How long do you have to file for unemployment with California EDD?
So I got laid off from my warehouse job about 6 weeks ago and I kept putting off filing because I thought I'd find something new pretty quickly. Well here I am still jobless and now I'm stressing about whether I even waited too long to file. My manager told me there's some kind of deadline and if you miss it you lose everything which honestly sent me into a panic. Does anyone know how long you actually have to file for unemployment with California EDD? Like is there a hard cutoff date? I'm also wondering if filing late means my weekly benefit amount gets affected or if I can still get backdated payments for the weeks I didn't file. I've been reading different things online and can't figure out what's actually true. Would really appreciate any help from people who've gone through this.

Good news - California EDD doesn't have a strict deadline that permanently bars you from filing. You can still file a new claim even after several weeks. That said, there are some important things to understand about timing. Your benefit year starts from the date you file, not from the date you were laid off. So if you wait 6 weeks to file, you generally cannot go back and claim benefits for those 6 weeks you waited unless you request backdating with a valid reason. The EDD does allow backdating in some circumstances but you'd need to explain why you couldn't file earlier. I'd recommend filing your initial claim ASAP through UI Online at unemployment.edd.ca.gov to lock in your benefit year start date right now.

AuthorWait so the 6 weeks I already waited - those might just be gone? That's a significant chunk of money I potentially missed out on. Do I at least have a shot at getting those backdated if I explain I was job hunting and thought I'd find something?

Honestly the backdating requests are hit or miss. EDD evaluates them case by case. 'I was job hunting' alone probably won't be sufficient - they usually want documented circumstances like illness, a death in family, or technical barriers. But it never hurts to request it and explain your situation. More importantly though, file TODAY so you stop losing any more weeks.

This is correct. The benefit year is 52 weeks from your claim opening date. Filing late just shrinks the window where you can potentially collect. Your weekly benefit amount itself isn't affected by when you file though - that's calculated from your base period wages regardless.

how long to file for unemployment was literally my first google search when I got laid off lol. I was freaking out thinking I had like 2 weeks or something. Filed same week I got let go and it still took forever to process. Def file asap dont wait

AuthorYeah I really wish I had just done it right away instead of convincing myself I'd find something fast. Live and learn I guess.

same here filed right away and still had issues for weeks, the system is a mess regardless of when you file

Filing right away is always the move but since you're already 6 weeks in here's what I'd do step by step. First go to unemployment.edd.ca.gov and start your UI Online claim today. During the application there's a section where you can request backdating - fill that out and explain your situation as clearly as possible. Second, once your claim is filed you'll need to certify for benefits every two weeks through the UI Online portal or by phone via EDD Tele-Cert. Third, you'll also need to start meeting California's job search requirements which is typically 3 job search activities per week that you have to document. Don't skip this even while waiting for your claim to process or you could get disqualified for those weeks.

Jenna Sloan
AuthorThe job search requirement - does that apply retroactively for the weeks before I filed? Or just going forward from when I submit the claim?
0 coins
Diez Ellis
Just going forward from when you file. You can't retroactively document job searches for weeks before your claim existed. Another reason to file now rather than waiting another day.

the 3 activities per week thing is important, I got nailed for not documenting properly even though I was actually applying places. keep records of everything dates names of employers confirmation emails whatever you can save

I was in almost the same boat as you earlier this year - waited almost 5 weeks because my employer told me I might get recalled and I didn't want to file prematurely. When I finally did file I requested backdating and got partially approved for 2 of the 5 weeks but not all of them. So sometimes it works out partially even if not fully. One thing that really helped me was actually getting through to a live EDD agent to explain my specific situation. I'd been trying to call forever and couldn't get anyone. Someone here actually mentioned Claimyr which is a service at claimyr.com that helps you get connected to an EDD rep without sitting on hold for hours. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - honestly it made a huge difference being able to actually talk to someone about my backdating request instead of just hoping my online notes got read.

AuthorGetting through to an actual person sounds like exactly what I need to explain my situation for the backdating request. I'll check out that Claimyr link, thank you.

I've heard of Claimyr before, someone in another thread mentioned it too. Did it take long to actually get connected to an agent?

For me it was much faster than trying to call directly. Way better than the endless redials I was doing before.

WAIT. your manager told you there's a deadline and you lose everything?? That sounds like something an employer would say to discourage people from filing lmao. Employers have a financial incentive to keep claims off their record. You absolutely can still file. File TODAY. Don't let anyone discourage you from using benefits you paid into through your paycheck taxes.

Jenna Sloan
AuthorHonestly that crossed my mind too. He mentioned it pretty casually and it just scared me enough that I kept putting it off.

Laila Prince
Classic. File right now. EDD won't penalize you for filing 6 weeks in. You might lose those past weeks but your claim going forward is totally valid.

To be fair there IS a benefit year deadline concept - your claim has to be filed within your base period window to receive maximum benefits, and your weekly certifications have to be done within a certain timeframe each week. But nothing about the claim being permanently invalid because you waited a month or two. The manager was exaggerating at minimum.

Let me give some more technical context on how California EDD calculates your benefit amount because this affects how important filing timing really is. Your weekly benefit amount is based on your 'base period' which is roughly the first 4 of the last 5 completed calendar quarters before you file. If you wait several months to file, your base period actually shifts and might include different quarters - this could help or hurt your weekly benefit amount depending on when your highest earning quarters were. For most people who got laid off recently, filing sooner rather than later usually captures the base period that includes your most recent high-earning months.
0 coins
Jenna Sloan
AuthorOh wow I hadn't thought about the base period shifting. So theoretically waiting could actually change my weekly payment amount not just how many weeks I collect?
0 coins
Sasha Reese
Exactly. It's not always a big difference but it's worth filing now rather than letting more time pass. The EDD has an alternate base period option too if the standard one doesn't give you enough wages to qualify - you can ask about that when you file.

this is actually really good info I wish someone had explained the base period thing to me when I filed

Something nobody mentioned yet - when you do file make sure you have all your information ready. You'll need your employer's full legal name and address, your last date worked, the reason for separation (layoff, not quit), your employment history for the past 18 months roughly, and your bank info for direct deposit if you want payments that way rather than the EDD debit card. Having all that together before you start the application makes the process way smoother and reduces the chance of your claim hitting adjudication because of missing info.
0 coins
Jenna Sloan
AuthorGood call, I'll gather all that before I start. Does the reason for separation matter a lot? Like does 'laid off' process faster than other reasons?
0 coins
Drew Hathaway
Definitely. Layoffs are generally the most straightforward separation reason - EDD doesn't need to investigate whether you voluntarily quit or were fired for cause. Your claim is much less likely to go into extended adjudication with a clean layoff.

Also make sure you have your Social Security number handy and your driver's license or state ID. The ID.me identity verification step will need those.

I filed late once by about 3 weeks and didn't bother with the backdating request because I figured it wouldn't work. Later found out my coworker requested backdating in a similar situation and got approved for like half his missed weeks. Definitely at least try - worst they can say is no.
0 coins
Jenna Sloan
AuthorThat's encouraging to hear. I'll definitely include the backdating request when I file.

Yeah just be honest and specific about why you delayed. Vague answers don't help your case.

Can I ask a related question - how long does EDD actually TAKE to process the claim once you file? I filed 2 weeks ago and still nothing approved
0 coins
Christian Burns
Processing time varies a lot. Simple layoff claims with no issues can come through in 3-4 weeks. Anything that requires adjudication (which happens when there's a question about your eligibility) can stretch to 6-10 weeks or longer unfortunately. You can check your claim status in UI Online.

Vanessa Figueroa
ugh its been 2 weeks and my status just says pending. I guess I wait more

If you're worried about where things stand, that's exactly when getting an actual EDD agent on the phone helps. claimyr.com is what I used to get through without the endless busy signals - way less stressful than trying to call in blind.

the whole system is honestly broken. I filed correctly on time, did everything right, and still waited 9 weeks for my first payment. meanwhile bills don't stop. I don't understand why it's so difficult when you clearly got laid off and have all the documentation
0 coins
Laila Prince
SAME. The system is designed to frustrate people into giving up. Document everything, keep calling, don't stop.

Sasha Reese
It's genuinely backlogged and understaffed unfortunately. The best way to move a stalled claim is to actually get an EDD agent on the line who can flag your claim for review. Persistent communication does help even when it doesn't feel like it.

UPDATE: I went ahead and filed this afternoon after reading all these replies. I included a backdating request explaining I had delayed because I expected to be recalled and then was actively applying on my own. The whole application took about 40 minutes. Now I just have to wait. Thank you everyone who helped!

Great move filing today! Make sure to start your job search documentation immediately and certify on time every two weeks once your claim is processed. Good luck!

Nice work. Set a reminder for your certification dates so you don't miss them - a missed certification can create unnecessary headaches even after your claim is approved.

slightly different situation but related - what if you got laid off but your employer is contesting the claim saying you quit voluntarily? Does the timeline question still apply or does that change everything
0 coins
Sasha Reese
A contested claim goes into adjudication regardless of timing. EDD will contact both you and the employer for statements and then make an eligibility determination. You should still file as soon as possible - a delay doesn't help your case and means you're not even in line while the investigation happens. Gather any evidence you have showing you didn't voluntarily quit - emails, separation paperwork, texts, whatever you have.

Dominique Adams
Ok thank you. My employer sent me an email saying my position was being eliminated but is now saying I resigned. I have that email saved which seems like it should settle it?
0 coins
Sasha Reese
That email is exactly the kind of documentation that wins adjudication disputes. Upload it when you respond to EDD's request for information and reference it clearly in your written statement.

I'm on week 11 of waiting after filing on time and I'm about to lose my apartment. How is someone supposed to survive this process

Have you been able to reach anyone at EDD at all? At this point with 11 weeks elapsed you need to escalate. Try contacting your state assembly representative's office - they have EDD liaisons who can actually get claims unstuck. Seriously this is what those offices are for.

Also try Claimyr at claimyr.com to get connected to an EDD agent directly - at 11 weeks your claim needs human attention not just status checks in the portal. There's a demo video at https://youtu.be/JmuwXR7HA10 so you can see how it works before trying it. Getting through to someone who can actually see your file is the priority right now.

genuine question - if you file and then get a job before your claim is approved do you have to cancel the claim or just stop certifying
0 coins
Diez Ellis
You stop certifying for the weeks you worked full time. If you go back to work you simply don't certify for those weeks or you certify 'yes I worked' and report your earnings. Your claim stays open during your benefit year in case you need it again - like if that job ends. No need to formally cancel anything.
0 coins
Muhammad Hobbs
oh that's good to know, I was afraid I'd get in trouble for having an open claim while working
0 coins
Christian Burns
You do need to accurately report any wages you earn while certifying though. Underreporting earnings is considered fraud and EDD does cross-check wage records. Just be honest about what you earned and the system handles the math on any partial benefit you might receive.

One more thing worth knowing - if you're filing for the first time ever with California EDD you'll need to go through ID.me verification which is an identity verification step that has tripped a lot of people up. Have your government ID ready and be prepared for the facial recognition component. If the automated verification fails you can request a video call with an ID.me agent. Don't let this step stall you out - it's annoying but doable.
0 coins
Jenna Sloan
AuthorI actually ran into this during my filing today! The facial recognition kept failing and I got frustrated but eventually the video call option worked perfectly. Good heads up for others.

For anyone still lurking who's afraid they waited too long - I want to be really clear: file anyway. Even if you think you've missed something, even if it's been months, even if you're not sure you qualify. The worst EDD can do is deny you and you can appeal that. But if you don't file you definitely get nothing. The answer to 'how long do you have to file for unemployment' in California is basically: file as soon as humanly possible but don't let fear of being late stop you from filing at all.

The timing shouldn't affect processing but it does sometimes affect whether the portal feels sluggish. Either way just get it done whenever you can rather than waiting for a perfect time.

Final update from me - I used Claimyr like someone suggested a few comments up and actually got through to an EDD agent within the same day. She looked at my claim and it was stuck because of an employer name discrepancy that nobody told me about. Got fixed while I was on the phone. Payment came through 4 days later. Wild that a 5 minute conversation fixed what 2 weeks of waiting couldn't.
