Can I draw unemployment if I get fired from my job in California?
So I just got let go from my job at a logistics warehouse where I'd been working for almost two years. My manager called me in last Thursday and said they were 'releasing me from employment' — which basically means I got fired. The whole thing came out of nowhere and I'm honestly still in shock. I'm trying to figure out if I can even collect unemployment benefits when you get fired versus quitting. I always assumed getting fired meant you were automatically disqualified from California EDD but my neighbor said that's not always true? I don't really understand the difference between being fired 'for cause' versus just being let go because the company wanted to reduce headcount or whatever. Can I still draw unemployment if I got fired? I haven't filed anything yet because I don't want to waste my time if I'm just going to get denied.

Great news — being fired does NOT automatically disqualify you from California unemployment benefits. This is one of the biggest misconceptions people have about UI. The key distinction California EDD makes is whether you were fired for 'misconduct' as legally defined under California Unemployment Insurance Code Section 1256. Simple mistakes, poor performance, or being laid off due to business reasons are generally NOT considered misconduct. You should absolutely file your claim. California EDD will send both you and your former employer a questionnaire asking for each side of the story. If your employer can't prove you engaged in deliberate misconduct — things like intentional rule violations, dishonesty, theft — you'll likely be approved. Don't delay filing because there's a one-week waiting period before benefits kick in and the clock starts from when you file.

AuthorThis is so helpful thank you. So like if I was fired for showing up late a couple times, would that count as misconduct? My manager mentioned attendance when they let me go.

Attendance issues can be tricky. A single incident or even a couple of late arrivals typically won't rise to the level of disqualifying misconduct. However, if your employer had a documented progressive discipline policy, gave you written warnings, and you continued the behavior — that could complicate things. The burden of proof is on your employer to demonstrate willful misconduct. Just be honest on your claim form about what happened.

same thing happened to my cousin, got fired for attendance and still got approved. edd sided with him over the employer

File right away!! I was in almost the exact same situation — fired from a retail job after 18 months and I was convinced I wouldn't qualify. Turns out the burden is on the company to prove you did something intentionally wrong, not just that you made mistakes or weren't the right fit. I filed online through UI Online, answered all the questions honestly about why I was separated, and within about 2 weeks I had an approval letter. The key is just being accurate and detailed when you describe your separation. Don't minimize it but don't exaggerate either.

AuthorDid you have to do anything after filing or did they just approve it pretty quickly?

After I filed they sent me a notice saying they needed to gather info from my former employer first. That triggered an adjudication period which lasted about 10 days for me. During that time I just kept filing my weekly certifications so I wouldn't lose those benefit weeks. Once adjudication finished they approved me and paid everything back to my first eligible week.

what is adjudication exactly? like does everyone go through that

Sofia Peña
Adjudication basically means California EDD is investigating a potential issue with your claim — in this case the reason for your separation. When you're fired (vs laid off) it triggers a review because EDD needs to determine whether misconduct was involved. Not everyone goes through it but most people fired from their jobs will see their claim enter adjudication while EDD contacts both parties.

ok so I went through this about 4 months ago and I want to warn you — even when you have a legitimate claim getting through to anyone at California EDD on the phone is a NIGHTMARE. I spent literally 3 weeks trying to get information about my adjudication status. Finally someone told me about Claimyr at claimyr.com which basically gets you through to an actual EDD agent without sitting on hold for hours. There's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works. I was skeptical but after my 12th failed attempt to reach EDD I tried it and finally got a human on the phone who told me exactly where my claim stood. Honestly would have given up without it.

can i draw unemployment if i get fired is literally the most googled unemployment question and the answer is USUALLY YES in California. People assume fired = no benefits but CA has really strong worker protections. Unless you literally stole something or got arrested at work or seriously violated a major policy on purpose, most firings result in approval. The employer has to prove misconduct and most of them either can't or don't bother to fight the claim.

This. My old employer threatened to 'contest' my claim when they fired me and I was panicking for weeks. In the end they never even responded to EDD's questionnaire and I got approved automatically.

Levi Parker
AuthorWait so if the employer just doesn't respond at all EDD just approves you?

Pretty much. If EDD reaches out to your employer for information about the separation and they don't respond within the deadline, EDD typically proceeds based on your account of events alone. Obviously still answer everything honestly on your end.

I'm kind of in a similar boat right now and reading this thread is making me feel better. I was fired two weeks ago from a restaurant job and I've been too scared to file because my manager literally said 'you'll never get unemployment' when they let me go. But based on what everyone's saying here that sounds like a scare tactic? I filed this morning actually after reading the first reply. Fingers crossed.

Good for you for filing! Your manager saying that was almost certainly just a scare tactic or ignorance about how California unemployment law actually works. File honestly, keep your weekly certifications current, and let the process play out. Many people get approved even after employers push back.

Thank you! I'm going to try to stay on top of everything. Do I have to be actively looking for work while this is being decided?

Yes — California EDD requires you to conduct job searches even while your claim is under adjudication. You need to record at least two job search contacts per week and keep a log of them. California EDD can audit your job search records so don't skip this step or assume you can catch up later.

honestly the system is SO rigged against workers I can't even. I got fired for supposedly 'insubordination' which was really just me telling my supervisor that scheduling me for 6 consecutive 12-hour shifts was a safety hazard. EDD initially denied me and I had to go through an entire appeal process which took FOUR MONTHS. Four months with no income before they finally reversed it. The whole thing is designed to frustrate people into giving up.

Hunter Hampton
That's brutal I'm sorry. 4 months is insane

Yeah and the worst part is trying to get information during the appeal. Nobody answers the phone, online messages go unanswered for weeks. I eventually used Claimyr at claimyr.com to actually reach a live EDD agent and that's the only time I got any real updates. Saved me from completely losing my mind honestly. Their video at https://youtu.be/JmuwXR7HA10 shows the whole thing.

I picked up some gig work which I reported to EDD. Partial benefits are a thing — if you earn less in a week than your weekly benefit amount you can still get some payment, just reduced. So that helped a little.

One practical thing I want to add: when you fill out the separation reason on your UI Online claim, be as specific as possible. Don't just write 'I was fired.' Describe the circumstances — was there a meeting? What was stated as the reason? Were you given any prior warnings? The more detail you provide upfront the less back-and-forth you'll have with EDD during adjudication. I actually wrote a few paragraphs explaining everything and my adjudication resolved faster than most people I've talked to.

AuthorThat's a really good tip. I was going to keep it short but I'll write it all out instead.

wait so does it matter WHY you got fired like specifically? My situation is kinda complicated — I tested positive on a drug test which my employer has as a policy violation. Does that count as misconduct?
0 coins
Libby Hassan
Drug test failures are a gray area in California EDD adjudication. California courts have found that testing positive for substances used off-duty and off-premises can sometimes NOT constitute misconduct, depending on the circumstances. However if your role required drug testing for safety reasons (like operating heavy machinery) or if you were already on a last-chance agreement, it gets more complicated. I'd strongly recommend filing anyway and letting EDD make the determination rather than assuming disqualification.

it was a safety sensitive position operating forklifts so... that doesn't sound great for me

Libby Hassan
Honestly still file. You might be surprised — and if you do get denied you have the right to appeal. The worst case is you spend some time going through the process and end up where you started. But a lot of people in complicated situations get approved. EDD's definition of misconduct requires showing you acted willfully and with disregard for your employer's interests.

lol everyone here saying file file file but nobody mentions how annoying the weekly certifications are. like once you're approved you have to certify every single week and answer all these job search questions and if you mess up even one answer your payment gets held. I accidentally said I wasn't able and available one week when I was just confused by the question and my payments froze for like 3 weeks
0 coins
Hunter Hampton
omg same thing happened to me. read every question super carefully especially the 'were you able and available for work' one
0 coins
Levi Parker
AuthorYikes okay I'll be really careful about that. What does 'able and available' even mean exactly?
0 coins
Chloe Zhang
basically it means were you physically and mentally capable of working and not doing anything that would have prevented you from accepting a job that week. like if you were on vacation out of state some people think that disqualifies them but actually its about whether you COULD have worked not whether you had plans. but honestly just answer yes unless something genuinely stopped you from being able to accept a job
0 coins
Sofia Peña
To add to this — 'able and available' means you had no physical, mental, or scheduling reason that prevented you from accepting work had it been offered. Being in school part-time, being sick for a day or two, or even short trips generally don't disqualify you as long as you would have accepted work if called. The question trips people up because it sounds more restrictive than it actually is.

Going back to the Claimyr question from earlier — I finally tried it after spending 3 days straight trying to get through to California EDD about my claim status. It's legitimate. You sign up at claimyr.com and it handles the hold queue stuff for you. Was able to talk to an actual EDD rep within the same day I signed up and she walked me through exactly what was happening with my adjudication. For anyone stuck trying to get info on a fired-for-cause claim, it's genuinely useful.

something nobody mentioned yet — when California EDD sends you that questionnaire about your separation, answer it promptly! I think I had like 10 days to respond and I almost missed the deadline because the letter ended up in my spam folder. If you miss that window EDD may decide based on incomplete information and that usually doesn't go in your favor.
0 coins
Levi Parker
AuthorOh wow that's a really important point. So they email the questionnaire?

Jace Caspullo
They mail it AND send it to your UI Online inbox. Check both your physical mail and your UI Online messages regularly especially in those first few weeks after filing. I'd check UI Online literally every day during adjudication.

This is huge. People lose winnable cases just because they didn't respond to EDD's info request in time. Set a reminder to check your UI Online account and your mailbox every single day once you file.

I feel like everyone saying you'll probably get approved is being a little optimistic honestly. My friend filed after being fired and went through 3 months of back and forth with EDD, got denied, appealed, went to a hearing, and STILL got denied in the end. The employer showed up to the appeal hearing with documentation going back 18 months. So it really does depend on the specific circumstances.
0 coins
Libby Hassan
That's a fair point and thanks for bringing some balance. Yes, outcomes vary significantly. If your employer has solid documentation of progressive discipline — written warnings, PIPs, signed acknowledgments — and can show a pattern of the same conduct continuing despite warnings, the chances of denial go up. The situations where fired workers have the BEST odds are: layoffs disguised as firings, performance-based separations without prior warnings, and personality conflicts where no real policy was violated.

Eva St. Cyr
yeah my friend's employer literally had him sign a last chance agreement 6 months before and then fired him the next time anything went wrong. hard to argue against that paper trail I guess

Quick question for the thread — does the industry matter? Like do retail or restaurant workers get treated differently than someone fired from like a professional office job? Or does EDD just look at the facts of the separation regardless?
0 coins
Libby Hassan
EDD applies the same legal standard regardless of industry — willful misconduct under UICC Section 1256. What might vary is the type of conduct that's considered 'misconduct' in different contexts. For example, in safety-sensitive industries (construction, transportation, healthcare) certain violations are held to a higher standard because the stakes are higher. But the underlying legal test is the same. A retail worker fired for a dress code violation and an office worker fired for the same thing would be evaluated using the same framework.

Sophia Carter
That makes sense. I was just curious because I'm in construction and always worried that any job site safety violation would be treated more harshly.

just wanted to add my experience for OP: I drew unemployment after being fired from a tech company 'for cause' last year. The cause was supposedly not meeting performance benchmarks. EDD approved me because poor performance without documented warnings doesn't meet the misconduct standard. Got my full weekly benefit amount which was pretty substantial given my previous salary. The whole process from filing to first payment was about 5 weeks for me.
0 coins
Levi Parker
Author5 weeks total is not as bad as I was imagining. And good to know performance issues aren't automatically misconduct. My situation was kind of performance-related too.
0 coins
Kristian Bishop
Yeah performance PIPs, missing metrics, not being 'a culture fit' — these are basically all ways companies fire people without legal exposure but they rarely constitute UI misconduct. You should be in decent shape. Just document everything you can remember about the conversations when they fired you and write it all out on your claim.

Hunter Hampton
does anyone know if you can get fired and then immediately rehired part time by the same company and still collect partial unemployment? asking for a reason lol
0 coins
Sofia Peña
Yes technically — if your part-time earnings are less than your weekly benefit amount you can collect partial unemployment for the difference (approximately). But you'd need to report ALL earnings from that employer during your weekly certification. EDD cross-checks with employer wage records so don't try to hide it. Also the same employer firing you and rehiring you part-time might raise red flags and trigger another adjudication depending on the circumstances.

Hunter Hampton
yeah that sounds complicated. probably not worth the risk if theres a chance it triggers another review

The thing that stresses me out about all this is I have no idea what my former employer is going to tell EDD. We left on really bad terms and my manager was furious when I left. Can they just make stuff up and will EDD believe them?
0 coins
Adriana Cohn
Employers exaggerate and sometimes outright lie to EDD — it happens. But EDD is not naive about this. They're looking for consistency between the claimant's account and the employer's account, documentation supporting the employer's claims, and whether the stated reason actually meets the legal definition of misconduct. Vague or emotional accusations without documentation generally don't carry much weight. Just be factual and detailed on your end and let the evidence speak for itself.
0 coins
Kaitlyn Otto
Okay that helps. I just have this fear that my word vs their word and they have more credibility because they're the employer.
0 coins
Adriana Cohn
Actually in California UI law the burden is on the EMPLOYER to prove misconduct, not on you to prove innocence. They have to affirmatively demonstrate that you violated a known policy, that violation was willful, and that you had no good cause. If they can't do that with evidence, you win by default basically.
0 coins
Melody Miles
One thing I want to say to OP and everyone else newly dealing with this: the emotional toll of fighting with EDD while also being unemployed is really real. It's not just a bureaucratic inconvenience — it's stressful and demoralizing and the system definitely doesn't make it easy. Be kind to yourself through the process and don't take every delay or confusing notice as a sign you're going to lose.

Update for anyone following this: I filed my claim online this afternoon through UI Online. The whole process took maybe 25 minutes. I described my separation honestly and in detail like people suggested. Now it looks like my claim is in adjudication. They said to keep filing weekly certifications while it's being reviewed so I set a reminder in my phone. Honestly so relieved I finally just did it instead of sitting on the fear.
