Can I apply for California EDD unemployment after 3 months of not working?

So I've been putting this off way longer than I should have and now I'm sitting here three months after losing my job wondering if I even still qualify to file. My last day was in early spring and honestly I just kept thinking I'd find something new quickly so I never bothered filing. Spoiler: I did not find something quickly. Now I'm three months in with no income and no idea if California EDD is going to laugh at me for waiting this long or if there's some cutoff I missed. I was working full time in logistics for about two years before the layoff, so I definitely had enough wages earned. I just… waited. Is it too late to apply for unemployment benefits now? Can you still get approved if you waited months before filing your claim? Will they backdate anything or am I just screwed out of those first three months entirely? Any info would help because I'm kind of panicking.

You can absolutely still file a California EDD unemployment claim even after waiting three months. There is no deadline that says you must file within X days of losing your job. The key thing to understand though is that California EDD does NOT automatically backdate your claim to your last day of work just because you waited. Your benefit year starts from the Sunday of the week you actually submit your claim. So those three months you waited are most likely gone in terms of collecting benefits for that period. You won't get paid for weeks you didn't certify for BEFORE your claim was even opened. File right now today if you haven't already. Every additional day you wait is another day of potential benefits gone.

Wait so the three months I already waited, that money is just gone? Like there's no way to get paid for those weeks at all?

0 coins

Unfortunately yes, for the most part. There's a process called backdating where you can request your claim start from an earlier date if you had a valid reason for the delay like a medical issue or being misinformed by EDD itself, but just not knowing you could file or thinking you'd find work quickly doesn't typically qualify. I'd still ask California EDD about it when you call in, but don't count on it.

0 coins

this is accurate. file NOW. seriously do not wait another single day reading forum posts lol

0 coins

Going through basically the same thing right now except I waited about 6 weeks not 3 months. Filed last week and already got my confirmation number. The online filing at edd.ca.gov is actually pretty straightforward, took me maybe 20 minutes. You'll need your employment info, last employer's address and phone number, and your last day of work. The system walks you through everything step by step.

0 coins

Did they ask you WHY you waited before filing? I'm nervous they're going to flag my account or something for the gap.

0 coins

Nope, not during the online application at least. The system just asks your last day of work and processes from there. If there's any issue they send you a notice but the gap itself isn't automatically a red flag.

0 coins

same, filed online and it was fine. the waiting part after is the annoying part lol

One thing that tripped me up when I finally filed after a delay was the whole backdating request process. After you submit your initial claim you can actually contact California EDD and request your claim be backdated to an earlier date. They require you to explain the reason for the delay. Like I said, most common reasons they accept are things like illness, caring for a sick family member, or being actively misled by EDD. But it doesn't hurt to try explaining your situation. The worst they can say is no and your claim just starts from when you filed. Also important: once your claim is open you need to certify for benefits every two weeks through UI Online or by phone. Don't skip that step thinking it happens automatically.

0 coins

The certifying every two weeks part, is that where you report if you worked or looked for jobs that week?

0 coins

Exactly right. You certify for two weeks at a time and answer questions about whether you worked, earned any wages, were available for work, actively looked for work, etc. California EDD requires you to list three job search activities per week as part of keeping your benefits active.

0 coins

three job searches a week yeah. keep records of everything you apply to just in case EDD ever audits your job search log. dates, company names, position titles, how you applied.

0 coins

Okay so I was in a similar boat last year, waited almost two months before filing because I was too stressed to deal with it and also kind of in denial about the whole situation. When I finally filed I called California EDD to ask about backdating. Getting through on the phone was honestly the hardest part. After about a week of redials and disconnections I found out about Claimyr (claimyr.com) from someone else on this forum. It basically gets you connected to an actual EDD agent without sitting on hold forever. There's a demo video at https://youtu.be/JmuwXR7HA10 that shows how it works. Got through to an agent within the hour, explained my situation, they submitted the backdating review for me right on the call. Didn't get approved for backdating in my case but at least I had a real answer fast instead of wondering for weeks.

I've been trying to call EDD all morning and keep getting the 'we cannot take your call' message. Going to look into that Claimyr thing.

0 coins

claimyr worked for me too. was skeptical at first but got through to someone in like 45 minutes on a tuesday which is apparently prime busy time for edd calls

0 coins

Yeah Tuesday and Wednesday mornings are brutal for EDD call volume. Claimyr helps cut through that. Worth trying especially if you want to ask about the backdating option for your situation.

0 coins

Not to be the bearer of bad news but just want to set realistic expectations here. Three months of missed benefits is probably not recoverable. California EDD backdating is approved in a pretty narrow set of circumstances and 'I thought I'd find work' or 'I didn't know I could file' generally don't make the cut. That said your FUTURE benefits are completely fine. You still qualify based on your base period wages from working two years in logistics, your weekly benefit amount will be calculated normally, you'll just be getting benefits going forward from your file date. Focus on that. File today, certify every two weeks, do your three job searches per week, and you'll be getting payments rolling in pretty soon.

0 coins

How long does it usually take from filing to actually receiving a first payment?

0 coins

For a straightforward claim with no issues or adjudication holds, usually about three weeks from when you file to when you see the first deposit. You'll get a letter with your weekly benefit amount and then start certifying. Some people get it faster.

0 coins

mine took almost 5 weeks but i think there was an issue on my end. three weeks sounds about right for a clean claim

0 coins

Also just want to clarify something for OP since this confused me when I first filed: there's a one week unpaid waiting period built into every new California EDD claim. Your first week of benefits is technically your waiting period week and you won't receive payment for it even if everything is approved. So the first check you actually receive covers week two onward. This is normal and doesn't mean anything is wrong with your claim.

0 coins

Oh wow I had no idea about the waiting week. So even once I'm approved I'm waiting an extra week on top of the processing time?

0 coins

The waiting week is actually counted within your first certification period so it's not really an additional delay, it's just that one of the two weeks you certify for first won't be paid out. The second week will be. Then subsequent certifications cover two paid weeks each.

0 coins

This is right. The unpaid waiting period was temporarily waived during the pandemic but it's back now for regular UI claims in California. Just something to be aware of so you're not confused when your first payment seems lower than expected.

0 coins

ugh this thread is making me stressed on OP's behalf. the whole california edd system is designed to make you jump through hoops and the phone situation is an absolute nightmare. i called 47 times in one day last year and got through exactly zero times. ZERO. filed online eventually and just had to figure everything out myself because getting a human being on the phone is basically impossible

0 coins

47 times in one day?? That sounds exhausting. How did you even manage the whole process without talking to anyone?

0 coins

honestly the UI Online portal handles most of the basic stuff okay. certifying, checking payment status, uploading documents. it's when something goes wrong or you have a specific question that you REALLY need a human and that's where the system completely falls apart

0 coins

This is why services like Claimyr exist honestly. The phone system is genuinely broken and people shouldn't have to make 47 attempts just to get basic questions answered about their unemployment claim.

0 coins

wait genuine question - does the 3 month gap affect your base period wages at all? like do they use different quarters to calculate your benefits because of the delay in filing?

0 coins

Good question actually. Your base period is determined by when you file, not when you stopped working. California EDD uses the first four of the last five completed calendar quarters before you file to calculate your weekly benefit amount. So filing three months later than you 'should have' actually doesn't change your base period wages significantly and might even help in some cases if a better quarter of earnings falls within the calculation window.

0 coins

oh that's actually interesting. so theoretically waiting to file could work in your favor wage-calculation wise even if you lose out on the weeks you didn't collect?

0 coins

In some edge cases yes but you'd almost never come out ahead by waiting because the benefit weeks you lose are typically worth more than any marginal bump in weekly benefit amount from a slightly different base period calculation. Always better to file immediately upon becoming unemployed.

0 coins

Filed after about 10 weeks of not working earlier this year. Here's my timeline so OP has something concrete to reference: Day 1 filed online. Day 4 got confirmation letter with my claim number and weekly benefit amount. Day 10 became eligible to certify for my first two weeks. Day 15 certified online took about 8 minutes. Day 19 first payment hit my Bank of America EDD debit card. So roughly 3 weeks total from filing to first payment for me with no complications.

0 coins

This is so helpful thank you. The Bank of America debit card, is that automatic or do you have to set something up?

0 coins

EDD mails you the card after your claim is opened. You don't have to do anything to request it. Takes about a week to arrive in the mail. You can also set up direct deposit to your own bank account through UI Online if you prefer that.

0 coins

Definitely set up direct deposit if you have a bank account, it's faster than waiting for the card and you don't have to worry about the card getting lost in the mail or sitting in a mailbox.

0 coins

Something nobody mentioned yet: when you fill out the initial application make sure you answer the question about why you're no longer working VERY carefully. If you were laid off, say laid off. If it was a reduction in force, say that. Don't accidentally describe it in a way that sounds like you quit voluntarily or were fired for misconduct because that can trigger an adjudication hold and slow everything down significantly. The initial application language matters more than people realize.

0 coins

I was laid off, my whole department was eliminated. How should I phrase that?

0 coins

Say 'laid off due to lack of work' or 'position eliminated' - those are clean straightforward answers that typically don't raise any flags. If your whole department was cut that's textbook lack of work which is the most straightforward qualifying reason for UI.

0 coins

100% this. 'Lack of work' is the magic phrase basically. It tells EDD exactly what they need to hear and moves the claim through the fastest. Anything vaguer can kick it into adjudication which adds weeks to the process.

0 coins

i mean honestly just file already lol why are people spending hours on forums when you could have just done the thing. edd.ca.gov > file a UI claim > done. took me 20 mins

0 coins

Fair point lol. Filing now as we speak.

0 coins

good!! report back when you get your first payment

0 coins

the forums are useful though for like understanding what to expect after you file. filing is easy the waiting and not knowing what's happening is the hard part

0 coins

OP update us when you've filed! And seriously if you have any issues or need to talk to EDD about the backdating question, don't waste days trying to call on your own. I mentioned Claimyr earlier but just want to reiterate - for anyone who needs to actually speak to a California EDD representative about their claim situation, that service (claimyr.com) saved me so much frustration. The video demo at https://youtu.be/JmuwXR7HA10 shows exactly what to expect. Especially useful if you want to formally request backdating which really does require a phone conversation with EDD.

0 coins

Just submitted my claim! Got a confirmation number. Now I wait I guess. And yeah I'm going to try to call about the backdating thing, will check out Claimyr if the regular phone keeps being impossible.

0 coins

Great news!! The hard part is done. Now just watch for your award letter in the mail, set up direct deposit in UI Online, and start your certification schedule. You've got this.

0 coins

Nice work OP. Now just don't forget to certify every two weeks on schedule. Missing a certification window can complicate things.

0 coins

One more thing worth mentioning for anyone in this situation who does have a genuine medical reason or documented reason for the filing delay: the backdating request form requires written documentation. So if you had a hospital stay, a documented family emergency, or something similarly concrete, gather those records before you call EDD. Having documentation ready on the call significantly improves your chances of getting the backdating approved versus just explaining verbally with nothing to back it up.

0 coins

My reason is honestly just that I was in denial and kept thinking I'd find work. No documentation for that.

0 coins

Yeah that's going to be a tough one to get backdated unfortunately. But focus forward - your claim is open now and you'll start collecting soon. The lost three months is a bummer but your future weeks are fine.

0 coins

honestly same boat as OP when I filed late. no documentation just wishful thinking. just accepted the loss on those weeks and moved on. the benefits going forward were still really helpful.

0 coins

For the job search requirements that will apply to your claim going forward: California EDD currently requires three job search activities per week to be eligible for benefits that week. A job search activity can be submitting an application, attending a job fair, doing a resume workshop, interviewing, using a staffing agency, etc. You don't submit your job search log to EDD every week but you need to keep your own records because they can ask for verification at any point. Some claimants have gotten letters asking to verify job search activities for specific weeks months after the fact.

0 coins

Three per week seems manageable. Do they have to be three different employers or can one employer count for multiple things like applying AND interviewing?

0 coins

Generally EDD counts each separate activity as one activity, so applying to a job and then interviewing at that same company would count as two separate activities on two different dates. Contact with the same employer on the same day would typically only count as one though.

0 coins

I keep a simple spreadsheet with date, company, position, type of contact, and contact info. Takes 2 minutes to update and I sleep better knowing I have documentation if EDD ever questions my job search.

0 coins

Also want to add for OP: once your claim is approved and you're in the system, download the UI Online app or bookmark the website. Certification day every two weeks is important to remember. I literally put a recurring reminder in my phone calendar. If you miss your certification window you have to call EDD to reopen it and that means more phone time which as we've established is not fun.

0 coins

When exactly is certification day? Like does EDD assign you a specific day?

0 coins

Yes, after your claim is opened EDD assigns you a certification schedule. It's usually tied to the last digit of your Social Security number. You'll see your scheduled certification dates in UI Online under your claim details.

0 coins

mine is every other Sunday night, I always certify right when the window opens because apparently certifying early in your window sometimes means faster payment processing. not sure if that's totally proven but it's what I do

Comprehensive summary for OP and anyone else finding this thread later who's wondering if they can still apply for California EDD unemployment after several months of not working: 1. YES you can still file - there's no hard deadline to apply 2. NO they won't automatically pay you for the months you waited 3. Backdating is possible but requires documented valid reasons - just not knowing or hoping to find work doesn't typically qualify 4. Your weekly benefit amount calculation is NOT significantly harmed by filing late 5. File online at edd.ca.gov, it takes about 20 minutes 6. Expect first payment about 3 weeks after filing for a clean claim 7. Certify every two weeks and complete 3 job searches per week 8. If you need to talk to EDD about backdating or any complications, Claimyr (claimyr.com) is worth looking at for getting through on the phone without the endless redial nightmare

0 coins

This is perfect, bookmarking this whole thread. Thank you everyone seriously, I feel so much better about this situation than I did this morning.

0 coins

Good luck OP. The system is annoying but once you're in it it's pretty manageable. Check back in if you run into anything weird during adjudication or with your first certification.

0 coins

solid summary. only thing I'd add is make sure the address on your claim is current because EDD mails important stuff like your award letter and EDD debit card and if it goes to a wrong address it's a whole headache to fix
