EDD rep entered wrong claim date - need help with backpay decision timeline before eviction
I'm in a really tough spot and need advice from anyone who's been through this. An EDD rep processed my unemployment claim last month but entered the wrong start date - she put April 2025 instead of March 2025. Because of this error, I had to go through a special eligibility interview for what they're now considering "backpay" even though it was THEIR mistake not mine! The interview was completed 8 days ago, but I still don't see any updates on UI Online. I'm now a month behind on my $2,100 rent and my landlord is threatening eviction. I've explained the situation, but he's not being understanding at all. Does anyone know how long EDD typically takes to make these backpay decisions after the interview? Are there ways to expedite it given my housing situation? I've tried calling multiple times but can't get through to anyone who can help.

After an eligibility interview for backpay, EDD usually takes 10-14 business days to make a decision. Sometimes faster, sometimes slower depending on their workload. Since it's been 8 days, you might hear something this week, but there's no guarantee. You should try calling EDD first thing in the morning (exactly at 8:00am) when their lines open. Be persistent and keep calling. Sometimes it helps to select the Spanish language option and then ask for English assistance when someone answers - the Spanish queues are often shorter.

•Thanks for the info. I've been trying to call right at 8am but keep getting the "we're experiencing high call volume" message and then it hangs up. I'll try the Spanish option tomorrow morning. Do you know if there's any way to explain my eviction risk to them to get my case prioritized?

•5 weeks?! I can't wait that long - I'll be homeless. Did you try anything that seemed to help speed things up?

I've been through something similar with EDD making an error on my claim date. Here's what worked for me: 1. Contact your State Assembly member's office immediately. They have EDD liaisons who can escalate your case. Google "[your county] state assembly member" to find yours. 2. Get documentation from your landlord about the eviction threat - this helps prove hardship. 3. While waiting, ask your landlord if you can make a partial payment to show good faith. Some landlords will work with you if they see you're making an effort. 4. File a formal complaint through EDD's website about the incorrect date entry. Document everything. The backpay interview decision typically takes 7-21 days, but with an assembly member's help, it could be faster. Good luck!

•Thank you so much for these detailed suggestions! I didn't know about contacting my State Assembly member. I'll look them up right away and reach out. My landlord has already said he won't accept partial payment, but maybe if I show him I'm working with a government official he'll be more patient. I really appreciate your help.

If u cant get thru to EDD try Claimyr.com. That service helped me get thru after 2 weeks of failed calls. They connect u to an EDD rep without all the waiting and hangups. They have a video demo here: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km Worth it when ur facing eviction imo. EDD reps can sometimes push backpay decisions when there's urgent situations like eviction.

•Is that service legit? Seems sketchy to pay someone else just to call EDD for you when you can do it yourself for free...

•Yeah its legit. I used it twice. They don't call for u - they just connect u to an actual EDD rep so u can explain ur situation urself. I wasted like 90+ calls trying to get thru on my own before using it.

•It depends on how much time passed between when the error was discovered and the original claim date. If it's been more than 14 days, EDD often requires an eligibility interview for backpay because they need to verify you were eligible during that period. They're checking you were actually unemployed, available for work, etc. during those weeks. System is frustrating but that's their process.

THE SYSTEM IS DESIGNED TO MAKE YOU GIVE UP!!!! I've had THREE different EDD reps give me THREE different answers about my claim date issue. One said it would take 3 days, another said 3 WEEKS, and the third said there was no timeframe at all!!! They're hoping you'll just stop fighting and go away. My advice: call EVERY SINGLE DAY and document EVERY conversation (get badge numbers!!!). Tell them you're facing imminent eviction and need supervisor intervention. Keep escalating until someone helps. And don't let your landlord illegally evict you - in California they MUST go through proper court procedures which takes time. Know your rights!!!!

•I'm definitely not giving up - too much at stake. I'll start documenting every interaction like you suggested and ask for badge numbers. Good reminder about tenant rights too - I should probably look into those more so I understand the eviction timeline. Thanks for the encouragement!

Just wanted to add something important: make sure you've certified for all weeks including the ones in the disputed period. Some people make the mistake of not certifying for weeks they're waiting on a backpay decision for, but you should still complete all certifications even while waiting. Otherwise, when they do approve the backpay, you'll face another delay because you haven't certified.

•Oh! I wasn't sure about this - I've been certifying for current weeks but not for the backpay weeks because I thought I couldn't until they fixed the date. Should I go back and try to certify for those earlier weeks too?

•Yes, if UI Online allows you to certify for those earlier weeks, definitely do it now. If the system doesn't show those weeks as available for certification, make sure to mention this specifically when you speak to a representative. They can sometimes unlock those weeks for certification while you're on the phone with them.

just a thought but do u have any emergency rental assistance options in ur area? might help buy time while EDD figures their mess out

•That's a good idea - I hadn't thought about rental assistance. I'll look into what's available in my county. Anything to buy some time would be helpful right now.

•Update for anyone in the same situation: I finally got through to EDD yesterday using the State Assembly member contact method someone suggested! They're expediting my case due to the eviction risk, and the rep said I should see a decision by Friday. Also, my landlord agreed to wait until then after I showed him the email from the Assembly office. Will update again when I know more!
