EDD backdate appeal denied without explanation - possible to reopen in 2025?
I'm at my wit's end trying to resolve a backdate issue from my pandemic unemployment claim. I got laid off from my restaurant job in March 2023 but struggled with the UI Online system and didn't successfully file until August 2023. This means I missed out on approximately $8,500 in regular benefits plus the additional $750/week supplement during those months.\n\nAfter countless attempts through UI Online messaging (which either went unanswered or got generic responses), I finally managed to submit a formal backdate request. After waiting nearly 7 weeks, I received a denial letter with literally NO explanation - just a checkbox marked 'denied'.\n\nI tried appealing but my appeal was apparently lost in their system. I gave up for almost a year because the phone situation was impossible - calling 80+ times daily only to get disconnected. \n\nFast forward to last week - miracle of miracles - I actually reached a live EDD representative! She reviewed my account history and openly admitted my backdate request SHOULD have been approved, saying it looked like a system error on their end. But then she delivered the gut punch: "there's nothing we can do now because too much time has passed." When I explained I'd been trying to contact them constantly, she just shrugged it off.\n\nHas anyone successfully reopened a denied backdate claim after a significant time has passed? Is there a supervisor tier I can reach? An ombudsman office? I have documentation proving I was eligible during those months. This is life-changing money that I'm rightfully owed! Any advice would be so appreciated.

Thanks for sharing your experience. It's incredibly frustrating that they can just blame

You might still have options. The EDD has a formal Appeal process that goes through the California Unemployment Insurance Appeals Board, which is separate from EDD. You normally have 30 days to file an appeal from the date of denial, BUT you can request a \

meh dont waste ur time. edd doesnt care about u once ur claim is over. my cousin works for the state (not edd but knows ppl) says they purge old records and u cant fight stuff from last year. sorry but probly too late

This is incorrect. EDD is required by law to maintain records for at least three years, and the Appeals Board operates independently from EDD. I've personally helped clients receive backdated benefits from claims over a year old. While it's more challenging, it's definitely not impossible if you follow the proper procedures.

I HAD THE EXACT SAME PROBLEM!!! Laid off Feb 2023, couldn't file until June because their stupid website kept crashing!!! Lost THOUSANDS in benefits! Called 50+ times a day for MONTHS! Absolute nightmare! They should be investigated for how they treated people!!!!

It's simultaneously comforting and infuriating to know so many others experienced this. Did you ever find any resolution? I'm seriously considering contacting a state representative about it.

NO RESOLUTION! Just gave up after months of trying! The whole system is BROKEN BY DESIGN! They WANT us to give up so they don't have to pay what they owe us! Criminal!!!

If regular channels aren't working, I'd suggest trying to reach a Tier 2 specialist at EDD. The frontline reps often don't have the authority to resolve complex issues like backdating claims from previous years.\n\nI was in a similar situation last year and finally got through using Claimyr (claimyr.com). They basically hold your place in the EDD phone queue and call you when they have an agent on the line. Saved me from hundreds more redial attempts. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km \n\nWhen you do get through, specifically ask for a Tier 2 specialist who can handle backdate appeals. Be sure to mention that a previous rep confirmed it was an EDD system error. Document the name and ID of every person you speak with.

I've never heard of Claimyr before! That sounds so much better than what I've been doing. Did you have to specifically request a Tier 2 specialist when you got through? I didn't even know there were different tiers of representatives.

Yes, you need to specifically ask for a Tier 2 specialist. The first person who answers is usually just a screener. Politely but firmly explain that your issue requires a Tier 2 specialist with authority to handle backdating from previous benefit years. Don't let them rush you off the phone with promises to \

my heart goes out to you...this happened to me too. i was a substitute teacher who couldn't file right away because the system kept saying i wasn't eligible (which was wrong). by the time i got through to someone who fixed it, i lost 3 months of benefits. what helped me was writing a hardship letter explaining exactly how this affected me financially - had to move in with parents, couldn't pay medical bills, etc. i sent it through the appeal process and surprisingly got about half of what i was owed. not perfect but better than nothing. make it personal and specific about how this impacted your life.

Thank you for this advice. I hadn't thought about focusing on the personal hardship angle, but that makes a lot of sense. I definitely experienced significant financial strain during those months - maxed out credit cards, borrowed from family, and nearly lost my apartment. I'll make sure to detail all of that in my appeal.

As someone who's navigated the EDD backdate process successfully (though it took almost 8 months), here's what actually works:\n\n1. You need to file a formal appeal using form DE 1000M specifically citing \

This is incredibly detailed and helpful - thank you! I had no idea about UI Code Section 1032(a). That seems directly applicable to my situation since the representative admitted it was their system error. I'm going to follow your advice step by step.

ive heard people talk about getting a lawyer for edd stuff. probably costs more than what youd get back tho lol. but maybe worth asking bout a free consultation?

Most employment attorneys won't take EDD cases unless they're very large claims. However, there are several free legal aid organizations that specifically handle EDD issues. Try Legal Aid at Work, Bay Area Legal Aid, or your county's legal assistance foundation. They often have unemployment insurance specialists who can help with appeals at no cost.
