EDD check already issued with wrong employer - need to report payroll company instead?

I'm stressing out about what might be a technical error on my UI claim. I just completed a 3-week contract job and correctly certified my earnings each week. When filling out the employer info, I listed the actual company I worked for (ABC Marketing) as my 'last employer' rather than their payroll company (PayFlex Solutions). EDD already processed everything and I received a benefit check yesterday, but now ABC Marketing contacted me saying I should have listed PayFlex as my employer since they handle all payroll and tax reporting. I haven't cashed the check yet because I'm worried this error might cause problems later. Do I need to contact EDD to fix this employer information even though they've already issued payment? Will this be considered false information if I cash the check? Also, I've been trying the main 800-300-5616 number for two days but keep getting the 'too many callers' message and getting disconnected. Is there any specific extension or alternative number to get this fixed quickly? Really appreciate any advice!

You should be fine cashing the check. The important thing is that you reported your earnings correctly when certifying. The 'last employer' technicality is more for their records and tax reporting purposes. Since the payroll company and the actual company are connected in EDD's systems through tax ID numbers, it usually gets sorted out on the backend. I'd still recommend contacting EDD to update your records though, just to avoid any potential issues during quarterly wage reviews. But this isn't an urgent emergency situation - go ahead and cash that check!

Thank you SO much for the reassurance! I've been staring at this check for days worried I'd be penalized for fraud or something. I'll definitely still try to reach EDD to update the info, but it's good to know I can cash it without immediate consequences.

Oh no, that's exactly what I'm afraid of! Did you have to pay anything back or did they just correct the records? How did you finally get it resolved?

they finally fixed it but i had to send in paystubs to prove i wasnt lying about the work...just a big hassle and no payments for weeks

This is actually a common mix-up with PEO (Professional Employer Organizations) and payroll companies. The W-2 employer should technically be listed as your employer for EDD purposes. If PayFlex is on your W-2, then yes, they should be listed as your employer. However, it's not so critical that you need to hold off on cashing the check. The important part is that you reported your earnings correctly. I would recommend these steps: 1. Cash the check - this won't be a problem 2. Contact EDD to update your employer information (this is for future reference) 3. Be prepared with your paystub that shows PayFlex as the employer of record As for calling, the main number is honestly a nightmare right now. I used a service called Claimyr (claimyr.com) last month when I had a similar issue and needed to speak with someone. They have a system that keeps dialing EDD for you until it gets through, then calls you when an agent is ready. They have a video demo at https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km that shows how it works. Saved me hours of frustration!

Thank you for the detailed explanation! That makes a lot of sense about the W-2 employer being the key factor. Looking at my paperwork, you're right - PayFlex is on my W-2 even though I did all my actual work for ABC Marketing. I'll check out that Claimyr service because I've literally wasted hours trying to get through. At this point I just want to talk to someone at EDD to make sure my record is correct.

This is TERRIBLE advice! EDD absolutely DOES care about accurate employer information. They cross-reference everything with tax records, and if there's a discrepancy, they can issue an overpayment notice or even accuse you of fraud. I've seen people get hit with penalty weeks for much smaller mistakes than this!

Wait, I'm confused. Is a payroll company considered your actual employer? I always thought the company you actually work for is your employer and the payroll company just handles the administrative stuff. Can someone clarify this? I've been listing my actual employer on all my certifications...

It depends on the business relationship. Some payroll companies are just processing services, in which case your actual company is your employer. But many businesses use what's called a PEO (Professional Employer Organization) or co-employment model where the payroll company is technically your employer of record for tax and benefits purposes. The easiest way to check is to look at your W-2. Whoever is listed as the employer on your W-2 is who should be listed on your EDD forms. That's the entity that's paying into the unemployment insurance system.

I worked though a temp agency last year and had a similar situation. The confusion was whether to list the temp agency or the actual place I worked. EDD told me I should always list whoever issues my paycheck and W-2 as my employer. In your case that would be PayFlex. But I wouldn't stress about the check - just deposit it! As long as you reported your earnings honestly, that's the most important part. The last employer info is mostly for their record keeping.

That makes perfect sense, thank you! I think I confused myself because I've always thought of ABC as my employer since that's where I actually did the work. I'll cash the check and then try to update the records. Appreciate the firsthand experience!

I am FUMING on your behalf about that phone line! I've been trying for WEEKS to get through on the 5616 number and it's IMPOSSIBLE. Always "we're experiencing high call volume" then CLICK and it hangs up! How are we supposed to get help if they won't even put us on hold??? Sorry I don't have advice about your specific question but wanted to commiserate about the phone situation. The whole system is broken!

I know, right?! I've tried calling at different times (early morning, late afternoon) and different days of the week. Still can't get through. It's so frustrating that they don't even give you the option to wait on hold. Just an immediate disconnect.

Try calling right when they open at 8:00 AM. That worked for me once, but you have to be dialing exactly at 8:00, not 8:01 or 8:02. The system gets flooded immediately.

i think wat matters is if u reported ur income correctly. thats wat they care about more than which employer name u put. i would just go ahead n cash the check, but keep all ur paystubs in case theres any questions later

Thanks! I did report all my income correctly each week, so hopefully that's the most important part. I'll definitely keep all documentation just in case.

Just to follow up on the earlier comments - I checked with an EDD representative about this specific situation recently. The official guidance is that you should list whoever issued your W-2 as your employer for UI purposes. However, they also confirmed that as long as your earnings were reported accurately, this kind of administrative correction won't affect your benefits or eligibility. If you do manage to reach EDD, ask them to add a note to your file about the correct employer name. This helps prevent confusion during any future claims or if there's a wage audit. But again, this won't affect the current benefits you've received.

Thank you for confirming! I feel much better about the situation now. I'll definitely try to get through to EDD to add that note to my file, but at least I know I can cash the check without worrying too much. Really appreciate everyone's helpful insights on this!
