Can furloughed employees collect unemployment in California EDD?
So my employer just handed me a furlough notice yesterday - effective immediately, no return date given. I've been with this company for six years in the logistics industry and this came completely out of nowhere. HR just sent an email saying operations are being temporarily suspended and everyone in my department is on unpaid furlough until further notice. I'm trying to figure out if furloughed employees can collect unemployment through California EDD or if being 'temporarily laid off' disqualifies me somehow. I've never filed for UI before so I'm totally lost. My main concerns are: - Does EDD treat furloughs differently than regular layoffs? - Do I need to keep doing job search activities if my employer says I might be called back? - What happens to my benefits if my employer suddenly recalls me mid-claim? - Should I file right away or wait to see if the furlough ends quickly? I have about $800 in savings and I can't afford to wait around for weeks if there's some issue with my claim. Any help would be massively appreciated from anyone who's been through this.

Yes, furloughed employees absolutely can collect unemployment through California EDD - this is actually one of the most common situations EDD handles. A furlough is treated essentially the same as a temporary layoff from EDD's perspective. As long as you're not receiving any wages during the furlough, you meet the basic eligibility criteria. Here's what you need to know right away: 1. File your claim ASAP - there's a one-week unpaid waiting period built into California UI, so every day you delay costs you money. 2. When asked why you stopped working, select 'lack of work' - this is the correct category for furloughs. 3. You WILL need to meet job search requirements unless you qualify for standby status (more on that below). 4. Report any severance or vacation pay EDD asks about. The standby status question is important for your situation. If your employer gave you a specific return-to-work date within 60 days, you can request standby status which exempts you from the weekly job search requirement. Without a return date, you'll need to conduct and log three job search activities per week.

AuthorThank you so much - this is exactly what I needed. My HR email didn't mention any return date at all, just 'indefinite furlough until operations resume.' So it sounds like I should go ahead and file and also plan on doing the job search activities?

Exactly right. File today if you can. With no return date given, EDD will treat this like an open-ended layoff. Complete your job search log each week - three employer contacts minimum - and keep records in case you get audited later. If your employer eventually gives you a recall date within 60 days, you can call EDD at that point to request standby status.

wait does standby mean you dont have to look for work at all?? I thought you always had to do job searches no matter what

Standby status is a real exception to the job search requirement, but it's only available in specific situations - mainly when an employer provides a definite recall date within 60 days, or in certain labor dispute situations. It's not automatic, you have to request it and EDD has to approve it.

Went through a furlough last year with my manufacturing job, filed with EDD and got approved within about 2 weeks. The key thing people mess up is how they answer the separation reason question. Don't say you 'quit' or 'resigned' obviously, but also don't overthink it - furlough = lack of work, full stop. EDD knows what furloughs are and handles them constantly. One thing that tripped me up personally was the base period earnings calculation. Make sure you've worked enough in the past 18 months to qualify - EDD looks at your highest earning quarter and you need at least $1,300 in that quarter, or $900 plus total base period earnings of 1.25x that quarter. Six years with one employer you're probably fine, just flagging it.

Liam Brown
AuthorThat's really helpful context about the earnings calculation. I've been full time for six years so I should definitely hit those thresholds. Did you have any issues with your employer contesting the claim?

Ava Hernandez
My employer didn't contest it. Most employers don't fight furlough claims because they know it qualifies - contesting it would just create bad blood with workers they're planning to recall anyway. If yours does contest it for some reason, don't panic, just go through the appeal process with documentation of the furlough notice.

yeah same experience here, employer never said anything and claim went through fine

I'll add something nobody's mentioned yet - when you file online through UI Online, there's a specific field where it asks if you expect to return to work for this employer. Answer YES if you think there's any reasonable chance of recall, because this can help trigger the standby eligibility review. Also answer honestly about whether your employer gave any return date. I know someone in a similar furlough situation who spent three weeks trying to get through to EDD by phone to ask basic questions like this. Couldn't get anyone on the line. She ended up using a service called Claimyr (claimyr.com) that basically holds your place in EDD's phone queue and calls you back when an agent is available. She said it saved her hours of redialing and she got her eligibility question answered same day. There's a demo video showing how it works at https://youtu.be/JmuwXR7HA10 if you want to see before trying it. Given your savings situation you probably don't want to waste days trying to get through by phone.

AuthorOh interesting, I've never heard of that. I was dreading trying to call EDD because everyone says it's nearly impossible to get through. I'll check out that video.

Does this actually work or is it just one of those things that sounds good? I've tried every trick to get through to EDD and nothing works

NOBODY told me furloughed employees qualify when I got furloughed two years ago!!! I waited THREE WEEKS thinking I wasn't eligible and lost all that money. Please file immediately, do not wait, the waiting week is already unpaid and you will NOT get those weeks back once they're gone. EDD does not backdate claims just because you didn't know you qualified. File. Today.

AuthorOh wow, I had no idea you couldn't get backpay for weeks before you filed. Filing right now.

Good!! And take screenshots of everything, every confirmation number, every certification you submit. EDD's systems have bugs and things disappear. CYA always.

This is real advice. Document everything religiously. I had a certification disappear from my account once and had zero proof I submitted it. Learn from others' mistakes.

my cousin told me furloughed people dont qualify because you technically still have a job?? is that true
0 coins
Olivia Garcia
This is a very common misconception. Unemployment insurance in California is based on whether you're receiving wages, not whether you technically have a job title. During a furlough where you're receiving zero pay, you meet EDD's definition of unemployed for UI purposes. The 'you still have a job' logic doesn't hold up under California UI law.

ok that makes way more sense. my cousin got bad info then lol

Tons of people believe this myth. The simple test is: are you getting paid? No? Then you're likely eligible. EDD doesn't care about your employment status on paper as much as it cares about your actual earnings.

One practical thing worth knowing: you'll certify for benefits every two weeks through UI Online or the EDD phone system (1-866-333-4606). Each certification period you have to report any earnings, job search activities, and whether you were available and able to work. If your employer starts paying you anything during the furlough - like if they pay out accrued vacation or give any partial hours - you MUST report those earnings. Partial earnings don't necessarily disqualify you but they reduce your weekly benefit amount. There's a formula EDD uses where you can earn up to 25% of your weekly benefit amount before dollar-for-dollar deductions kick in.

Liam Brown
AuthorGood to know about the partial earnings formula. My employer said they're paying out our accrued PTO so I'll need to report that.
0 coins
Jacob Lewis
Yes, definitely report the PTO payout. EDD will ask about it and it can affect which weeks it gets applied to. You might want to call EDD about how to correctly report a lump sum PTO payout - that's a situation where getting it wrong can cause headaches later.

Amelia Martinez
Wait PTO payout affects your benefits?? I had no idea. I reported mine but I wasn't sure how it affected things and the EDD website wasn't super clear about it.

Olivia Garcia
PTO payouts allocated to specific weeks can affect benefit amounts for those weeks. It's one of those areas where calling EDD to confirm how to report it correctly is genuinely worth the effort.

I was in this exact situation 8 months ago - furloughed from my hospitality job with no return date. Filed with EDD and was approved. I'll tell you the one thing that almost messed up my claim: I answered the 'are you actively seeking work' question vaguely on my first certification and it triggered an eligibility interview that delayed my payment by almost a month. Be crystal clear and consistent in how you answer. 'Yes' to able and available to work. 'Yes' to actively seeking. Record your three job search activities before you certify, not after.

Liam Brown
AuthorWhat counts as a job search activity? I was assuming it meant actually applying for jobs but is there more to it?

EDD accepts several things: submitting a job application, attending a job fair, creating or updating a profile on a job search site, contacting an employer about openings, taking a skills assessment through CalJOBS, attending an EDD workshop. Applying to actual jobs is the most straightforward but you have options.

Elijah Jackson
Also register with CalJOBS (the California job search portal) as soon as you file - EDD often requires this and it actually counts as one of your initial job search activities.

genuine question - what if the furlough ends like two weeks in and your employer calls you back but you already got some EDD money. do you get in trouble??
0 coins
Olivia Garcia
Not at all - this is expected and normal. If you're recalled and return to work, you simply stop certifying for benefits. On your next certification you report the date you returned to work and any wages earned that week. Your UI claim stays open for a year from the date it was established, so if you get furloughed again within that period you can reopen the same claim without starting over.

Mason Davis
oh ok that's way less complicated than i thought. good to know

Ava Hernandez
The only situation where you could get in trouble is if you get recalled, start working, but continue certifying and claiming you're unemployed. That would be UI fraud. But legitimately collecting for the weeks you actually were on furlough is completely fine.

just wanna say i scrolled through this whole thread because im in the same furloughed situation and this is the most helpful info ive found anywhere. nobody at work knew what to do either and HR basically just said 'check with EDD' without any guidance at all

For anyone in this thread struggling to actually reach EDD by phone - I want to reiterate the Claimyr option I mentioned earlier. I've seen it come up in a few EDD groups and the feedback from furloughed workers specifically is that it's useful when you have questions about how your particular situation is classified or if your claim gets flagged for any reason. Website is claimyr.com and the video walkthrough is at https://youtu.be/JmuwXR7HA10. Getting a real EDD agent on the phone can genuinely make a difference when your claim has any kind of wrinkle.

I was skeptical at first too but phone access to EDD really does matter when something goes sideways with your claim. Good to know about options

Something I want to flag for OP and anyone else on furlough: EDD will send your employer a notice asking them to confirm the reason for your separation. Your employer has a set window to respond. In most standard furlough situations the employer confirms lack of work and everything proceeds smoothly. Where issues arise is if your employer's description of the situation doesn't match yours - like if they say you refused available work or had some conduct issue. If EDD gets conflicting information, your claim goes into adjudication which can delay payments significantly. Keep your furlough notice email as documentation in case you ever need to show EDD your employer's own words.

Liam Brown
AuthorGreat point - I still have the HR email so I'll make sure to save that somewhere safe.

Mia Rodriguez
This is SO important. Print it, screenshot it, save it to multiple places. If your claim goes to adjudication you'll be glad you have the original documentation.

Sophia Miller
I'd add: if adjudication does happen, don't assume the worst. A lot of claims go to adjudication just because EDD's system flagged something for review, not because your employer contested anything. Most adjudications for standard furloughs resolve in your favor.

does furlough affect your benefits if you go back to work and then get laid off again later? like does it mess up your base period
0 coins
Olivia Garcia
Interesting question. Your base period is calculated from earnings in the 12-18 months before you file. If you return to work after furlough and then get laid off later, you'd file a new or reopened claim and EDD would recalculate based on your earnings in the relevant base period. Your furlough period itself (when you weren't earning wages) would just show up as a gap in earnings, which is normal and expected. It shouldn't 'mess up' anything - EDD sees this constantly.

ok good, that was something I was worried about for my own situation. thanks

one thing nobody said yet - sign up for EDD's Bank of America debit card situation proactively. when your first payment comes through you want the card to already be activated. took me an extra week to get funds because i wasn't expecting a physical card in the mail and didn't know to activate it
0 coins
Liam Brown
AuthorOh wow I had no idea payments came on a debit card, I assumed direct deposit was the default. Thanks for the heads up.
0 coins
Isabella Martin
you can set up direct deposit through UI Online actually - go to payment preferences after filing. way faster than waiting for the card. wish someone had told me that from the start
0 coins
Ava Hernandez
Direct deposit is definitely the way to go. Usually shows up within 2-3 business days after certification is processed vs potentially over a week for the debit card to arrive and get activated.

this might be a dumb question but do you have to tell your employer you filed for unemployment
0 coins
Jacob Lewis
Not a dumb question. No, you don't have to notify your employer that you filed. EDD notifies them automatically as part of the process (they get a chance to respond to your claim). You don't need to do anything to make that happen.

ok good i wasnt sure if it would be awkward with my job since they said they might bring us back

Totally normal to feel weird about it but collecting unemployment you're legally entitled to during a furlough is not something a reasonable employer would hold against you. You paid into the UI system through your payroll taxes - you're using a benefit you earned.

I CANNOT STRESS THIS ENOUGH: do not let your claim sit with pending issues without calling EDD. I had a simple furlough claim that went to adjudication and I just waited thinking it would resolve itself. It didn't. It sat for seven weeks because nobody at EDD proactively works pending cases - you have to call and push. By the time I got it sorted out I was already back at work and had missed most of the payments I was entitled to.

Liam Brown
AuthorSeven weeks is terrifying. How did you finally get it resolved?

Mia Rodriguez
Eventually got through to an actual agent who looked at my file and said there was a simple question that just needed to be answered. Took five minutes on the phone but weeks of waiting and redialing to get there. The phone access problem at EDD is a real systemic issue.

This is exactly why I keep bringing up Claimyr (claimyr.com) in this thread - adjudication situations are specifically where being able to reach a live EDD agent matters most. Check the demo at https://youtu.be/JmuwXR7HA10 - it's designed exactly for situations like what you described where you're stuck waiting and need someone to actually look at your file.

yeah getting through to EDD by phone feels like a lottery. good to know there are options

Final thing I'd add for OP: keep your job search log even if you end up getting recalled quickly. EDD can audit past certifications and ask you to prove you actually did the job searches you claimed. A simple spreadsheet with dates, employer names, position titles, and how you applied is sufficient. Takes two minutes per week and gives you protection if you ever get an audit letter.
