California EDD unemployment appeal reversed - when do I actually get paid?
So I just got the decision letter in the mail yesterday and my California EDD appeal was reversed in my favor. I've been waiting on this for almost four months now and I'm honestly still in shock that it actually worked. The judge sided with me completely and said the original disqualification was not warranted based on the evidence I submitted. Here's my situation: I was laid off from my warehouse supervisor position back in February and California EDD initially disqualified me saying I had voluntarily left without good cause which was completely wrong. I filed my appeal immediately and went through the whole hearing process with the CUIAB (California Unemployment Insurance Appeals Board). The administrative law judge reversed the disqualification and now my claim should be eligible for all the weeks I was previously denied. But here's where I'm confused - nobody told me what happens NEXT. Like does the payment just automatically show up in my UI Online account? Do I need to certify for all those back weeks again? I have about 16 weeks of unpaid benefits that I should be getting now. Does California EDD automatically process the back payments or do I have to do something to trigger it? I've tried calling but can't get through to anyone. My UI Online account still shows the disqualification status and hasn't updated yet. The letter is dated 8 days ago. How long does this actually take and what do I need to do on my end to make sure I get paid?

Congrats on winning your appeal! That's not easy to do. To answer your question - when a California EDD appeal is reversed by CUIAB, the process for getting paid isn't instant unfortunately. EDD needs to receive the official order from the board first, then they have to manually update your claim record and process the back payments. Typically you're looking at 4-8 weeks from when the decision was issued before money actually hits your account. The key thing you need to do RIGHT NOW is make sure all your weekly certifications are filed for those weeks in question. If you stopped certifying during the appeal period thinking it didn't matter, you'll need to call EDD to get those weeks reopened.

AuthorI did keep certifying through the whole appeal process because someone on here told me to. So all 16 weeks should be in the system. But 4-8 MORE weeks of waiting after already waiting 4 months is brutal.

yeah you definitely did the right thing keeping up with certifications. a lot of people stop and then have to fight even harder to get those weeks back open

This is accurate. The CUIAB sends the remand order to EDD and then EDD processes it through their system. It does not happen overnight. I work adjacent to this industry and the 4-8 week estimate is pretty standard for straightforward reversals.

I went through this exact situation last year. Won my appeal after being wrongly disqualified for misconduct and had to wait about 6 weeks after the decision before I saw any money. The thing that tripped me up was that EDD had a question about one of my weeks of certification and they couldn't process the full back payment until I resolved it. I had NO idea because my UI Online account just sat there looking unchanged. Make sure you're checking your UI Online message inbox not just the main claim status page.

AuthorOh that's a good tip about the message inbox. I've only been watching the main status. Going to check that right now.

same happened to my cousin, they had a pending issue on like week 3 of her back payments and it held up everything. she had no idea for weeks

The UI Online inbox is seriously the most important thing to check and EDD barely tells anyone about it. I missed a notice in there once and it delayed my whole claim by almost a month.

After my appeal reversal I spent literally two weeks trying to get someone on the phone at EDD to find out the status of my back payments. Kept getting the busy signal or sitting on hold for over an hour and then getting disconnected. I was going out of my mind. Someone on a different thread mentioned Claimyr (claimyr.com) and I was skeptical but desperate. It basically gets you connected to an actual EDD rep without you having to sit on hold all day. There's a video showing how it works at https://youtu.be/JmuwXR7HA10 - within a day I was talking to an EDD agent who was able to tell me exactly where my reversed appeal payment was in the processing queue and what was holding it up. Turns out there was a small issue they needed to resolve and I would never have known without talking to someone.

AuthorI literally cannot get anyone on the phone. Going to look into this because I need answers and my UI Online account is just sitting there with the old disqualification showing.

I've heard of claimyr, does it actually work for post-appeal payment questions specifically? Like will the rep actually know about the CUIAB order and be able to look that up?

Sean Doyle
Yes - the EDD rep I spoke with was able to pull up my appeal decision record directly and tell me the exact processing stage my back payment was in. It's just a regular EDD phone rep but you actually get through to one.

ok so important clarification here because I see some confusion in threads like this all the time when CUIAB reverses a disqualification there are actually TWO separate things that have to happen: 1. EDD has to lift the disqualification on your record (this changes your claim status) 2. EDD has to process and issue the actual payments for each week These don't always happen at the same time. Your UI Online might update to show the disqualification removed before the payments are issued, OR you might get payments before the status visually updates (less common). Either way both steps have to complete. The timeline between receiving the CUIAB order and issuing payment is typically 3-6 weeks but I've seen it take longer when there's high claim volume or if your case gets flagged for any secondary review.

GalacticGuru
AuthorThis is really helpful, thank you. So I might see the disqualification status change first and then separately get notified about the back pay? Or does it all come at once?
0 coins
Nia Jackson
Usually the status change comes first then the payment processing follows. But EDD can sometimes issue a partial payment first too if some weeks are clear and one or two have questions attached. It varies.

I got a lump sum all at once when mine was reversed, everything came together. But that was about 2 years ago so things might process differently now

HOW LONG DID YOUR APPEAL TAKE?? I filed mine in November and still haven't had my hearing scheduled. Four months sounds fast to me honestly. I've been told I might wait another 3-4 months just to get a hearing date. This system is absolutely broken. Congrats on winning though seriously, gives me some hope.

GalacticGuru
AuthorMine took about 3.5 months from filing to decision. I was told timing varies a lot by region and the type of case. Good luck with yours, keep all your documentation organized.

3.5 months I would be thrilled with at this point. Did you have a phone hearing or in-person?

AuthorPhone hearing. It was actually less stressful than I expected. The judge was pretty straightforward and gave both sides time to present.

One more thing that's really important for your situation - when your back payments finally process, EDD will release them to whatever payment method you have set up (Bank of America debit card or direct deposit). If your debit card has expired or your bank account info changed during the appeal period, the payments could bounce back and create another delay. Worth double-checking your payment info in UI Online before the money is released.

GalacticGuru
AuthorGreat catch. My debit card actually expired in March. Just logged in and updated my payment info. Thank you!

This is such a common issue and people don't think about it. An expired card during a long appeal can add weeks of additional delay.

congrats on the reversal!! genuine question tho - did you have a lawyer or represent yourself at the hearing? I have mine coming up in like 6 weeks and I'm terrified

AuthorI represented myself! I gathered all my documentation - termination letter, emails with my supervisor, my performance reviews, anything that showed my side of the story. The judge was fair and actually read everything I submitted in advance.

There are legal aid organizations in California that help with unemployment appeals for free. Bay Area Legal Aid, Legal Aid Foundation of LA, and others depending on where you are. Worth looking up.

When my California EDD appeal reversal finally got processed last year I got a deposit for all my back weeks at once. It was a pretty significant amount. Then I realized I needed to figure out what to do about taxes because that lump sum put me in a weird spot for my estimated taxes. Just something to think about when you're planning - unemployment benefits are taxable income in California at the federal level (though California doesn't tax UI benefits at the state level).
0 coins
GalacticGuru
AuthorOh I hadn't even thought about taxes. Good thing you mentioned that. I was going to use all of it for rent arrears but I should probably set some aside.
0 coins
Chloe Anderson
This is accurate. Federal taxes apply to UI benefits. California doesn't tax them at the state level. If you didn't have withholding set up during your claim period you'll want to account for that federal portion.
0 coins
Carmen Lopez
Exactly - EDD will send you a 1099-G showing the total amount paid for the year. Worth checking if you need to adjust your withholding or set money aside.

Something nobody mentioned yet - after your appeal reversal processes, you should also start getting any remaining active weeks of benefits going forward if you're still within your benefit year and still eligible. The reversal doesn't just unlock the back weeks, it restores your full claim. So if you have remaining balance in your UI claim you should be able to continue certifying normally. Just make sure you keep up with your job search requirements (3 employer contacts per week in California) because those requirements don't pause just because you were in an appeal.
0 coins
GalacticGuru
AuthorI've been keeping up with job search activities the whole time, good. I actually started a temp job while waiting but it's part-time so I should still be eligible for partial benefits right?
0 coins
Andre Dupont
Yes! If you're working part-time you report those earnings when you certify. EDD will calculate a partial benefit based on your wages for that week. The formula is they subtract a portion of your earnings from your weekly benefit amount. You definitely want to keep reporting rather than skip certifying because you're working.
0 coins
Omar Fawaz
part time earnings reporting is really important to get right. report exactly what you earned not what you'll earn or what you were scheduled for. and it's gross wages before any deductions

I'm sorry but I just want to double-check something in this thread - when people say appeal reversal do they mean the FIRST level appeal at CUIAB or a further appeal? I got a letter saying my appeal was being forwarded to the CUIAB board panel for review and I'm trying to understand if there are multiple levels here
0 coins
Nia Jackson
Good question. The first level is a hearing before an Administrative Law Judge (ALJ) - that's usually what people mean by 'appeal.' The CUIAB board panel review is a second level that happens if either party (you or EDD) requests reconsideration of the ALJ decision. If you won at the ALJ level and EDD requested reconsideration, that's your case going to the board panel. If you lost at the ALJ level you can request reconsideration yourself.
0 coins
QuantumQuasar
so EDD might be appealing MY appeal win?? is that what's happening to me??
0 coins
Nia Jackson
It's possible. You should have gotten a notice explaining which party requested the board review and what's being reconsidered. Read it very carefully. If EDD is appealing your win you should consider responding formally to the board.
0 coins
Freya Pedersen
This is exactly why if you're going through reconsideration you really want to talk to someone - either legal aid or an EDD rep who can explain your specific situation. Don't just wait and hope.

does anyone know if back payments from a reversed appeal affect your total available benefit balance? Like I had a $7,800 max benefit amount when I filed and I've used some of it. Will the 16 back weeks come out of my remaining balance or is it treated differently
0 coins
Chloe Anderson
The back payments for the weeks covered by your reversed disqualification do come from your total benefit balance. They aren't added on top - they were always technically owed to you, they just weren't paid out. So yes, they'll reduce your remaining available balance. This is worth factoring in if you're still unemployed.
0 coins
Zoe Papanikolaou
that's what I was afraid of. so I might have less remaining than I thought. I need to look at my original award letter and do the math

To check your remaining balance you can log into UI Online and look at your claim details. It should show your maximum benefit amount and how much has been paid out once the back payments process.

I tried calling EDD about my own reversed appeal status for three straight days and never got through. A friend told me about Claimyr and I finally used it this week. Honestly it's the only way I've found to reliably reach an EDD agent. You go to claimyr.com and there's a demo video at https://youtu.be/JmuwXR7HA10 that explains how it works. The agent I got was helpful and confirmed my reversal was in the payment processing queue and gave me an estimated timeframe. Huge relief compared to just staring at UI Online wondering what's happening.

did the EDD rep you talked to have any information about the CUIAB order specifically or just general claim status?

genuine tip from someone who learned the hard way - print out and keep a physical copy of your CUIAB reversal decision letter and the envelope it came in showing the postmark date. If there are any disputes later about when EDD received the order or what it said, you want your own copy. I didn't keep mine and when there was a processing issue months later I had to request a copy from CUIAB which took additional time.

lol at California EDD making people wait months on end to get paid money they were already owed, then making them wait MORE after winning. The whole point of unemployment insurance is to keep people afloat while between jobs and they just... don't pay for months at a time. My rent doesn't pause while EDD takes its sweet time.

The system definitely has real problems but fwiw most reversal payments do eventually come through. Small comfort when you're drowning but it's not usually a situation where winning the appeal and then never getting paid happens

One thing I want to add - when you do finally get your back payment, log into UI Online immediately and verify the payment detail matches what you're expecting. Check each week that was paid and the amount. If there's a discrepancy you'll want to catch it early rather than after the funds are spent. I had a situation where EDD paid me for 14 of my 17 back weeks initially and I had to follow up on the remaining 3 weeks separately.
0 coins
GalacticGuru
AuthorThat's concerning that you got a partial payment and had to follow up separately. How did you do that - just call them?
0 coins
Mateo Hernandez
Yes I called and it turned out two of the missing weeks had a small earnings amount I had reported and they needed clarification on the calculation, and the third week had a technical system note on it. All resolved eventually but it required a phone call.

Chloe Anderson
This is why the phone contact thing is so important - UI Online is useful but it doesn't always show you the full picture of what's happening behind the scenes with individual weeks

I'm about three weeks post-reversal decision on my own appeal and still nothing. Reading this thread is both reassuring and making me more anxious. Has anyone had their back payment come through FASTER than 4 weeks? Like is there any chance I see this before the end of the month

Fastest I've personally heard of was about 3 weeks but that seems to be the exception not the rule. More commonly 5-7 weeks in my experience following these threads.

If you're at three weeks and your UI Online account has already updated to remove the disqualification, that's actually a good sign. It means the first processing step is done and payment should follow. If the disqualification is still showing, you might want to try to reach EDD to confirm they received the CUIAB order.

tagging onto this thread because I have a slightly different version of this question - I won my appeal but the judge's decision says 'remanded to EDD for further consideration on the earnings issue' - is that the same as a full reversal? Will I still get back pay?
0 coins
Nia Jackson
A remand is different from a straight reversal. In a remand, the judge is sending the case back to EDD to reconsider or gather more information rather than just saying 'EDD was wrong, pay this person.' It does not automatically trigger payment - EDD will review the remanded issue and make a new determination. You could still win payment from that process but there's another step involved.
0 coins
Luca Romano
oh no. so it's not guaranteed. I thought I had won...
0 coins
Nia Jackson
It's not a loss either though - a remand often comes out in the claimant's favor once EDD does the additional review. Watch your mail for a new determination from EDD on whatever issue was remanded. You'll have appeal rights on that determination too if you disagree.
0 coins
Andre Dupont
Remands are actually pretty common and many do result in payment. Stay on top of checking your mail and UI Online inbox for the new EDD determination on the remanded issue.

For everyone in this thread stressing about reaching EDD after a reversal - I had really good luck using Claimyr after my appeal situation. You can check it out at claimyr.com and see the demo at https://youtu.be/JmuwXR7HA10 - it handled the whole frustrating part of actually getting through to someone. Quick question for the thread - when EDD processes back pay from a reversed appeal, does it all come on one payment or do they break it up week by week? I'm trying to figure out what my bank statement will look like
0 coins
Diego Vargas
From what I've seen and experienced it often comes as a lump sum but can also come in multiple transactions. If you have a Bank of America EDD debit card you'll see it as one or more deposits. If you have direct deposit to your bank it may appear slightly differently. Either way it should be documented in your UI Online payment history.
0 coins
Aisha Khan
ok good to know, I'll just watch my bank account and UI Online simultaneously I guess

Mine came as a single transaction for the full back amount. But I've heard others got multiple deposits. Doesn't really matter how it comes as long as the total amount is right - that's why verifying against your expected weekly benefit amount times the number of weeks is important
