Back to California Unemployment

Sean Murphy

Is there a time limit to file for unemployment with California EDD?

So I got laid off from my warehouse job back in March and honestly I kept putting off filing because I thought I'd find something new pretty quick. Well here I am two months later still job hunting and my savings are almost gone. I finally decided to look into filing but now I'm freaking out wondering if I missed some kind of deadline. Is there actually a time limit to file for unemployment with California EDD? Did I just shoot myself in the foot by waiting this long? I can't find a clear answer anywhere on the EDD website and every time I try to call I just get automated messages or get hung up on. Really hoping someone here knows the answer because I'm kind of panicking right now.

You didn't completely miss out but yeah timing does matter with California EDD. When you file, they establish what's called a benefit year which runs for 52 weeks from your application date. Your weekly benefit amount gets calculated based on your earnings during a specific base period, which looks at wages from about 5 to 17 months before you file. The longer you wait to file, the more your base period shifts forward in time. If you had lower earnings in those more recent quarters compared to earlier ones, your benefit amount could actually be lower than if you'd filed right away. So technically no hard cutoff but there are real financial consequences to waiting.

0 coins

Ok so I'm not totally disqualified but I might get less money because I waited? That's rough. My March and April were actually pretty light on hours because work was slowing down before they let me go. Would that affect the calculation badly?

0 coins

It depends on exactly which quarters fall into your base period now vs when you were laid off. The standard base period for California EDD looks at the first four of the last five completed calendar quarters before you file. I'd honestly just go ahead and file through UI Online right now and see what benefit amount they calculate. You can always ask EDD to use the alternate base period if the standard one gives you a low number.

0 coins

This is correct info. The alternate base period uses the four most recently completed quarters and can sometimes work out better depending on your work history. Worth knowing that option exists.

0 coins

also important thing people dont realize - your benefits dont go back to when you got laid off if you wait to file!! whatever date you submit your application is when your claim starts. so those two months you spent not filing are just gone, EDD wont pay you for that time retroactively. only exception was during covid stuff but thats done now

0 coins

Wait seriously?? I thought they would pay back to when I lost my job. Oh man that's like 8 weeks of benefits I just lost by not filing sooner. I feel sick right now.

0 coins

yeah unfortunately thats how it works. file TODAY dont wait another day. the sooner you get your claim in the sooner your benefit year starts and the sooner you can actually get paid

0 coins

exactly what they said. go to UI Online right now, it takes maybe 30 minutes to complete the application. every day you dont file is another day you wont get paid for

Since you're dealing with the phone situation I want to throw something out there that helped me when I was going through my claim last year. I had the same issue trying to reach a live EDD agent - kept getting the 'high call volume' message and getting disconnected over and over. Someone on a different forum mentioned Claimyr (claimyr.com) and I was pretty skeptical at first but I tried it. Basically it handles the whole hold process for you and gets you connected to an actual EDD rep. There's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works. I was able to talk to someone about my claim questions within the same day which was honestly a miracle compared to my previous 2 weeks of failed attempts. If you have questions about your base period situation or want a rep to walk you through your options that might be worth looking into.

0 coins

I've been trying to get through to EDD for weeks so this is actually really helpful. I'll check out that video. Did they help you figure out specific claim stuff or just general questions?

0 coins

I had questions about my specific benefit amount calculation and they were able to look up my account and go through everything with me. Way more useful than trying to navigate the website alone when you have a specific situation.

0 coins

gonna save this link. been struggling to get through to EDD about a different issue and its been a nightmare

0 coins

One thing nobody mentioned yet - once you do file, make sure you understand the waiting week. Your first week of certification you certify but EDD doesnt pay you for it. Its just a mandatory unpaid waiting period. So factor that in, you wont get paid for week 1. After that assuming your claim is approved you should start seeing payments when you certify every two weeks through UI Online or by phone.

0 coins

Is the waiting week still a thing? I thought they got rid of it at some point during covid

0 coins

It came back after the pandemic era provisions ended. Yes as of right now there is a one week unpaid waiting period for new California EDD claims. You still have to certify for it, you just don't receive payment for that first week.

0 coins

Confirmed. The waiting week is back in effect. First week of an active claim is always unpaid regardless of your reason for separating.

0 coins

I went through something almost identical last year, laid off in June but didn't file until August because I kept thinking I'd land something before it became necessary. By the time I finally filed I had missed out on a ton of weeks of benefits AND my benefit amount ended up lower because the base period calculation shifted. The EDD rep I eventually talked to basically said there's no official deadline to file in terms of eligibility, you just lose out on back pay and potentially get a different benefit calculation. File now no matter what. Even if your amount ends up being lower than it could have been, something is better than nothing while you keep job hunting.

0 coins

This is exactly my situation. How long did your claim take to get approved after you filed?

0 coins

Mine went into adjudication for about 3 weeks because of some questions about my separation reason. If your layoff is straightforward - like they eliminated your position or cut staff - it usually goes faster. Make sure when you fill out the application you're very clear that it was a layoff and not a quit or termination for cause.

0 coins

It was definitely a layoff, they closed the whole department. I'll make sure I explain that clearly. Thanks for the heads up about adjudication, I'll be prepared for a possible wait.

0 coins

doesnt matter just file already lol the website is easy

0 coins

Yeah I'm going to file today after reading all this. Just needed to make sure I wasn't completely ineligible first.

0 coins

To give you a more complete picture on eligibility requirements since you're filing: California EDD requires that you earned enough wages during your base period (at least $1,300 in your highest earning quarter, or at least $900 in your highest quarter AND total base period wages of 1.25 times that high quarter amount). For a warehouse worker who was employed for a while before March, you almost certainly meet this threshold unless you had a lot of gaps in employment. The job search requirement also kicks in immediately - you need to be actively looking for work each week you certify and be ready to document at least three job search contacts per week if audited.

0 coins

Wait is it three per week now? I thought it used to be one job search activity per week

0 coins

The standard requirement is three job search activities per week for most claimants. Some exceptions exist like if you're on standby status or in an approved training program. But for a standard UI claim yes you should be doing and documenting at least three per week.

0 coins

Correct. And keep a log with dates, employer names, contact method, and position applied for. EDD can ask to see this at any point and you want to have documentation ready.

0 coins

UGH the EDD phone system is absolutely infuriating. I have been trying to get through for THREE WEEKS about my adjudication and literally cannot reach a human being. I get the 'we are experiencing high call volume' recording and then it disconnects me. Every. Single. Time. How is this even legal?? People are waiting on money they need to pay rent and groceries and EDD just has an automated system that hangs up on you. I know this is kind of off topic from your question but your comment about not being able to get through really hit me.

0 coins

I feel you on this. That's exactly why I mentioned Claimyr earlier in this thread - claimyr.com. It solved this exact problem for me when I was going through the same cycle of getting hung up on repeatedly. There's a walkthrough at https://youtu.be/JmuwXR7HA10 if you want to see how it works before trying it. Specifically for adjudication situations talking to a live rep can actually move things along faster.

0 coins

I just watched that video and I'm going to try it today honestly I have nothing to lose at this point. Thank you

0 coins

The phone system is genuinely awful. I've started calling right when they open at 8am and even then sometimes it's busy immediately. Good luck to you

Jumping in with some practical filing tips since you're about to start the application. Have these ready before you begin: your Social Security number, your last employer's name address and phone number, the exact date of your last day of work, your reason for separation (layoff in your case), and your banking info for direct deposit if you want payments faster than the EDD debit card. The application on UI Online saves your progress so you don't have to finish it all at once but it's generally easier to just do it in one sitting if you have everything together. After you submit you'll get a confirmation number - write this down. It can take 3-5 weeks to get your first payment even after approval, so the sooner you file the better.

0 coins

This is super practical thank you. I actually have all of that info available. Going to sit down and do it tonight.

0 coins

Direct deposit is way faster than the debit card. Set up direct deposit when you apply if you can.

0 coins

Agreed on direct deposit. EDD debit card payments sometimes have additional delays compared to direct deposit to your bank account.

0 coins

my cousin waited like 6 months to file and EDD denied him i think? not totally sure why but i remember him being really upset about it. might be worth calling to double check before you file just in case

0 coins

A 6-month delay itself wouldn't cause a denial. More likely his base period wages didn't meet the minimum earnings threshold after that much time passed, or there was some other issue with his specific situation. The delay itself doesn't trigger an automatic denial in California - it just affects which wages EDD looks at for calculating your benefit amount.

0 coins

ohh ok that makes sense. yeah he had been between jobs a lot so maybe his earnings were too low

0 coins

Yeah low base period wages is a very common reason for denial especially if someone has gaps in employment. Different issue from filing late though.

0 coins

Something I want to flag about your situation specifically - when you certify for your first weeks, you might be asked about your availability and job search activities going back to your lay off date even though you didn't file back then. Just to be clear: you only certify starting from your official filing date, not from when you lost your job. Don't try to certify or claim for weeks before you filed. Your claim period starts the Sunday of the week you submitted your application.

0 coins

That makes sense. So I just certify from this week going forward and I can't claim anything for March April or May regardless.

0 coins

Exactly. Your benefit year starts fresh from your filing date. Those earlier weeks are gone unfortunately but at least you know going forward you're good as long as you're certifying on time and meeting the job search requirements.

0 coins

Can I ask a semi related question - does the time of year you file matter? Like does filing in summer vs winter affect anything about your benefits?

0 coins

The calendar timing of your base period quarters matters more than the season per se. But if you had higher wages in certain quarters (like if your industry has seasonal patterns), filing at a time that captures those high-earning quarters in your base period can increase your weekly benefit amount. For most people it's not a significant factor but in seasonal industries it can be.

0 coins

Interesting, I work in retail which is definitely seasonal so that's good to know. Might think about timing if I ever need to file.

0 coins

Good thing to be aware of. For most standard W-2 employees the difference is small but it's worth understanding if your income varies significantly by quarter.

0 coins

Something that tripped me up when I first filed - make sure the email address you put on your UI Online account is one you actually check regularly. EDD sends notices there that have deadlines to respond and if you miss them your claim can get flagged or delayed. I almost missed an eligibility interview notice because it went to an old email. Check your UI Online inbox AND your email constantly in the first few weeks after filing.

0 coins

Good tip. I'll use my main email and set up notifications.

0 coins

the UI Online inbox and your regular email can have different notices so check both. some stuff only shows in the online portal not your email

0 coins

Yes exactly - UI Online messages and email notifications don't always mirror each other. Both are important to monitor.

0 coins

I was in your exact shoes 8 months ago, scared I waited too long, couldn't get anyone on the phone, didn't understand the process. I just want to say it does work out eventually. Filed late like you, got approved, benefits aren't as high as they could have been but they helped me get through until I found my current job. The system is frustrating but it does work if you're patient. Just file and then check in regularly.

0 coins

This is really reassuring to hear. Thank you. I feel a lot better about where I'm at after reading through this whole thread.

0 coins

Good luck! The first few weeks of waiting are the hardest. After that it becomes more routine.

0 coins

One more thing - after you file, EDD will mail you a paper notice called the Notice of Unemployment Insurance Award if your claim is approved. This shows your weekly benefit amount and the total award for your benefit year. Hang onto this document. Also make sure your mailing address in UI Online is correct because some correspondence still comes by mail even though most stuff is electronic now.

0 coins

I moved recently actually - is it easy to update my address in UI Online?

0 coins

Yeah you can update it in your profile settings once you have an account. Do it as soon as you file. I'd also call EDD to confirm the update went through because address changes sometimes need to be verified, especially if your claim is already active.

0 coins

For address changes specifically, updating in UI Online should be sufficient but yes confirming with EDD directly adds a layer of security. The last thing you want is for an important notice to go to a wrong address during adjudication.

0 coins

Update: I tried Claimyr like that person suggested above and actually got through to an EDD agent today about my adjudication. The agent told me my claim had been sitting waiting for a return call that I never got notice about - which is infuriating - but at least now I know and they're supposedly moving it forward. If you end up needing to talk to someone about your claim after you file that service is worth knowing about. Visit claimyr.com if you're stuck in the EDD phone loop.

0 coins

Oh wow glad it worked out! That's actually really helpful to know you can use it for adjudication issues specifically

0 coins

The missing notice thing is SO common with EDD adjudication. Notices get sent to wrong emails or old addresses and claimants have no idea their claim is stalled waiting on them. Good that you got it sorted out.

0 coins

Yeah I was completely unaware. My claim had literally been sitting there for three weeks waiting on me and I had no clue. The system for notifying people is terrible.

0 coins

For anyone landing on this thread while searching about California EDD filing deadlines - the short version is there's no strict cutoff date to file for unemployment but every week you delay is a week of potential benefits you lose permanently since EDD doesn't backpay to your layoff date. File as soon as possible after losing your job. And if you run into trouble reaching EDD after filing, whether it's about adjudication, your benefit amount calculation, or anything else, claimyr.com is a legitimate option for getting connected to a live agent without the usual phone runaround.

0 coins

Thanks to everyone in this thread. I filed tonight. Took about 25 minutes. The application was pretty straightforward. Now I just wait I guess.

0 coins

Nice! Now make sure you know your certification dates - you'll certify every two weeks and missing a certification can cause payment delays or gaps. Set a reminder on your phone.

0 coins

Good move filing today. Your benefit year is officially started. Check UI Online in a week or so for any status updates and respond to anything EDD sends you within the deadline they specify. Good luck with the job search.
