Back to California Unemployment

How do I know if I won my unemployment appeal with California EDD?

So I had my California EDD unemployment appeal hearing about two and a half weeks ago and I genuinely have no idea what happens next or how I'll find out if I won. The whole situation started because I got disqualified after my former employer contested my claim saying I quit voluntarily, which is completely false - I was laid off when they eliminated my entire department. I filed the appeal within the 30-day window, submitted all my documentation (emails proving the layoff, my separation notice, everything), and did the phone hearing with the administrative law judge. The judge seemed to listen to both sides and asked me some follow-up questions. At the end she just said the decision would be mailed. That was it. No indication of which way it went, no timeline given. My UI Online account still shows the original disqualification and I haven't received any payment. Does anyone know how long it takes to get the appeal decision letter? And if I win, does California EDD automatically release all my back payments or do I have to do something? I've been living off savings for almost two months now and I'm getting really stressed about this whole thing.

The appeal decision letter typically comes within 2-4 weeks after the hearing date. It gets mailed to the address on file with California EDD so make sure that's current. Once you get the decision, if you won, EDD is supposed to release your held payments automatically but in practice it can take another 1-3 weeks after they receive the decision from the CUIAB (California Unemployment Insurance Appeals Board). Keep filing your weekly certifications the entire time you're waiting - this is super important. If you stopped filing because you assumed you were disqualified, you'll have issues collecting back pay for those weeks even if you win the appeal.

0 coins

I did keep filing my weekly certifications, thank god someone told me to do that early on. But I had no idea it could take another 3 weeks AFTER winning just to get paid. That's brutal honestly.

0 coins

yep the CUIAB and EDD don't exactly communicate instantly lol, there's always a lag between when the decision is issued and when it shows up in EDD's system

0 coins

This is accurate. The CUIAB mails the decision simultaneously to both you and EDD but EDD still has to process it on their end and lift the disqualification flag on your account before any payments can go through. The timeline varies but 2-3 weeks post-decision is normal.

0 coins

Went through almost the exact same thing last year. My employer lied and said I was fired for misconduct when really the whole team got restructured. Won the appeal but the waiting was absolutely awful. One thing to know - the decision letter will be very formal and clearly state either 'the decision of the Department is reversed' (you won) or 'the decision of the Department is affirmed' (you lost). No ambiguity in the language. You'll know immediately when you read it.

0 coins

That's actually really helpful to know what language to look for. I keep imagining getting this vague letter that I can't interpret lol

0 coins

same happened to me except I lost mine and had to file a second level appeal to the CUIAB board itself, not just an ALJ hearing. the process just keeps going unfortunately

0 coins

@above - yeah the second level appeal is a whole different process. Hopefully OP won't need that but it is an option if the ALJ decision goes against you.

0 coins

While you're waiting, the absolute hardest part is not being able to get anyone at California EDD on the phone to even confirm they received the hearing decision or check on the status. I was in appeals limbo for 6 weeks and couldn't get through to a live agent no matter what I tried. Someone in another thread mentioned a service called Claimyr that basically gets you through to an actual EDD rep without spending hours redialing. I finally used it and got connected in under 30 minutes. You can check it out at claimyr.com - there's also a video showing how it works at https://youtu.be/JmuwXR7HA10. After my appeal won I used it to confirm EDD had the decision and ask when my back payments would process.

0 coins

Wait this actually works? I've been calling EDD for weeks and keep hitting the 'we cannot take your call at this time' message. Going to look into this right now.

0 coins

claimyr worked for me too when I was dealing with adjudication on my initial claim. Got through to someone who actually had notes on my account and could tell me exactly where things stood.

0 coins

I was skeptical about stuff like this but honestly the EDD phone system is so broken that any workaround is worth trying at this point

0 coins

Few things worth clarifying here since some people get confused about the appeals process. When you had your hearing, you were before an Administrative Law Judge (ALJ) at the CUIAB - that's the first level of appeal. The ALJ's written decision is what gets mailed to you. If you disagree with it (either party can appeal further), the next step is a petition to the CUIAB board of commissioners for a second level review. If you still disagree after that, you can appeal to superior court. But most cases resolve at the ALJ level. Based on what you described - documented layoff, separation paperwork, employer claiming voluntary quit - that sounds like a strong case. The burden of proof shifts to the employer in those situations.

0 coins

So the employer also receives the same decision letter? I didn't realize they'd be notified at the same time I am.

0 coins

Yes, all parties including EDD, you, and your former employer receive the decision simultaneously. The employer then has the same window you do to appeal if they want to contest an ALJ decision in your favor.

0 coins

Ugh I didn't know employers could appeal if you WIN. That seems so unfair. How often does that happen?

0 coins

It does happen, usually larger companies with HR departments that fight every claim. Smaller employers rarely bother with second level appeals. But even if they do, you'd still receive any back pay owed to you while that appeal is pending in most circumstances.

0 coins

oh god im in a similar situation and this thread is making me panic more lol. my hearing was 5 weeks ago and i still havent gotten anything. is 5 weeks too long? should i be worried something got lost??

0 coins

Five weeks is getting into the longer end of the range but not unheard of, especially if the ALJ had a complex caseload. I'd call CUIAB directly (not EDD) to check on the status - the number is on your original appeal acknowledgment letter.

0 coins

omg i didnt know i could call CUIAB directly!! i've only been trying to reach EDD this whole time. thank you so much

0 coins

Yes CUIAB and EDD are separate agencies with separate phone lines. A lot of people don't realize this. For the hearing decision status, CUIAB is who you want.

0 coins

Can I jump in with a related question? I won my appeal about 3 weeks ago but my UI Online still shows 'disqualified' and I haven't received back pay. I've been trying to call EDD daily and can't get through. How long did it actually take for people's accounts to update after winning?

0 coins

Three weeks post-decision and nothing updated yet is worth following up on. EDD should have processed it by now. This is exactly when you need to actually reach a live agent.

0 coins

I'd use Claimyr for this honestly - claimyr.com - this is exactly the situation it's designed for. You won your appeal and now you need a real person at EDD to manually push the processing. Getting through the phone queue on your own when there's a specific account action needed is extremely frustrating without some kind of help.

0 coins

I'll try that, honestly at this point I'll try anything. Three weeks of calling and getting nowhere is exhausting.

0 coins

Once you reach an EDD rep, specifically ask them to 'process the CUIAB decision' on your claim and give them the decision date. That phrasing helps them understand exactly what action needs to happen.

0 coins

CALIFORNAI EDD IS AN ABSOLUTE NIGHTMARE I had to fight for 4 MONTHS to get my back pay after winning an appeal. They kept saying they were 'processing' it every single time I called. Finally got a supervisor involved and suddenly it was done in two days. ALWAYS ask for a supervisor if you're getting the runaround, regular agents sometimes have limited ability to actually trigger payment release.

0 coins

This is terrifying but also useful to know about asking for a supervisor specifically. Thank you.

0 coins

supervisors really do have more system access, this is legit advice

0 coins

I'm not even exaggerating when I say I called 47 times before I got through to someone who could actually help. The system is completely broken.

0 coins

Since you mentioned the employer contested by claiming voluntary quit - this is one of the most common EDD disqualification scenarios and also one where claimants frequently win on appeal when they have documentation. The key legal standard is whether leaving was truly voluntary and without good cause. Since you have a documented layoff notice and emails showing department elimination, the ALJ would have to ignore the evidence to rule against you. Your situation sounds similar to several successful appeals I've read about in this forum. The documented paper trail is really what determines these cases.

0 coins

I submitted about 15 pages of documentation - the formal layoff notice, an email from HR about the department restructure, and messages from my manager confirming my last day. Felt like overkill but I guess more is better.

0 coins

That's exactly the right approach. 'Voluntary quit' disputes almost always come down to whether the separation was truly the employee's choice. You had multiple forms of documentation contradicting the employer's claim. That's a strong position to be in.

0 coins

Wish I had done more documentation for mine. I won but barely, the ALJ said my evidence was thin even though I knew I was laid off.

0 coins

just here to say keep filing weekly certifications no matter what!! I made the mistake of stopping when I got disqualified because I thought there was no point and then even when I won my appeal I couldn't get back pay for the weeks I didn't certify. Lost like $2,400 that I would have gotten if I'd kept filing. Don't make my mistake

0 coins

Already confirmed I've been filing every week, but this is such important advice. I would have made this exact mistake if someone hadn't told me early on.

0 coins

wait does this mean you can certify even when you're disqualified?? I stopped filing two weeks ago because I thought it was pointless

0 coins

YES you should absolutely keep filing even during disqualification or adjudication holds. Filing preserves your eligibility for those weeks if the status changes. Call EDD and ask about late certifications for those two weeks you missed, you might still be able to file them.

0 coins

To confirm - certification deadlines can sometimes be extended if there's an active appeal or adjudication. Definitely try to file those missed weeks as soon as possible and explain the situation if asked.

0 coins

how do you even know if the address EDD has is current? I moved a few months ago and I'm suddenly scared the decision letter is going to someone else's house

0 coins

Log into UI Online and check your profile/personal information section - you can update your mailing address there. You should also be able to see what address is currently on file. If you just moved and the decision was mailed to your old address, contact both CUIAB and EDD immediately to update your address and request the decision be re-sent.

0 coins

just checked and its wrong!! updating right now omg thank you for this

0 coins

Also worth noting - CUIAB decisions are sometimes available through their portal too, not just mail. Check if you have online access through the appeals portal with your case number.

0 coins

Something nobody mentioned yet - if you win the appeal and your disqualification gets reversed, EDD will release payments for all the weeks you certified MINUS any weeks they determine you weren't meeting the job search requirements during the disqualification period. Make sure your job search activity logs are solid for those weeks. You need 3 employer contacts per week in California and they can theoretically audit this even retroactively.

0 coins

Oh wow I didn't think about them checking job search activities for the back pay period. I did keep records but they're definitely not as detailed as I'd keep them now knowing this.

0 coins

Wait they can deny back pay even after you win the appeal if your job search records aren't good enough?? That seems like a double punishment

0 coins

It's technically separate - the appeal is about the disqualification reason, but continued eligibility requirements (able/available, actively seeking work, job search contacts) apply to every week regardless. In practice EDD rarely audits job search for appeal back pay periods but it's possible.

0 coins

This is accurate but I want to add some reassurance - audits of job search during appeal back pay periods are uncommon unless there's a specific reason for EDD to flag those weeks. Keep your records anyway, but don't lose sleep over it.

0 coins

honestly the most frustrating thing about the whole appeals process is that you do everything right - file on time, submit documents, show up to the hearing - and then you just... wait. in silence. with no updates. while your bills pile up. there should be a way to at least see the status of the hearing decision online but nope, nothing

0 coins

This is exactly where I am. I feel like I did everything I was supposed to do and now I'm just completely in the dark.

0 coins

same boat last year, it genuinely tests your patience. hopefully you hear something soon

0 coins

the lack of any online status tracking for appeals is INSANE. this is 2025 and you're telling me I have to wait for a physical letter? come on

0 coins

Something that helped me mentally during the wait was remembering that the ALJ makes their decision DURING the hearing in most cases but takes time to write the formal decision. The questions the judge asked you and the way the hearing concluded are sometimes indicators. Did the ALJ ask your employer's representative to justify their claim of voluntary quit? Did they seem skeptical of anything? Not a guarantee but sometimes you can read the room a bit.

0 coins

The ALJ definitely pushed back on my former employer's rep a few times - asked for specific documentation they couldn't provide. I'm trying not to read too much into it but it did seem like the employer's story had some holes.

0 coins

That's actually a really good sign in my experience. When ALJs press the employer side for documentation they can't produce, it usually means the employer's narrative isn't holding up. Still not a guarantee but sounds promising.

0 coins

I had a similar hearing and the ALJ was noticeably frustrated with my employer's inconsistent answers. I won. Cautious optimism seems warranted based on what OP described.

0 coins

For anyone else in this thread dealing with EDD contact issues during appeals - I want to reiterate the Claimyr recommendation from earlier. After winning my appeal I used it specifically to follow up on back payment processing and it made a huge difference. The rep I spoke to was able to see the CUIAB decision in their system and confirmed it was being processed. Just having that confirmation after weeks of silence was worth it. Site is claimyr.com and the walkthrough video is at https://youtu.be/JmuwXR7HA10 if you want to see how it works before trying it.

0 coins

just watched the video, seems pretty straightforward. going to try it tomorrow morning since thats supposedly a better time to call EDD anyway

0 coins

I ended up using this yesterday after my comment above and actually got through to EDD. Rep confirmed they have the decision and it's being processed, should see payment in about a week. Such a relief after 3 weeks of silence.

0 coins

Really glad this worked for you, I'll probably use this too once I get the actual decision letter and need to follow up on payment processing.

0 coins

One more important thing to add: if the ALJ rules AGAINST you, your appeal decision letter will include information about your right to petition the CUIAB board for review. That petition has to be filed within 20 days of the mailing date on the decision letter, not the date you receive it - so if your mail is slow, that's a tight window. Read the decision letter immediately when it arrives and note the mailing date vs. the date you received it. If you need to appeal further, start that process immediately. Don't wait.

0 coins

20 days from the MAILING date, not when I receive it? That's a really important distinction. What if I don't receive it until like day 15?

0 coins

Unfortunately yes, the 20-day window starts from the mailing date printed on the letter. If mail delays eat into that window, you can sometimes request a late filing for good cause (document that you received it late), but it's not guaranteed. That's why keeping your address current with both EDD and CUIAB is critical.

0 coins

This is also why checking the CUIAB online portal for your case status is smart - you might be able to see the decision was issued before the physical letter arrives, giving you more time.

0 coins

Does anyone know if you're supposed to tell EDD you had your hearing? Like do they already know or do I need to report it somehow? I had mine last week and now I'm confused about whether I'm supposed to do something proactively

0 coins

CUIAB and EDD share information on appeal decisions automatically - you don't need to notify EDD that you had a hearing. EDD is actually a party to your appeal so they already have your case information. You just wait for the decision and then EDD will receive it directly from CUIAB.

0 coins

oh that's a relief, I was worried I was supposed to be doing something and missing a step

0 coins

Your only job at this point is to keep filing your weekly certifications and wait for the decision. If several weeks pass with no letter, then proactively following up with CUIAB makes sense.

0 coins

Jumping in because I got my appeal decision letter last month and want to give some practical advice for when OP gets theirs. Read the whole thing even if it feels overwhelming. There will be a 'findings of fact' section, a 'reasoning' section, and then the actual decision. The decision section at the very end is the bottom line - everything before that is the ALJ explaining their reasoning. Some people read the findings section and panic before they get to the actual ruling.

0 coins

This is really practical advice, thank you. I would absolutely read the first section in a panic and assume the worst before getting to the actual decision.

0 coins

The findings of fact section sometimes describes the employer's version of events first before presenting your version and then the decision. A lot of people stop reading when they see 'employer states employee voluntarily resigned' without realizing the ALJ is about to explain why they're rejecting that claim.

0 coins

Really good point. The letter format can be confusing. The last paragraph before the signature is almost always where the actual ruling is.

0 coins

update from me - just updated my address in UI Online and also found the CUIAB case portal thing someone mentioned. I can see my case status shows 'decision issued' and the date from four days ago. So the letter is on its way. feeling a mix of terrified and relieved to know it's coming

0 coins

good luck!! fingers crossed for you

0 coins

That's actually a great outcome from updating your address - at least you know the decision exists and is in transit. Make note of the date shown in the portal since that's your mailing date for any appeal deadline purposes.

0 coins

oh good point about noting the decision date for appeal purposes. just screenshotted it just in case

0 coins

final update from me too - called CUIAB directly like someone suggested and found out my decision was mailed 10 days ago. Should be here any day. The CUIAB person was actually really helpful and told me the case number I should reference if I need to follow up with EDD after. Way better experience than trying to reach EDD directly

0 coins

Glad you got some clarity! CUIAB is genuinely easier to reach than EDD in my experience

0 coins

Good luck to both of us! Feels like this thread has been weirdly helpful for my anxiety about this whole process.

0 coins

Rooting for good outcomes for everyone in this thread. And if you win and EDD drags their feet on releasing the back pay, remember you can reach an EDD rep through Claimyr (claimyr.com) to follow up directly. Don't let them slow-walk your money after you fought for it.
