EDD interview about wrong employer - trying to disqualify me after 3 years?

I just had the strangest interview with EDD and I'm completely panicking. They sent me a notice for an eligibility interview about an employer I've NEVER worked for. So I thought, no big deal, just a mix-up. When the interviewer called, she started grilling me about a job from 3 YEARS ago that I quit during the height of COVID! I was totally unprepared for this bait-and-switch. I told the interviewer I needed more time since I wasn't notified about which employer they'd be asking about, but she refused to reschedule and only gave me 48 hours to provide documentation. This job they're suddenly investigating was during 2020 when I quit due to severe anxiety and stress during the pandemic. I was seeing a therapist at the time and everything. I'm almost certain this issue went through appeals already years ago, but now they're asking for medical documentation from 3 years back! I'm absolutely terrified they're trying to retroactively disqualify me and demand repayment of around $14,000 in benefits from that period. Has anyone dealt with EDD suddenly reopening old claims like this? What medical documentation would I even need after all this time? My doctor from back then moved practices!

This happened to me last year! They suddenly started asking about a job from 2 years prior. EDD is on a mission to collect overpayments. Here's my advice - pull together ANY medical documentation you can find from that time - even pharmacy records showing anxiety meds or therapist billing statements. The 48 hour deadline is BS, but if you don't respond, they'll automatically disqualify you. You need to submit something, even if incomplete, and explain you need more time to gather the rest due to their error in notification.

Thanks for the quick reply. So frustrating! I'll start gathering whatever I can find today. Do you think a letter from my current doctor explaining that my previous provider moved practices would help? I'm so scared about that 48 hour deadline...

Ya its crazy how they just randomly pick people to investigate. My neighbor got hit with a 22k overpayment last month for something from covid days. They say its some kind of audit program where there checking old claims. Good luck!!

You need to understand exactly which claim period they're investigating. EDD has been conducting retroactive eligibility reviews as part of their fraud prevention program. If you quit due to COVID health concerns and had medical documentation, you *should* still qualify under the rules that were in place at that time. Here's what you need to do: 1. Request clarification in writing regarding which specific weeks they're investigating 2. Ask for an extension based on their failure to properly notify you about the correct employer 3. Submit a written statement explaining your medical situation during COVID 4. Contact your former medical provider's office to request records transfer 5. If they disqualify you, immediately file an appeal - you'll get more time to gather evidence The 48-hour deadline is unreasonable and you should document your attempts to comply despite the short notice.

Thank you for the detailed advice. Do I need to request clarification through UI Online or call them directly? I'm worried about the ticking clock... And if they do disqualify me, will they immediately start collecting the overpayment before my appeal is heard? I can't afford to suddenly pay back $14k!

Have you tried calling EDD to get more information? I know it's nearly impossible to reach anyone there, but I've had success using Claimyr (claimyr.com). They have this system that calls EDD for you and gets you through to a live agent. They have a video demo at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km that shows how it works. I was skeptical at first but it saved me hours of frustration when I was dealing with a similar interview issue. Getting a live agent might help you explain the situation and get that deadline extended.

Yeah, it worked for me. Their system keeps dialing until it gets through. Took about 30 minutes instead of days of redialing. Definitely worth it when you're in time-sensitive situations like this.

Everyone needs to calm down a bit here. The EDD generally doesn't reopen cases that have already gone through appeals unless there's either new information or suspected fraud. A couple of questions: 1. Are you ABSOLUTELY CERTAIN this specific job issue was already appealed and resolved in your favor? Or is it possible this particular job separation was never fully addressed? 2. Were you on regular UI or PUA during 2020? The rules were different for each. 3. Did you receive a specific form number? DE 4800? DE 1080CTO? The form might give clues about what they're investigating. Just because they're asking questions doesn't automatically mean they're going to disqualify you and demand repayment. They have a legal obligation to investigate eligibility, even retroactively. I'd focus on gathering what you can within 48 hours and requesting additional time in writing.

You're right, I need to take a deep breath. To answer your questions: 1. I'm not 100% certain it went through appeals. I remember answering questions about this job when I first applied, but maybe it wasn't formally resolved. 2. I was on regular UI in 2020, not PUA. 3. The form I received is DE 4800, but it listed the wrong employer name completely. I'm going to start gathering my documentation today. Thank you for the perspective.

i had something like this happen but with a different twist they asked me about a job from 2 years ago that i DID work at but quit because my boss was literally screaming at everyone daily... anyway i just told them the truth and they actually ruled in my favor said hostile work environment was good cause to quit... just be honest with them

Thats good to hear! I think the pandemic rules were different tho, right? Like you could quit for safety concerns and still get benefits? But maybe those rules expired?

To respond to your question about UI Online vs. calling - do BOTH. Submit a message through UI Online (keep a screenshot as proof) AND try to reach them by phone. The DE 4800 form indicates they're questioning your eligibility for a specific period. Regarding immediate collection - they can't start collection until they issue a formal overpayment notice. If they disqualify you, you'll first receive a Notice of Determination. You then have 30 days to appeal that determination, which puts any collection on hold. If you had documented medical issues during COVID that prevented you from working, that should still qualify as good cause for leaving work, even under regular UI rules (not just the special pandemic rules). The key is proving you had no reasonable alternative but to quit.

Thank you so much for clarifying. I'm relieved to hear they can't immediately start collecting. I'm going to call first thing tomorrow morning and then submit documentation through UI Online as well. If they do try to disqualify me, I'll definitely appeal within that 30-day window. This has been super helpful - I was panicking thinking they could just start garnishing my wages with no warning.

One more tip - when you submit your documents, make sure to include a cover letter clearly stating: 1. You were not properly notified about which employer would be discussed 2. You are submitting what you can within their unreasonable timeframe 3. You reserve the right to submit additional evidence Based on my experience, they're looking for ANY reason to disqualify you, so be very precise in your wording. Don't say you "think" you had good cause - state confidently that you "had documented medical conditions that constituted good cause for leaving employment during the COVID-19 pandemic." The language matters!

THIS is why i hate the EDD!!!! they trick you with wording and then use it against you later!!! the whole system is designed to deny benefits we DESERVE!!!!

Wait I'm confused... if you already went through appeals for this job but they're asking again, isn't that double jeopardy or something? Can they really make you prove the same thing twice?

Double jeopardy is a criminal law concept that doesn't apply to administrative determinations like unemployment. EDD can review cases if they have reason to believe there was an error or incomplete information in the original determination. That said, if the OP genuinely already appealed this specific separation and won, they should reference the previous case number and determination in their response.

UPDATE: I managed to get through to EDD this morning! The agent explained that they're doing a standard audit of claims from the pandemic period. Apparently, this employer I've never heard of got mixed up in my file somehow. She noted the error on my account and said I should still provide documentation about the job I actually quit in 2020, but she extended my deadline to 10 days instead of 48 hours. I'm still gathering my medical records, but I'm feeling much less panicked now. Thanks everyone for your advice!

That's excellent news! The 10-day extension gives you reasonable time to gather proper documentation. Make sure to get the agent's ID number or name for your records in case you need to reference this conversation later. I'd still recommend submitting a brief written statement through UI Online acknowledging the call and the extension, just to have a paper trail. Glad you got some clarity!
