Back to California Unemployment

Romeo Quest

If I was fired can I get unemployment through California EDD?

So I got let go from my job last week and I'm trying to figure out if I even qualify for unemployment benefits. My manager called me into a meeting and said they were letting me go, gave me some vague reason about performance but never gave me anything in writing. I worked there for almost two years doing warehouse logistics. I'm not sure if being fired means I automatically don't qualify or if it depends on the reason. I went to the California EDD website and started filling out the application but there's a section asking WHY I left my job and I don't know what to put. Do I just say fired? Does it matter what the reason was? I'm panicking a little because rent is due in 3 weeks and I have no idea how long this process takes or if I'll even get approved. Has anyone been through this?

Good news - being fired does NOT automatically disqualify you from California EDD unemployment benefits. A lot of people think that but it's actually a misconception. What matters is WHY you were fired. California EDD looks at whether you were terminated for 'misconduct' as defined under California Unemployment Insurance Code. If you were let go due to performance issues, lack of skills, or just not being a good fit for the role, that typically does NOT count as disqualifying misconduct. You'd likely qualify. Misconduct that CAN disqualify you is stuff like deliberately violating company policy, theft, harassment, things like that. Performance-based terminations usually result in approval. Just be honest on your application and describe what happened accurately.

0 coins

That's really reassuring actually. They kept saying 'performance' but never wrote me up or gave me any formal warnings. Does that matter?

0 coins

Yes that actually works in your favor. If there were no formal write-ups or documented warnings, it's harder for the employer to prove willful misconduct. Keep any emails or communications from your employer that might support your side of things just in case.

0 coins

This is correct. The burden is actually on the employer to prove misconduct, not on you to prove you didn't do anything wrong. California EDD will contact your former employer as part of the process.

0 coins

I was fired back in February and just got approved last month so yes you can definitely get unemployment if you were fired. Mine took forever to process because my old employer contested it but I still won. The key is just being honest and consistent in everything you tell California EDD. Don't try to spin the story, just tell them exactly what happened. They're going to call your employer too and if your stories don't match it raises red flags.

0 coins

Did you have to do an interview or anything? I'm nervous about talking to someone from EDD.

0 coins

Yeah I had a phone interview called an eligibility interview. They just ask you questions about the separation. Just stay calm and stick to the facts. It's not as scary as it sounds.

0 coins

Same experience here. Got fired, applied, had a phone interview, got approved. The interview was like 20 minutes. They're not trying to trick you they just need to understand what happened.

0 coins

One thing that tripped me up when I filed after being fired - on the application where it asks reason for separation, make sure you select 'Discharged/Fired' not 'Quit' or 'Laid Off.' This sounds obvious but I've seen people get confused and pick the wrong thing which causes problems. After you submit, California EDD will open an investigation into your separation and contact your employer. This is called adjudication. It might take a few weeks. While you're waiting, keep certifying for benefits every two weeks on UI Online because even if your claim is pending you'll get backpay once it's approved.

0 coins

Wait so I should still file my weekly certifications even before I'm approved? I thought I had to wait.

0 coins

Yes definitely! File them as soon as they become available. If you don't certify, you lose those weeks permanently and can't get them back. A lot of people make this mistake and lose out on weeks of benefits they were owed.

0 coins

THIS. I lost like 3 weeks of benefits because nobody told me to keep certifying during adjudication. Don't make my mistake OP.

0 coins

Also if you need to actually talk to someone at California EDD about your claim status or the adjudication process, getting through on the phone is a nightmare. I tried calling for days when mine was stuck. Someone in another thread mentioned Claimyr (claimyr.com) and honestly it saved me so much stress. They basically get you connected to an actual EDD agent without you sitting on hold forever. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 if you want to check it out before trying. I got through in a fraction of the time I would have spent on hold.

0 coins

I've been trying to call EDD and keep getting the 'call volume too high' message. I'll look into that, thanks.

0 coins

does this actually work? sounds too good to be true lol

0 coins

I was skeptical too but it worked for me. Got connected to a real agent who actually explained what was happening with my claim. Way better than waiting on hold for hours or getting hung up on.

0 coins

gonna try this. been trying to reach EDD for 2 weeks about my own situation

0 coins

ok so real talk - i got fired for 'attitude problems' which felt super unfair and I still got approved. My employer said I was insubordinate but I explained my side during the eligibility interview and EDD sided with me. Don't assume being fired means you're out automatically. File the claim and let EDD sort it out. Worst case you get denied and then you can appeal.

0 coins

Did the appeal process take a long time? I'm worried about not having income for months.

0 coins

My situation got approved without needing to appeal but I know people who've appealed and won. It does take longer though, sometimes a couple months. That's why filing right away is so important.

0 coins

Just to add some technical context here - California Unemployment Insurance Code Section 1256 defines what constitutes disqualifying misconduct. The California Supreme Court case Paratransit v. CUIAB is actually the leading case on this. Under California law, misconduct requires a willful or wanton disregard of the employer's interests, not just poor performance or inability to meet standards. So the bar for disqualification is actually fairly high. Employers frequently contest claims hoping claimants won't appeal, but California EDD adjudicators do look at the evidence carefully.

0 coins

This is really good to know. My employer definitely contested my claim hoping I'd just give up. I didn't and I won.

0 coins

So basically EDD has to find that I INTENTIONALLY did something wrong, not just that I made mistakes?

0 coins

Essentially yes. Negligence and poor performance aren't misconduct under California law. It has to be more like deliberately doing something you knew violated the rules and could get you fired.

0 coins

wish someone told me this 2 years ago when I just accepted a denial without appealing. turned out I probably would have won.

0 coins

THE CALIFORNIA EDD SYSTEM IS SO BROKEN. I was fired unfairly and it took them 9 weeks to even schedule my eligibility interview. Nine weeks!! Meanwhile I'm behind on everything. Filed every two week cert like I was supposed to, jumped through every hoop, and just had to wait and wait. Even after I was approved the back pay took another week to hit my account. They need more staff or something because this is not okay for people who lost their income through no fault of their own.

0 coins

the wait times are honestly brutal. I feel you. Mine took 7 weeks and those were some of the most stressful weeks of my life.

0 coins

This is making me even more anxious. I really can't go 9 weeks without income...

0 coins

The wait times are real but also vary a lot. Some people get processed in 2-3 weeks. It depends on your employer's response time and claim complexity. Filing immediately, certifying consistently, and responding quickly to any EDD requests speeds things up.

0 coins

Yeah I don't mean to scare you OP. Mine was complicated because employer kept requesting extensions. Simpler cases go faster.

0 coins

quick question for anyone who knows - if my employer says I was fired for misconduct but I think that's not true, what do I do? do I just say my version and hope EDD believes me?

0 coins

You tell your version clearly and provide any evidence you have. Emails, texts, performance reviews, anything that supports your account. California EDD will weigh both sides. If they deny you, you absolutely can and should appeal to the California Unemployment Insurance Appeals Board (CUIAB). Many people win at the appeal stage when they lose initially.

0 coins

ok that's helpful. I have some text messages from my manager that I think back up my side.

0 coins

Save all of those texts and document everything while your memory is fresh. Screenshots, dates, context. You want to be as specific as possible if this goes to an interview or appeal hearing.

0 coins

i was fired last year and honestly the application process wasn't that bad. just fill it out completely and accurately, describe the reason for termination in your own words, and submit. then certify every two weeks on UI Online. the hardest part for me was just the waiting and not knowing.

0 coins

How long did yours take to process?

0 coins

about 4 weeks from application to first payment. not bad considering what I was expecting

0 coins

4 weeks is pretty typical for straightforward cases in my experience. OP yours sounds like it might be straightforward so hopefully similar timeline.

0 coins

One more thing - make sure you're meeting the job search requirements while your claim is pending AND after you're approved. California EDD requires you to make 3 job search contacts per week and log them. A lot of people don't realize this starts immediately after filing. If EDD audits your job search log and you haven't been documenting contacts, it can create problems with your claim. Use CalJOBS to log your searches - it syncs with your EDD account.

0 coins

Wait I didn't know about this. Does this apply even while I'm waiting to be approved?

0 coins

Yes it starts from your first week of claiming. You certify every two weeks and they ask if you did your job search each week. You need to actually be doing it and have documentation. Calljobs.ca.gov is the state system for this.

0 coins

I got a letter asking me to verify my job search contacts once. Scared me half to death but I had them all logged so it was fine. Don't skip this step.

0 coins

Also worth noting - if you're actively interviewing for jobs that's usually enough to meet the requirement. You don't necessarily need 3 formal applications every week, just documented contacts with employers.

0 coins

Something nobody mentioned - the EDD base period matters for eligibility too. You need to have earned enough wages in what they call the 'base period' - which is roughly the first 4 of the last 5 completed calendar quarters. If you only worked 8 months at this job you'll want to double-check that you meet the minimum earnings threshold. The EDD website has a calculator but I'm not sure exactly where.

0 coins

Good point. The standard base period earnings requirement for 2025 is earning at least $1,300 in one quarter OR at least $900 in your highest quarter with total base period earnings of 1.25x that highest quarter amount. Given OP worked there almost 2 years they likely meet this easily.

0 coins

Right, 2 years of warehouse work almost certainly meets the threshold. Just important for people who only worked a short time to check.

0 coins

I worked there 22 months so hopefully that's fine. Thanks for flagging it though.

0 coins

I went through this exact situation - fired, didn't know if I'd qualify, nervous about the whole process. Ended up getting approved and the benefits really helped me stay afloat while I figured out next steps. Just wanted to say it's not hopeless and the process while annoying is navigable. The California EDD website actually has decent FAQ resources if you dig around. Also make sure to set up your EDD Debit Card through Bank of America early because there can be a delay getting it in the mail after approval.

0 coins

Oh I didn't even think about the debit card. How long does that usually take to arrive?

0 coins

Mine took about a week after approval. But I've heard some people wait up to 2 weeks. You can also set up direct deposit through UI Online which might be faster.

0 coins

Direct deposit is definitely faster. I'd recommend setting that up right away in your UI Online account settings instead of waiting for the card.

0 coins

lol i work in HR and honestly just between us, when we contest unemployment claims we're usually doing it because the company policy is to contest everything automatically. Most managers filing those responses don't even know the legal standard. Don't be intimidated by an employer contest. Most frontline HR people filling out those forms have no idea what disqualifying misconduct actually means legally.

0 coins

This is wild to read but honestly doesn't surprise me. So many people just accept a denial thinking their employer must be right.

0 coins

This tracks with what I've seen. Employer contests are often boilerplate. The EDD adjudicator still has to independently evaluate the separation. An employer saying 'misconduct' doesn't make it legally misconduct.

0 coins

I KNEW IT. My employer's contest was obviously just a form response they sent. The adjudicator saw right through it.

0 coins

OP if you do get stuck in adjudication for a long time and can't get answers from EDD online, seriously consider trying to call them. I know their phone lines are rough but reaching an actual agent can really clarify things. That's when I used Claimyr - you go to claimyr.com and they help you actually get through to an EDD representative. There's a demo video at https://youtu.be/JmuwXR7HA10 showing what to expect. The agent I reached was actually helpful and explained exactly where my claim was in the process and what was causing the delay.

0 coins

My claim has only been in for a week so I'll give it some time but good to know about this if I get stuck.

0 coins

I tried calling EDD last week three times and got the busy signal message every single time. Might try this claimyr thing.

0 coins

the hold times are real. i once waited 2.5 hours and then got disconnected right when someone picked up. absolutely brutal.

0 coins

does being fired affect my ability to get unemployment in other states if i move? asking for a friend who might relocate

0 coins

Unemployment is administered state by state. If you move to a new state you'd claim benefits from whichever state you worked in, not where you currently live. So the California EDD rules would still apply for work done in California. You'd file in California regardless of where you relocate.

0 coins

ok that makes sense, thanks

0 coins

Also you'd need to meet that state's able and available requirements which usually means being in that state and available to accept work there. If you're moving that's worth researching further.

0 coins

Just circling back to reassure OP - I know this thread has a lot of information and it can feel overwhelming. Here's the simple version: 1) File your claim immediately at California EDD website, 2) Select fired/discharged as your separation reason, 3) Describe what happened honestly, 4) Start certifying every 2 weeks right away even if pending, 5) Do your 3 job search contacts weekly and log them, 6) Respond quickly to any EDD requests or interview scheduling. That's basically it. The rest will work itself out.

0 coins

Thank you for this. I actually needed the simplified version. Going to go file right now.

0 coins

Good luck OP! Come back and let us know how it goes. Rooting for you.

0 coins

This is great advice. Starting the claim immediately is the most important thing. Every day you wait is a day you potentially lose benefits since EDD doesn't backdate claims before your application date.

0 coins

Random thing that helped me - when you do your eligibility interview (if they schedule one) take notes during the call. Write down the agent's name, the date and time, and the main points they said. California EDD agents sometimes give inconsistent information and having notes protects you if there's ever a discrepancy. I know that sounds paranoid but it saved me once when they claimed I hadn't reported something that I had.

0 coins

Not paranoid at all. Documenting everything with EDD is just basic self-protection. I do this too.

0 coins

That's actually really smart. I'll definitely do this.

0 coins

Also if you mail anything to EDD, always use certified mail with return receipt so you have proof they received it. They have a reputation for losing documents.

0 coins

The document losing thing is so real. I faxed something AND mailed it AND submitted online just to make sure at least one copy got through.

0 coins

UPDATE: tried Claimyr after someone mentioned it earlier in this thread. Actually got through to a California EDD agent within about 30 minutes. The agent pulled up my claim and told me it was in adjudication because my employer filed a contest but that it was assigned to an adjudicator. Just having that info made me feel so much better versus having no idea what was happening. Website is claimyr.com if anyone else is struggling to get through on EDD's regular phone line.

0 coins

ok this is convincing me to try it. been getting the busy signal for days

0 coins

Good to know it actually works. I'll keep this in my back pocket if my claim gets complicated.

0 coins

Glad it helped! Having a real human tell you what's actually happening with your claim is such a relief compared to just staring at a status screen that says nothing.

0 coins

One thing I want to add that nobody mentioned - if you get denied, DO NOT JUST ACCEPT IT. You have 30 days to appeal to the California Unemployment Insurance Appeals Board. I've seen people just give up when they get a denial letter and they're leaving real money on the table. The appeals process is a real hearing with an administrative law judge and the approval rate on appeal is significant especially for fired employees. File the appeal, show up, bring your documentation.

0 coins

Absolutely this. CUIAB appeal hearings are de novo proceedings meaning they look at everything fresh. You can present new evidence and testimony. Many denials get overturned at this stage.

0 coins

This is good to know. I really hope I don't need it but knowing there's a safety net helps.

0 coins

And if you can't afford an attorney for the appeal, there are free legal aid resources in California that help with unemployment appeals. Legal Aid Society, Bet Tzedek, and other nonprofits sometimes take these cases.

0 coins

Yeah I was going to go it alone on my appeal but found a free legal aid attorney who helped me organize my evidence and it made a huge difference in how confident I felt going in.

0 coins

To wrap up the key points for OP and anyone else finding this thread: Being fired does not automatically disqualify you from California EDD unemployment benefits. The question is whether the firing was for legally defined misconduct. Performance issues, skill gaps, personality clashes - these are not misconduct under California law. File your claim right away, be honest about why you were fired, certify every two weeks, document your job search, and respond promptly to EDD. If denied, appeal within 30 days. Good luck OP - it sounds like your situation is exactly the type where people typically do get approved.

0 coins

Thank you so much. This whole thread has been incredibly helpful. I feel so much better about my situation. Filing my claim tonight.

0 coins

Good luck! The waiting is the hardest part but you've got this.

0 coins

One last thing - after you file note your exact application date. Your benefit year starts on that date and you can only collect within that year. Getting it filed tonight is the right call.

0 coins

Also bookmark UI Online and set calendar reminders for your certification dates. Missing a certification window is one of the most common and easily preventable mistakes people make. You have to certify within specific windows or you lose that week.
