If I get severance can I get unemployment in California EDD?
So I just got laid off from my logistics coordinator job last Friday and my employer is giving me a severance package — 8 weeks of pay based on my years of service. I'm trying to figure out if I can still file for California EDD unemployment benefits at the same time or if the severance disqualifies me entirely. I've heard conflicting things from coworkers who've been laid off before. One person told me severance automatically blocks your UI claim, another said it just delays when your benefits start. I have no idea what the actual rule is and the EDD website doesn't explain it in plain English. Has anyone dealt with this situation? Like do I still file right away or do I wait until the severance runs out? I really need to know because bills aren't going to pause while I figure this out.

This is actually a really common question and the answer depends on how your severance is structured. California EDD treats severance differently depending on whether it's tied to a specific week or paid as a lump sum. If your employer is paying it as continuation pay — meaning they're essentially extending your employment for 8 weeks and you're on the payroll during that time — then yes, that typically delays your UI benefits because you're considered employed. But if it's a true lump sum severance paid all at once with a clear separation date, California EDD generally does NOT count that against your weekly benefits. You should file your claim immediately regardless. EDD will sort out the eligibility period once they receive your wage info. Don't wait 8 weeks to file — that could cost you weeks of benefits.

AuthorOkay this is super helpful. My separation letter says my last day of employment was last Friday, and the severance will be paid out in a lump sum via direct deposit. Does that mean I'm in the clear to get benefits starting now?

yeah same thing happened to me, lump sum severance and I still got my EDD benefits no problem, just filed right away

I want to add one nuance here — even with lump sum severance, California EDD may still ask you to report it during the initial claim interview. Always disclose it. Hiding income or payments on your UI claim can lead to an overpayment determination later, and trust me, you do NOT want to deal with an EDD overpayment notice.

File NOW. Seriously don't wait. The EDD claim effective date is based on when you file, not when you're determined eligible. Every week you delay filing is a week you potentially lose benefits forever — they don't backdate for procrastination. Even if there ends up being a waiting period because of how your severance is classified, your benefit year starts from when you filed.

AuthorI filed yesterday actually! The online system accepted my claim. Now I'm just waiting to see what happens next. It said I might need to complete an interview.

When I got laid off with severance two years ago I was so confused about this exact thing. I spent literally two days trying to call EDD to get a straight answer and kept getting the busy signal or getting disconnected after 45 minutes on hold. I eventually found a service called Claimyr that got me connected to an actual EDD agent within an hour. They have a demo video at https://youtu.be/JmuwXR7HA10 and the site is claimyr.com — the agent I spoke with explained exactly how my severance would be treated and confirmed I could claim benefits immediately since mine was a lump sum payout. Saved me so much stress honestly.

AuthorI'm definitely going to need to call EDD at some point for my interview. Is it really that hard to get through? I was hoping the online process would handle most of it.

Getting through to EDD by phone is genuinely a nightmare. I've tried calling at 8am, tried redial for hours, everything. Might look into that Claimyr option.

I used Claimyr too when my claim got stuck in adjudication. claimyr.com — it's legit. The agent I talked to cleared up my claim issue in one call.

wait im confused, so if you get severance you CAN get unemployment?? my boss told me when i got laid off last year that severance means you cant file. i never filed because of that and now im reading this and kinda mad lol

Unfortunately that's a really common misconception employers tell workers — whether intentionally or not. Severance in most cases does NOT disqualify you from California UI benefits, especially lump sum packages. You may have been entitled to benefits that whole time. I'm sorry you missed that window.

ugh thats so frustrating. is there any way to go back and claim those benefits retroactively?
0 coins
Sofía Rodríguez
Unfortunately no — you can't backdate a claim by more than about two weeks in most cases, and that's only with a valid reason for the delay. After significant time has passed there's really no recourse. This is exactly why people need accurate information upfront.

THE EDD WEBSITE IS HONESTLY SO UNHELPFUL FOR THESE QUESTIONS. I went through this exact situation in March and had to piece together information from like five different sources because the official FAQ doesn't address real scenarios clearly at all. It just says 'wages may affect your benefits' with zero practical guidance. How is that useful to anyone??

lol right the edd website reads like it was written by a lawyer trying to avoid giving actual answers

AuthorThat's literally what I experienced. I read the EDD page on 'wages' three times and still couldn't tell if severance counted or not.

The specific page to look for is the one about 'vacation pay, holiday pay, and severance pay' in the California UI Code. Severance that's not tied to continued work or a specific pay period generally doesn't reduce your weekly benefit amount. The EDD Guide DE 1275A has more detail but honestly it's still dense.

To give you the most accurate breakdown of how California EDD treats different types of separation pay: 1. Severance pay (true lump sum, no conditions) — generally does NOT affect weekly UI benefits 2. Pay in lieu of notice (WARN Act payments) — CAN delay your benefit start date 3. Continuation pay (still on payroll, benefits continuing) — treated as wages and WILL reduce or delay UI benefits 4. Vacation/PTO payout — reported as wages for the week it covers The key thing is how your employer codes it and reports it to EDD. When you file your weekly certifications, you should report any money received during that week. EDD will make the determination about how it affects your claim.

AuthorThis is incredibly clear, thank you. My separation agreement specifically says 'severance payment' paid as a single lump sum with no conditions. Based on what you're describing that sounds like category 1.

what about if you signed a non-disparagement clause as part of the severance agreement, does that affect anything with EDD?
0 coins
Sofía Rodríguez
Non-disparagement clauses are a condition of receiving the severance but they don't affect your UI eligibility. EDD only cares about the financial structure of the payment, not the legal conditions attached to accepting it. Your claim eligibility is separate from your civil obligations under the severance agreement.

Just want to throw in — make sure you read your severance agreement carefully regarding any re-employment assistance or outplacement services. Some companies try to classify severance differently to avoid triggering WARN Act obligations and it can get complicated with how EDD categorizes it. If anything in your agreement looks unusual or doesn't match what I've described, it's worth calling EDD directly to clarify before your first certification.

Lena Kowalski
AuthorMine seems pretty standard — it just says severance equal to X weeks of pay as a lump sum in exchange for signing the release. Nothing about outplacement or re-employment assistance.

Giovanni Rossi
That sounds clean and straightforward. You should be good. Just make sure to disclose it on your initial claim when they ask about separation pay. Transparency is always the safer move with EDD.

can i ask a dumb question — when you file your weekly certifications do you have to report the severance every week or just once? i got a severance last month and have been reporting it every single week thinking that was right and now im worried i messed something up
0 coins
DeShawn Washington
Not a dumb question at all! For a true lump sum severance, you typically only report it during the week you actually received the payment — not every subsequent week. If you've been reporting it repeatedly, you should call EDD to clarify before this becomes an overpayment issue. Get it corrected proactively.

oh no. i've reported it like 4 weeks in a row. okay calling EDD tomorrow, this is stressful

If you're having trouble getting through to EDD about this, seriously look into Claimyr (claimyr.com). This exact type of situation — where you need to talk to an agent quickly to avoid a potential overpayment — is when it's most worth using. There's a video showing how it works: https://youtu.be/JmuwXR7HA10

I work in HR and see this confusion constantly. When we process layoffs with severance I always try to tell employees to file for unemployment immediately and be upfront about the severance. The number of people who don't file because they wrongly believe severance disqualifies them is genuinely sad — they're leaving money on the table that they're legally entitled to.

AuthorHonestly it would be so helpful if employers included this information in the layoff packet. I had no idea where to start.

You're absolutely right and some companies do include EDD filing information in severance packets, especially in California where it's fairly standard practice. Others don't, and employees are left to figure it out themselves. Hopefully this thread helps some people.

filed my claim after getting severance back in january and it was pretty smooth honestly. did the online interview questions, answered yes to receiving severance, put in the amount, and my claim processed normally. benefits started the week after my waiting period. total time from filing to first payment was about 3 weeks.

Lena Kowalski
AuthorThat's really reassuring to hear! 3 weeks from filing to first payment is not bad at all. Did EDD contact you with any follow-up questions about the severance or did it just process automatically?

they didn't contact me at all actually, just processed. i think because it was clearly a lump sum and i disclosed it upfront there wasn't much to question.

Something nobody's mentioned yet — make sure your employer is not contesting your unemployment claim. Some companies challenge UI claims even for laid-off workers, especially if the severance agreement has any language about the reason for separation. If your former employer contests your claim, it will go to adjudication and you'll need to provide documentation showing you were laid off and not fired for cause or that you didn't quit voluntarily.
0 coins
Lena Kowalski
AuthorI didn't even think about this. My layoff was part of a company-wide reduction in force so it seems like it would be hard for them to contest. But I'll keep an eye on my claim status.

EMPLOYER CHALLENGES ARE THE WORST. My former employer challenged my claim after laying me off and it added 6 weeks to my adjudication timeline. Keep every piece of documentation from your separation — emails, layoff letter, everything.
0 coins
Sofía Rodríguez
Great point. Save your layoff notice, any communication from HR, and ideally the language in your severance agreement that describes the reason for separation. 'Position eliminated' or 'reduction in force' are the magic words for UI purposes. If the agreement says anything vague about 'mutual agreement to separate' that can sometimes be used by employers to argue you voluntarily left.

i was so scared to file when i got my severance because i genuinely thought it would be fraud or something lol. like i thought i was trying to double dip. turns out you're literally entitled to UI benefits if you're unemployed regardless of severance in most cases, it's not double dipping at all

AuthorI felt exactly the same way! Like I felt guilty even asking the question. But you're right, I paid into unemployment insurance for years through my job, I should be able to use it when I actually need it.

This is such a healthy reframe. UI is an insurance program that workers contribute to. Using it when you're unemployed is exactly what it's designed for. There's no ethical issue with collecting UI and severance simultaneously in most cases.

random question but does california edd count severance as income when calculating your weekly benefit amount? like does getting a big severance affect how much you get per week going forward?
0 coins
DeShawn Washington
No — your weekly benefit amount (WBA) is calculated based on your earnings during your base period, which is roughly the 12-18 months before you filed. Severance doesn't factor into that calculation at all. Your WBA is set based on your actual wages from working, not any separation payments.
0 coins
Fatima Al-Rashid
oh that's actually great news, i was worried the severance would reduce my weekly amount permanently somehow
0 coins
Sofía Rodríguez
The only way severance affects your benefits is potentially the timing of when they start (for certain types of continuation pay). Once you're in your benefit year and certifying, your WBA is fixed based on your base period wages.

does anyone know if this is the same for part time workers? I work part time and got a small severance when my hours were cut to zero. wondering if the rules are different
0 coins
DeShawn Washington
The rules are essentially the same for part-time workers in terms of severance treatment. The main difference is that part-time workers may have a lower base period wage which affects the WBA calculation. But severance classification (lump sum vs. continuation pay) is evaluated the same way regardless of whether you were full or part time.

For anyone in this thread who ends up needing to speak with an EDD agent about severance classification, adjudication issues, or anything else — I cannot stress enough how much easier it is to use Claimyr versus trying to call EDD directly. The regular EDD phone line is genuinely brutal. Claimyr basically queues you for a callback from an actual EDD rep. You can see how it works at claimyr.com or watch their demo at https://youtu.be/JmuwXR7HA10. Especially if you're worried about an overpayment situation or your claim getting held up — getting a human on the phone fast matters a lot.

UPDATE: My claim has been processing and I just got a notice that my first benefit payment is on its way! No issues flagged regarding the severance — it looks like because it was a straightforward lump sum payout, EDD processed my claim normally. My waiting week has passed and I should see my first payment within the next few days. For anyone searching this question: file right away, disclose your severance honestly, and don't let anyone tell you that severance automatically disqualifies you from California EDD unemployment benefits.

For anyone finding this thread later via search, here's the complete summary of California EDD rules on severance and unemployment: — Lump sum severance: Does NOT disqualify you, file immediately — Continuation pay (still on payroll): May delay benefit start date — Pay in lieu of WARN Act notice: May affect timing, disclose to EDD — Always disclose severance on initial claim application — Your weekly benefit amount is NOT reduced by severance payments — File your claim the week you become unemployed regardless of severance — Keep all separation documentation in case of adjudication This is one of the most misunderstood areas of California unemployment and hopefully this thread clears it up for people.
