eligibility. If there were performance issues involved, EDD may investigate more closely. Budget cuts/layoff would be covered, termination for misconduct could result in disqualification. Be truthful on your claim about the actual reason - misrepresenting it can cause bigger problems later.

For the job search requirement - once you're approved and claiming benefits, California EDD requires you to conduct a certain number of job search activities per week and keep a record of them. Make sure you understand this requirement from day one. You'll need to document at least 3 job search activities per week during your claim period.
0 coins
LilMama23
AuthorDo they ever actually ask to see the job search log or is it just something you maintain yourself?
0 coins
Zainab Mahmoud
EDD can request your job search records during an audit. They don't always, but it happens. Keep detailed records - employer name, contact information, position applied for, date, and method of contact. Don't just write vague notes.

TechNinja
I got audited on my job search activities once. had decent records but they were pretty casual. they accepted them but definitely learned my lesson to keep better records after that

Something else worth knowing: your base period earnings determine your weekly benefit amount. California EDD typically looks at the first four of the last five completed calendar quarters before you filed. With 6 years of employment you've probably got solid wages in there, which means your weekly benefit could be closer to the maximum. The max weekly benefit amount in California is currently $450. Not a full replacement of income obviously but something.
0 coins
LilMama23
AuthorThat's lower than I expected honestly. I was hoping it would cover more of my expenses.
0 coins
Tyrone Johnson
yeah it's rough. UI is really designed as a bridge not a full replacement. the job search requirement is also there to keep people actively looking rather than treating it as a long-term solution

and benefits typically last up to 26 weeks in California assuming no extensions. so about 6 months to find something new

Update on the Claimyr thing since a few people asked - I also used it when I had a question about my claim status after my position was eliminated and there was a discrepancy in my benefit amount calculation. The EDD agent I got connected to was actually helpful and walked me through how my base period wages were calculated. For stuff like that where you really need a human to look at your specific claim, having a way to actually reach someone is worth a lot. Website is claimyr.com, demo video at https://youtu.be/JmuwXR7HA10

The way I think about it - I spent weeks trying the regular EDD phone line and got nowhere. At some point you just need to talk to a person and if this gets you there it's worth it.

FOR THE LOVE OF EVERYTHING do not forget to file your weekly certifications on time. I know everyone says this but I missed ONE week during adjudication thinking it didn't matter since my claim wasn't approved yet and I lost that week permanently. EDD does not give extensions. does not make exceptions. file every single week even if you're in adjudication even if you haven't received a dime yet.

AuthorOkay this is now the third time someone has told me this so I am absolutely going to set a weekly alarm. Noted!

the certification window is Sunday through Saturday and you can file starting on Sunday. most people do it Sunday morning to get it out of the way for the week
0 coins
Yara Assad
one thing i havent seen mentioned - when you do your weekly certifications it asks if you were able and available to work each day and if you did any work. if you pick up any freelance or temp work during your claim period you need to report it. EDD will cross-reference tax records and unreported income can result in an overpayment notice and potential penalties. just be honest on everything
0 coins
LilMama23
AuthorI wasn't planning on doing any freelance but good to know. What if I do like a one-time thing for a neighbor or something, does that count?
0 coins
Yara Assad
technically yes any income should be reported. practically speaking one small thing is unlikely to cause issues but it's genuinely better to just report it. EDD will take any amount earned that week into account and adjust your benefit payment accordingly rather than disqualifying you.
0 coins
Raj Gupta
This is correct. California EDD has a partial benefit formula - if you earn wages during a week you're claiming, they calculate your benefit using an earnings disregard provision. You don't lose all your benefits just because you earned some money that week, but you do need to report it accurately.

Late to this thread but just wanted to say - I was in your exact situation six months ago and wanted to give you some hope. Position eliminated after 8 years, applied for California EDD unemployment, went through a brief adjudication period, got approved and received benefits for about 4 months before landing a new job. The system actually worked the way it's supposed to in my case. Hang in there.

Good luck! One last tip - after you file online through UI Online, screenshot your confirmation and note your claim ID number somewhere safe. You'll need it for any calls or correspondence with EDD.

Great advice on the confirmation screenshot. Also sign up for text or email notifications in your UI Online account so you get alerts when there's any movement on your claim rather than having to log in constantly to check.
