How long do I have to apply for unemployment with California EDD?
So I got laid off from my warehouse job about 6 weeks ago and honestly I kept putting off filing because I thought maybe I'd find something fast. That didn't happen. Now I'm sitting here wondering if I missed my window entirely or if California EDD still lets you apply. Does anyone know how long you actually have to apply for unemployment after losing your job? I've been reading conflicting stuff online and I can't figure out if there's like a hard deadline or if I just lose out on back pay for the weeks I waited. My last day was mid-March and I haven't filed anything yet. Really stressed about this.

Good news - there's no hard deadline to file for unemployment with California EDD. You can technically file at any time after losing your job. BUT here's the catch that trips up a lot of people: your benefit year is based on when you file your initial claim, not when you were laid off. So by waiting 6 weeks, you've already potentially lost those 6 weeks of benefits unless you file a backdating request explaining why you didn't file sooner. California EDD does allow backdating under specific circumstances like illness, lack of internet access, or other good cause reasons. When you file, make sure to explain that you were actively trying to find work first and thought you'd land something quickly - that's sometimes accepted as good cause depending on the EDD rep reviewing it.

AuthorWait so I might be able to get those 6 weeks back?? I had no idea backdating was even a thing. How do I request that when I file?

The backdating thing is real but honestly getting it approved is hit or miss. I applied for backdating when I waited 3 weeks and they denied it saying waiting to find work wasn't sufficient good cause. ended up just losing those weeks entirely

To answer OP's question about HOW to request backdating - when you file online at UI Online, one of the early questions asks when you want your claim to start. Select the week you actually became unemployed, not the current date. Then there's a section where you explain why there was a gap. Be honest but emphasize any barriers you had to filing sooner.

yeah just file immediately, even if you think you'll find a job. you can always stop certifying once you're employed again

Something important people aren't mentioning - when you file matters for your base period calculation too. California EDD uses what's called a base period to determine how much you get per week. The base period is typically the first four of the last five completed calendar quarters before you file. So depending on exactly when you file, your benefit amount could actually change. If you made more money in a recent quarter that isn't being counted, you might qualify for an alternate base period calculation. I'd recommend filing soon and then asking EDD directly about your specific situation to make sure you're getting the maximum benefit amount you qualify for.

AuthorI didn't even know about base periods at all. So the longer I wait the more it could mess with how much I get per week?

Alicia Stern
Potentially yes. If you wait until a new quarter starts, one of your higher-earning quarters might drop out of the calculation. File this week if you can.

this is actually really good info, I wish someone had told me this when I filed. I definitely lost money because I filed at the wrong time in the quarter

After reading everyone's advice here I really think you need to actually TALK to someone at California EDD about your specific situation before assuming the worst. The problem is getting through to them is basically a full time job - I spent two weeks trying to reach an agent and just kept getting busy signals and disconnected calls. A friend told me about Claimyr (claimyr.com) which basically holds your place in the EDD phone queue so you're not sitting on hold for hours. They have a video showing how it works at https://youtu.be/JmuwXR7HA10 - it's pretty simple. I used it and actually got through to an EDD rep who was able to look at my specific base period situation and tell me exactly what I'd qualify for. For something like backdating where the details really matter, talking to an actual agent is worth it.

AuthorI've heard getting through to EDD on the phone is nearly impossible. Does this Claimyr thing actually work? I'm skeptical lol

Honestly I was skeptical too but I was desperate. Got a call back within a couple hours and spoke to a real person. Made a huge difference for sorting out my claim questions.

To directly answer your question about the timeline - California EDD says you should file your UI claim in the first week you're unemployed or working reduced hours. That's the official guidance. BUT like others said, nothing stops you from filing later, you just lose benefits for the weeks before you file (unless backdating is approved). The claim itself stays open for a year from when you file - that's your benefit year. You can collect up to 26 weeks of benefits during that year.
0 coins
Aria Park
Author26 weeks max total, got it. And the benefit year starts from when I file not when I got laid off?
0 coins
Alexander Zeus
Correct. Your benefit year is 52 weeks starting from your filing date. You have that whole year to use your 26 weeks of benefits if you haven't found work yet.

Chloe Boulanger
worth noting you don't have to use all 26 weeks consecutively either. if you find part time work you might be able to do partial claims

One thing I want to add about the backdating process since it seems like OP's main concern - California EDD backdating requests are evaluated case by case. Common reasons that get APPROVED include: medical condition preventing you from filing, no computer or internet access, caring for a seriously ill family member, recent release from incarceration, or natural disaster. Simply waiting to look for work first is unfortunately one of the harder ones to get approved. That said, I've seen people report success when they explained they genuinely didn't know they could file while job searching, or that they misunderstood EDD rules. Document whatever your reason was as specifically as possible.

Aria Park
AuthorHonestly I think my reason was just not knowing I should file right away. Is 'I didn't know' ever accepted?
0 coins
James Martinez
It can be under 'claimant was unaware of right to benefits' which is actually listed as a potential good cause reason. Not guaranteed but worth explaining honestly and specifically.
0 coins
Noah Ali
This is accurate. The more specific and honest you are about why you delayed, the better your chances. Vague answers like 'I was busy' don't help. If you genuinely didn't understand you could collect while job searching, explain exactly that.

THE EDD SYSTEM IS DESIGNED TO CONFUSE PEOPLE SO THEY MISS DEADLINES AND LOSE MONEY. I swear this is intentional. My coworker didn't know about filing and lost 8 weeks of benefits. There's nowhere prominent on their website that tells you to file immediately. They make millions off unclaimed benefits.
0 coins
Chloe Boulanger
I mean I don't think it's necessarily intentional but the information is definitely not easy to find. They should make it way more obvious
0 coins
Jordan Walker
it IS intentional, they save money every time someone doesn't file or files late. follow the money
0 coins
Noah Ali
Whether intentional or not the result is the same - people lose benefits they're entitled to. That's why threads like this are important, spreading the word to file immediately.

Since you mentioned your last day was mid-March - depending on exactly when you file now, you're entering a new quarter (April-June). This could actually affect your base period calculation. I'd strongly suggest filing today or this week before any more of the quarter passes. The quarterly cutoffs can shift which wages EDD considers when calculating your weekly benefit amount. Don't stress too much about it but sooner is definitely better than later at this point.

Good! Make sure you have your last employer's info handy, your SSN, and your approximate earnings from the last 18 months or so. It'll make the process faster.

wait so if youre working part time can you still apply for unemployment? asking for a friend lol
0 coins
Alexander Zeus
Yes! You can file for partial unemployment if your hours were reduced. California EDD has a partial claim option. You report your part time wages each week when you certify and they calculate a reduced benefit. The earnings disregard is 25% of your weekly benefit amount - anything over that reduces your payment dollar for dollar.

Natalie Adams
oh wow didnt know that. my friend works like 15 hours a week now when they used to be full time, sounds like they should definitely file

James Martinez
Your friend should file ASAP then. Partial claims are super underutilized and people leave a lot of money on the table by not knowing about this option.

I was in a similar spot last year and panicked about the same thing. What I'll say is just file, see what happens with backdating, and if you get denied on the backdating at least you'll have your claim going forward from today. Half of worrying about this stuff is just not knowing, once you file and get your award letter showing your weekly benefit amount it becomes a lot less scary.

Aria Park
AuthorThat's a really good perspective, thank you. I've been catastrophizing when really the worst case is I just lose the weeks I already waited.

Sarah Jones
Exactly. And worst case still means you get 26 weeks of benefits going forward, which is significant. Good luck!

does anyone know if you have to do the job search thing like immediately after filing or does that start after you're approved? I'm in a similar situation to OP and confused about when requirements kick in
0 coins
Noah Ali
Great question - California EDD requires you to conduct job search activities starting from the week you first certify for benefits, even while your claim is pending approval. You need to keep a record of your work search contacts (currently 3 per week for most claimants). Start your job search log from day one, even before you hear back about approval.
0 coins
Elijah O'Reilly
3 contacts per week seems like a lot, are there different types that count or does it have to be actual job applications?
0 coins
Noah Ali
Various activities count - submitting applications, attending interviews, contacting employers, attending job fairs, completing skills assessments through CalJOBS, etc. EDD rarely audits but if they do ask you need records of at least 3 activities per week.

I got flagged once for not keeping detailed enough records. They wanted employer names, contact info, position applied for, method of contact, and date. Keep very specific notes from the start.

Coming back to this thread because I want to emphasize again - if OP's backdating request gets complicated or they need to explain their situation to EDD, actually talking to an agent is really the best path. Claimyr (claimyr.com) was the only way I was able to get through after weeks of failed attempts at calling EDD directly. The video at https://youtu.be/JmuwXR7HA10 explains how the callback system works. Getting to speak with a human EDD rep about something nuanced like backdating good cause can make all the difference versus trying to handle it through online messages that take weeks to get responses.

Gabriel Graham
Second this - my backdating situation got complicated and the online message system took 3 weeks to respond. An actual phone call resolved it in 20 minutes.

i think the deadline thing also depends on whether you were laid off vs quit vs fired right? like the timeline for filing might be different?
0 coins
Alexander Zeus
The filing timeline is the same regardless of separation reason - there's no hard deadline to apply in any case. BUT the reason for separation absolutely affects whether you're eligible at all. Laid off = typically eligible. Fired for misconduct = typically disqualified. Quit = typically disqualified unless you had good cause to quit (unsafe conditions, following a spouse who relocated, etc.
0 coins
Amara Torres
oh ok so same deadline rules but different eligibility rules, got it
0 coins
Alicia Stern
Exactly right. And if you're disqualified for separation reason, you can appeal within 30 days of the determination notice. That 30-day appeal window IS a hard deadline unlike the application itself.

not to derail but can someone explain what adjudication means? I see it mentioned everywhere and I filed 5 weeks ago and my claim says 'pending adjudication' and I'm freaking out
0 coins
James Martinez
Adjudication just means EDD is reviewing your claim more closely to determine eligibility - it's not automatically bad news. It happens when there's a question about your separation, your availability for work, your earnings, or other factors. It can take anywhere from a few weeks to a few months unfortunately. Keep certifying every two weeks even while pending!
0 coins
Olivia Van-Cleve
oh thank god it doesn't automatically mean I'm denied. I've been assuming the worst. What should I be doing while it's pending?

Noah Ali
Exactly what you're already doing - keep certifying, keep your job search log, respond immediately to any mail or phone calls from EDD, and check UI Online regularly for updates. If you haven't heard anything after 8 weeks, that's when I'd try to contact them directly to check status.

One thing nobody mentioned - after you file your initial claim you have to wait out what EDD calls a non-payable waiting week. Your first week of eligibility won't be paid even if everything is approved. It's basically a one-week waiting period built into the system. So your first actual payment will cover week 2 onward. Just so OP knows not to panic when the first certification shows $0.

Aria Park
AuthorOh wow I had no idea about this. Good to know in advance so I don't freak out.

This is accurate. The waiting week requirement has been in place in California for a long time. Plan your budget accordingly for that first week gap.

Chloe Boulanger
to be clear the waiting week doesn't use up one of your 26 weeks of benefits, it's separate from your maximum benefit amount

One more thing worth mentioning - once you do file, make sure you set up your UI Online account properly and sign up for text or email notifications. EDD will sometimes send notices requiring a response within a short window (like 10 days) and if you miss them it can cause your claim to be denied or delayed. I missed a notice once because I wasn't checking my UI Online messages and had a mess to untangle. Also register on CalJOBS when you file - EDD increasingly cross-references CalJOBS activity with your claimed job search contacts.
0 coins
Aria Park
AuthorThe notification thing is super important, thanks. I'll make sure to set those up immediately when I file.

Also check your spam folder if you sign up for email notifications - EDD emails sometimes get filtered. I almost missed an important eligibility questionnaire that way.

The CalJOBS registration tip is really useful, I had no idea they cross-reference that. Does it actually hurt you if your CalJOBS activity doesn't match what you report?

I've heard of people getting flagged for it during audits but honestly I don't know how often it happens in practice. Better safe than sorry, just register and log your activities there too.
