EDD disqualified me after working part-time - how to prove I didn't earn $4250?

I'm seriously stressing out right now. I've been on partial unemployment for 3 months while working part-time (20-25 hrs/week) at a restaurant. I've been super careful to report ALL my earnings each certification period. Yesterday I got this notice saying I'm disqualified because I supposedly earned $4,250 in March that I didn't report?? That's absolutely insane - I barely make $1800 in a GOOD month with tips! My paystubs clearly show this. The letter says I have 30 days to appeal but I've never done that before. Has anyone successfully appealed something like this? Do I need to gather all my paystubs and bank statements? I can't afford to pay back benefits I legitimately qualified for!

Don't panic! This happens more often than you'd think. Yes, you should 100% appeal this disqualification. You'll need to gather ALL your paystubs from that period, your bank statements showing deposits, and any tip records you might have. The appeal process isn't as scary as it sounds - you'll submit a written statement explaining the mistake along with your documentation. Make copies of EVERYTHING before sending. Good luck!

Thank you! Do I need to keep certifying for benefits while this appeal is happening? Also, is there a specific form for submitting the appeal??

Yes, you should definitely continue certifying while your appeal is pending. The appeal form is DE 1000M, but you can also submit online through your UI Online account by clicking the \

If you're struggling to reach EDD by phone, try using Claimyr. I was in the same boat with a similar wage discrepancy issue and couldn't get through for days. They connected me with an EDD agent in less than 30 minutes. It saved me so much time and stress. You can check them out at claimyr.com - they also have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km. My issue got resolved in one call once I actually spoke to a real person at EDD.

THE SAME THIGN HAPPENED TO ME!!!!! EDD claimed I didn't report $3700 when I was only making like $1500/month at my part-time job. Turns out my employer reported my quarterly earnings all at once instead of breaking it down by month. I appealed and WON but it took like 8 weeks to get resolved. The worst part was they stopped all payments during the appeal which was TERRIBLE. Make sure you have a backup plan for bills while this gets sorted.

Oh no! I didn't realize they might stop payments during the appeal! I don't have any savings right now... did you have to do the appeal hearing in person or was it over the phone?

mine was over the phone but that was during covid. now i think they do them in person OR phone depending on what you select. the judge person was actually really nice and understanding. just be super organized with your evidence!!!

I actually work in payroll and see this kind of issue regularly. There are a few common causes for this kind of discrepancy:\n\n1. Employer error - They might have reported wages for the wrong person or wrong period\n2. Data entry error at EDD - Someone might have added an extra digit\n3. Identity mix-up - Someone with a similar name/SSN might have had their wages attributed to you\n4. Quarterly reporting confusion - As someone mentioned, quarterly amounts being incorrectly allocated\n\nWhen you appeal, request a copy of your wage records from EDD to see exactly what was reported. This will help you identify where the error occurred. Also contact your employer's payroll department immediately, as they can submit a wage correction if the error was on their end.\n\nBe aware that appeals are currently taking 6-10 weeks to process in California.

Thank you so much for this detailed response! I'll request the wage records right away. How do I do that? Is there a specific form or do I just call EDD (if I can get through)?

You can request your wage records by submitting form DE 8714 (Request for Wage Information). It's available on the EDD website. You can also sometimes view this information in your UI Online account under \

i hate EDD sooooo much!!! they do this on purpose to try to get people to give up and not appeal. my friend had almost this exact situation and she got so stressed she just didn't appeal and now owes like $7k in overpayment that she didn't even get!!! THE SYSTEM IS RIGGED AGAINST US!!!! 😡😡😡

While the system can definitely be frustrating, I don't think they intentionally disqualify people. These are usually honest mistakes or system limitations. Always appeal if you believe there's an error - the success rate for appeals with proper documentation is actually quite high.

UPDATE: I finally got my paystubs together and found something weird - there's a second employee with almost my exact same name at our restaurant chain (different location). I'm wondering if their wages got mixed up with mine somehow? Going to bring this up in my appeal. I'm feeling a little better now that I have a possible explanation.

That's likely your answer right there! This is a common issue, especially with large employers with multiple locations. Contact your company's HR department immediately and explain the situation. They should be able to submit a corrected wage report to EDD which might resolve this before you even need the appeal hearing. Make sure to document your conversation with HR.

Great detective work! This is exactly the kind of specific information that makes appeals successful. Definitely highlight this in your appeal statement and bring any documentation showing the other employee exists (if you can get it without violating privacy). The more specific your explanation of the error, the better your chances of a quick resolution.

my cousin works at edd (not posting which office lol) and she says they are SUPER understaffed right now and making tons of mistakes. if u can actually talk to a real person they can fix a lot of stuff without even needing the formal appeal!!

I had a similar wage discrepancy that was driving me crazy because I couldn't get through to EDD on the phone. I found this service called Claimyr that connected me to an EDD representative in about 20 minutes after days of failed attempts. The representative was able to see exactly what caused my wage reporting error and flagged it for correction. Saved me from going through the whole appeal process. Their website is claimyr.com and they have a video that shows how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km

I'll check this out right now! I'm desperate to talk to someone at EDD before filing the appeal. Thank you!!

One more important tip: If you do need to proceed with the appeal, make sure to check the box requesting a continuance of benefits during the appeal process. This isn't automatically granted, but if your case looks legitimate, they may continue your payments while the appeal is pending. This can be a lifesaver financially.

when i went through this, the judge asked me to explain in detail how i calculated my weekly earnings for certifications. make sure u review how u did this and can explain ur method. they also asked if i got paid under the table or had cash tips i didnt report. be honest about EVERYTHING.
