EDD pending payment after reporting car vandalism - will it affect my claim?

I'm stressing out big time about my recent certification. I certified for the past two weeks on Sunday, and they already approved and paid one week, but the second week is still showing 'pending'. Here's what happened: during that second week, I had to turn down work for one day because my car got vandalized overnight and was in the shop getting fixed. I couldn't get to the jobsite (I'm in construction) since it's 30 miles away and no public transit options. I honestly reported this on my certification and explained that I was unable to accept work JUST for that one day. I was back to accepting assignments the very next day once my brother loaned me his car until mine was fixed. Now I'm wondering if reporting that one missed day is what's causing the pending status? Has anyone dealt with something similar? How long should I expect to be stuck in pending? Will they disqualify the whole week because of one day? I really need this payment to cover my rent next week.

Yes, they approved it after the interview. They asked a lot of questions about the funeral (whose it was, where it was held, etc.) but didn't actually ask for documentation. The whole thing felt invasive and unnecessary for a single day. The EDD rep even seemed embarrassed about having to ask all those questions.

I work as an employment consultant, and I can tell you that while the system seems punitive, it's actually designed to prevent fraud. The problem is that it often catches honest people in its net. For a single day of unavailability due to car vandalism, you absolutely have good cause, and any reasonable EDD representative will approve your payment. My advice is to call tomorrow with your documentation ready, but also prepare for the possibility of waiting for an interview. If you can't get through or get your payment released tomorrow, consider filing for a hardship advance on your pending payment by explaining your rent situation. Not many people know about this option, but EDD can sometimes issue partial payments while waiting for eligibility interviews in hardship cases.

UPDATE: I finally got through to EDD this morning after 23 calls! Spoke with a very helpful Tier 2 specialist who reviewed my situation. She said the car vandalism absolutely counts as good cause for being unavailable that one day, especially since I had the police report. She released my payment right then! It should hit my account within 24-48 hours. So relieved! Thanks everyone for your help and advice!

That's awesome! So glad you got it resolved quickly! 23 calls isn't bad - it took me over 40 last time 馃槄

Can I get EDD benefits if fired for performance while on FMLA for mental health?

I've been working at my current company for 4 years as a customer service rep, but the last few months my performance metrics have been dropping significantly. I'm currently on FMLA for anxiety and depression (still working though), and my QA scores keep falling below target. My supervisor had a 'final warning' meeting with me yesterday, and I'm pretty sure I'll be terminated by the end of the week. I'm in treatment, but my mental health has seriously impacted my ability to meet the company's expectations. If they fire me for not meeting performance goals while I'm technically on FMLA, would I qualify for unemployment benefits? I've never been on unemployment before, and I'm worried about how I'll pay rent next month if I lose my job.

Sorry to hear about the termination, but you've done the right thing by applying right away. The 'pending' status and phone interview are normal parts of the process when there's a job separation that needs clarification. Make sure you continue to certify for benefits every two weeks even while waiting for the interview and decision. Good luck with everything, and definitely update us on how it goes!

Thank you! I'll definitely certify on schedule. Do you know how long it typically takes for them to schedule the phone interview?

0 coins

The interview scheduling depends on their current backlog, but typically you'll receive a notice in the mail with the date and time about 7-10 days before the interview. Currently, interviews are being scheduled about 2-3 weeks out. Just make sure you're available at the phone number you provided on your application during the scheduled time window, and have all your documentation ready.

Great, I'll keep an eye out for the interview notice. Thanks again for all your help - this community has been incredibly supportive.

Need to resolve EDD eligibility interview hold ASAP - can't wait until March 1st appointment

So the EDD finally scheduled my eligibility interview for March 1st, but I'm completely broke and my rent is due next week!!! I reported some part-time work from my side gig during my last certification and boom - payment pending. Can't believe they're making me wait 3+ weeks for this interview. Has anyone had success calling EDD directly to get the interview done sooner? Will they ask the same questions over the phone that they would during the scheduled interview? I'm desperate and can't wait until March to get paid. Bills piling up and already maxed out my credit cards. Any advice would be super appreciated!

DOES ANYONE ELSE THINK IT'S COMPLETELY INSANE that the EDD can just hold our money hostage for WEEKS while they take their sweet time scheduling these interviews??? Some bureaucrat decided March 1st was a good day for them without any consideration that we have BILLS TO PAY and FAMILIES TO FEED! This happens to literally EVERYONE who reports ANY work income. The system is designed to punish people for trying to work part-time while looking for full-time employment. I've been through 3 of these interviews in the past year, and each time it's the same ridiculous process. They ask basic questions they ALREADY HAVE THE ANSWERS TO, then magically release your funds a few days later. The whole thing could be handled with an automated form instead of making people wait weeks without income.

preach!! happened to me TWICE last year

I couldn't agree more! It's absolutely maddening that they make us jump through all these hoops while bills pile up. I understand they need to prevent fraud, but making people wait 3+ weeks for a 10-minute conversation is just cruel.

Based on everything shared here, your best immediate steps are: 1. Call EDD first thing tomorrow (8:00am) and specifically request an expedited interview due to financial hardship. Have your documentation ready. 2. If that doesn't work, reach out to your state assembly member's office the same day. They can often work wonders with EDD cases. 3. In the meantime, check if you qualify for emergency assistance through local community organizations. Many counties have emergency rental assistance and utility payment programs. 4. Continue certifying on your regular schedule regardless of the pending payment. I hope you're able to get this resolved quickly. The waiting period is definitely one of the most challenging aspects of the unemployment system.

Thank you so much for this clear action plan! I'm going to try calling right at 8am tomorrow. If that doesn't work, I'll contact my assembly member immediately after. Really appreciate everyone's help and suggestions!

Can I get EDD benefits if I quit my retail job due to unsafe conditions?

So I quit my retail job last week after 8 months because the store manager kept scheduling me to close alone in a high-crime area, and we had THREE robberies in the past 2 months! I told my manager multiple times I didn't feel safe, especially after getting threatened by a customer, but nothing changed. I'm wondering if I can file for unemployment even though I technically quit? I've heard something about "good cause" for quitting, but I'm not sure if safety concerns qualify. Has anyone successfully gotten EDD benefits after quitting for safety reasons? Really need some advice because rent is due in 3 weeks and I've applied to 12 places with zero callbacks.

UPDATE: I just applied online and got my confirmation number! The application asked for details about why I quit, and I made sure to focus on the safety concerns and the robbery incidents. My eligibility phone interview is scheduled for May 18th (about 3 weeks from now). I've started gathering all my documentation - found the text messages to my manager, the police report numbers, and even a coworker who's willing to provide a statement if needed. Feeling a bit more hopeful now, but still nervous about the interview. Thank you all for the advice!

Great job! Sounds like you're doing everything right. For the interview, I recommend writing down all your key points and dates beforehand so you don't forget anything important when you're nervous. Also, make sure you're in a quiet place with good phone reception for the call - they'll only try once at the scheduled time. Good luck!

my friend quit her nursing job bcuz they kept making her work double shifts without breaks which is dangerous for patients and she got approved for benefits. so yeah safety stuff counts for sure. but she had like emails and stuff proving she complained about it before quitting.

This is a good example of how health and safety concerns can qualify as good cause. The key element here was documentation that she tried to resolve the issue before quitting - exactly what EDD looks for in these cases.

EDD benefits while fighting for final paycheck - employer withholding until next month!

I just got laid off from my healthcare admin position last Thursday with no warning. When I went to pick up my final paycheck today, the payroll manager told me I won't receive it until the next regular pay cycle on September 15th (almost 4 weeks away!). I thought California law requires employers to pay terminated employees their final wages immediately at termination? This can't be legal, right? I've already filed for unemployment and have my phone interview scheduled next week, but I'm seriously stressed about making rent next month without this final check (it's about $2,300 with my unused vacation time). The HR person just shrugged when I mentioned the labor code and said "that's our policy." Has anyone dealt with this before? Should I mention this issue during my EDD interview? I'm worried that fighting for my paycheck might somehow impact my unemployment claim. Any advice on handling both situations would be super helpful!

i wonder if they wer suposed to give u unepployment pamflet too when they fired u. my company always gives them out when people leave. might b another violation??

Yes, California employers are required to provide the "For Your Benefit" pamphlet (DE 2320) to all employees who are laid off, discharged, or placed on leave of absence. If OP didn't receive this, it's another violation, though a much less serious one than failing to provide the final paycheck immediately.

One more thing to consider - while you're fighting for your final paycheck, make sure you're diligent about your EDD claim requirements. Remember to: 1. Complete your bi-weekly certifications on time 2. Register for CalJOBS if required 3. Keep records of your work search activities 4. Be available for the phone interview Missing any of these steps could delay your benefits. I've seen people get so focused on wage claims that they miss certification deadlines and create new problems for themselves.

Thank you for the reminder! I did create my UI Online account yesterday and am waiting for my first certification date. I've already started applying for jobs so I'll make sure to keep track of those for my work search requirements. I definitely don't want to mess up my UI benefits while fighting this paycheck battle.
