EDD system created second claim after temp work - need to fix 1099 reporting mistake ASAP

I think I've messed up my unemployment claim and I'm freaking out! I've been receiving regular UI benefits since December, but in March I picked up what I thought was a short-term W2 job (lasted 5 days ending 3/31/2025). When I certified for that period, I reported the work and income by entering the company's info in the employer section. Here's where I screwed up: I just received a notice dated 4/12 saying "Unemployment Claim Filed" which shows this company as my last employer. I never intended to file a new claim! I was just trying to properly report income for my existing claim. To make matters worse, I just found out this was actually a 1099 gig that I should have reported as self-employment income instead of W2. I'm totally confused and worried about: 1. Did EDD automatically open a second claim when I didn't want one? 2. Will reporting this incorrectly (as W2 instead of 1099) cause problems with my existing benefits? 3. What's the fastest way to fix this mess? I drafted an explanation letter but have no idea where to send it or if that will even help. I've tried calling 30+ times but can't get through. My rent is due next week and I'm worried my regular payments will stop because of this mistake. Has anyone dealt with something similar?

Yes, this happens more often than you'd think! When you report a new employer during certification, EDD's system sometimes automatically initiates a new claim review process. Here's what you need to do: 1. Don't panic - your original claim is still active until EDD makes a determination 2. You'll need to contact EDD to explain both issues (the unintended claim filing AND the misreported income type) 3. Mail your explanation letter to the address on the new claim notice AND upload a copy to your UI Online account under "Contact EDD" 4. Make sure to clearly explain it was a short 1099 gig, not a new W2 job Your benefits should continue on your existing claim while this gets sorted out, but there might be a temporary delay while they adjust things.

Thank you so much! I didn't even think about uploading the letter to UI Online. Will do that right away. Do you think I should also check the box for "Request for Backdate" when I submit through UI Online since I don't want the new claim at all? I'm just worried about my regular payments stopping.

omg this happened to my brother!!! took him like 2 months to fix and he didnt get paid the whole time. EDD is the worst. good luck

2 MONTHS with no payment?! I can't go that long without income. Did he just keep calling until he got through or was there something specific that finally fixed it?

I went through something similar last year. Here's exactly what worked for me: 1. Don't use the backdate request form - that's for different situations 2. On UI Online, go to "Contact EDD" and select "Claim Questions" as the category 3. Explain VERY clearly: "I did not intend to file a new claim. I was reporting income from a short-term 1099 contractor position on my existing claim." 4. Keep certifying for benefits on your original claim while this gets resolved The key thing is to keep certifying no matter what, even if you get confused about which claim to use. This preserves your payment history. They may need to adjust your reported earnings from self-employment vs W2, but that's a fairly simple fix once you reach someone.

ur giving bad advice. they SHOULD stop certifying until EDD tells them which claim to use. thats what caused my payments to get all messed up cuz the system got confused.

wait so was this a legit 1099 or were they misclassifying you?? cuz if they should have been paying you as w2 but did 1099 to avoid taxes you can report them and maybe get extra $$$

It was a proper 1099 gig - I knew going in it was contract work, I just didn't realize until I got the tax forms that it wasn't W2. My bigger concern is fixing the wrong information with EDD before my benefits get messed up.

I went through THREE MONTHS of hell with EDD because of something like this. Calling is pointless - you'll never get through with regular numbers. After trying for weeks, I found this service called Claimyr (claimyr.com) that got me connected to an EDD rep in 20 minutes when I'd been trying for days. They have a video showing how it works: https://youtu.be/JmuwXR7HA10?si=TSwYbu_GOwYzt9km Best money I ever spent because the EDD agent was able to fix my issue immediately once I actually got to talk to someone. These kinds of problems (duplicate claims, incorrect reporting) are almost impossible to resolve through the online system.

I've never heard of this service but I'm desperate enough to try anything at this point. Did they actually fix it during that first call? I just need someone to understand I didn't mean to file a new claim and fix the 1099 vs W2 mistake.

Yes, they fixed it in one call because it's a common issue. The agent made notes on my account, canceled the duplicate claim, and made sure my existing claim stayed active. The key was getting to an actual tier 2 agent who could make account changes - those are the hardest to reach through regular methods.

WHATEVER YOU DO, DON'T STOP CERTIFYING ON YOUR ORIGINAL CLAIM!!! I had the exact same problem and made the mistake of not certifying while waiting for a response from EDD. Ended up causing a gap in my claim that took SIX WEEKS to resolve!! Also for the love of god DO NOT create a new online account if they send you paperwork with a different claim number. That causes even more chaos in their system. Call, call, call until you get through. Nothing gets fixed by mail or online requests in my experience.

This is excellent advice. The EDD system really struggles with duplicate claims and accounts. To be clear for the original poster: you should continue certifying through your existing UI Online account, and if you get paperwork for the new claim, don't set up a separate account for it. The EDD representative can merge the information once you reach someone.

This is actually a very common issue. The EDD system is designed to automatically initiate a claim review when you report working for a new employer after a period of unemployment. However, they should NOT have opened a whole new claim based just on your certification - there's likely a miscommunication or system error. Regarding the 1099 vs W2 misreporting: When you report self-employment income (1099), it affects your weekly benefit amount differently than W2 income. With 1099 work, they typically reduce your benefit using a different formula than regular employment. It's important to get this corrected so your benefits are calculated properly. To fix both issues at once, you need to: 1. Contact EDD and explain both the duplicate claim issue AND the income reporting correction 2. Request that they: - Cancel the new claim that was inadvertently opened - Correct your income reporting for those days from W2 to 1099 self-employment - Recalculate any benefit adjustments based on the corrected income type In the meantime, keep certifying through your original claim as normal. The system will eventually sort this out, but speaking with a representative will expedite the process significantly.

This explanation makes so much sense. I had no idea the system would automatically initiate a new claim just from reporting work on a certification. Do you know if there's any specific department I should ask for when I call? I'm going to try right when they open tomorrow.

dont bother with the letter edd never reads those things lol. you gotta call and be super pushy or they wont help. i had to call 57 times in one day to get thru last month, its insane

I recommend taking two specific steps to resolve this quickly: 1. On UI Online, go to your homepage and look for the section that says "Upload Documents." Upload a clear letter explaining both issues (inadvertent new claim and 1099 vs W2 correction). Title it "Claim Correction Request - Urgent" to help it get routed properly. 2. Call the technical support line (not the regular claims line) at 8am sharp. The technical support agents can't fix claim issues directly, but they can see both claims in the system and add detailed notes for the claims specialists. They can also expedite your case if you explain that it's creating a payment interruption risk. Keep certifying for benefits on your original claim in the meantime. If payments pause temporarily, they'll be backdated once this is resolved.

Thank you! I'll prepare the letter tonight and upload it first thing in the morning. Do you know if the technical support line is the same as the regular EDD number? I'll try calling at 8am sharp tomorrow.

The technical support line is 1-833-978-2511, but I've found it works better to call the regular UI claims number (1-800-300-5616) right at 8:00:00am. Have your claim number ready, and when the automated system asks why you're calling, say "Payment issue" as that tends to get routed to more experienced agents.
