Can EDD disqualify me if I keep leaving work early for childcare issues?

I started a new job 3 weeks ago after being on unemployment for 4 months. The problem is my childcare situation is really unstable right now. My regular babysitter quit unexpectedly and I've had to leave work early 6 times already because the temporary sitter cancels last-minute. My supervisor gave me a verbal warning yesterday saying this violates their attendance policy. I'm worried if I get fired, EDD will say I was terminated for misconduct and deny my claim. Does anyone know if California has protections for parents in this situation? Or would EDD consider this misconduct since it's in the company handbook that employees can't leave early without 24hr notice? I'm a single parent and really need this job but also can't leave my 7-year-old alone.

just wanted to say i feel u so much on this. being a single parent is SO HARD and employers act like we can just magicly make childcare appear out of nowere. hang in there!!! ur doing the best u can!!

Thank you everyone for all the advice and support! I'm going to: 1) Document everything about my childcare search efforts, 2) Talk to my supervisor about flexible scheduling options, 3) Look into the Family-School Partnership Act protections, and 4) Create a backup childcare plan to propose to my employer. I really appreciate all your help - it's been so stressful trying to balance everything as a single parent. I'll update if anything changes with my situation.

Can my son get EDD benefits after quitting for full-time lineman apprenticeship 4 hours away?

My son just quit his job to start a 4-month full-time lineman apprenticeship program located 4 hours away from home. He had his EDD phone interview today and they said he'd get a determination letter in 5-7 days. I'm really worried because he quit his previous position, but he had to relocate for this specialized training program. Does anyone know if EDD considers this a valid reason to quit? He's also a union member but put his membership on hold during training (they don't pay during schooling). The interviewer asked specifically about the relocation for the apprenticeship program - does this help his case at all? Really anxious about this since his rent is due next week and the program doesn't leave time for part-time work.

Based on all the information shared, I think your son has about a 50/50 chance of approval. The relocation factor combined with a state-approved apprenticeship program gives him a reasonable argument for good cause. If he does get denied, he should immediately file an appeal and request a hearing. In the appeal, focus on: 1. The necessity of the relocation (impossible to commute 4 hours each way) 2. The career advancement opportunity the apprenticeship represents 3. The connection to his existing union membership Many initial denials get overturned on appeal when all the facts are properly presented. Just make sure he continues certifying for benefits every two weeks while waiting for the appeal outcome.

Thank you for the realistic assessment. I'll prepare him for either outcome. If he does need to appeal, how long does that process typically take? His savings won't last more than a month.

One more important thing to note: If he does receive a denial, he only has 30 days from the mailing date of the determination to file an appeal. The appeal deadline is strict and rarely extended, so mark the calendar and don't miss it. Regarding timeline: Unfortunately, appeals are currently taking about 3-4 months to be scheduled for a hearing. If he's facing financial hardship, he should include that information in his appeal request and ask for an expedited hearing. It doesn't always work, but sometimes they'll prioritize cases with severe financial impact. In the meantime, he should look into emergency assistance programs in his new location - many counties have short-term aid available for people waiting for unemployment appeals.

3-4 months?! That's terrifying. I'll definitely look into emergency assistance programs for him. This whole situation is so stressful. I wish EDD had clearer guidelines about training programs.

SDI benefits delayed after returning to work - no payment since December 2024

I'm so frustrated with how slow SDI payments have been. I was out on medical leave but returned to work on January 17th (second week back now). My doctor submitted all the required medical forms back in early December. I've yet to receive ANY benefit payments for the period from 12/05/24 to 01/03/2025. My online account shows they received my claim and I already got the notice about the 7-day waiting period being applied. It's been over six weeks since my doctor submitted everything! My rent is due next week and I'm seriously stressed about making ends meet. Has anyone else experienced such long delays with SDI payments? What's the normal timeframe I should expect? I've tried calling but just get the "we're experiencing high call volume" message every single time.

My sister had a baby in December and had a similar issue with her Paid Family Leave (which is processed through the same SDI system). What fixed it for her was having her employer contact EDD directly to confirm her leave dates. Sometimes employers don't respond to EDD's verification requests which can hold up the whole process. Might be worth asking your HR department if they received any verification requests from EDD that they haven't responded to yet.

That's a great idea I hadn't thought of. I'll talk to HR tomorrow and see if they've gotten any requests from EDD. My company is pretty large so it's possible something got lost in their system.

Update us if you get this resolved! I'm curious if any of these suggestions help speed things up. And if you do call using that service someone mentioned, let us know if that works. SDI delays seem to be getting worse every year.

Will do! I'm going to try calling with Claimyr tomorrow and also check with my HR department. I'll update here once I know something. Thanks everyone for all the advice and support - feeling less alone in this frustrating situation!

EDD phone nightmare - max callers message but need urgent disability extension help

Been trying to reach EDD for 3 days straight about extending my disability claim that's about to expire next week. Every single time I call, I either get the 'we're experiencing higher than normal call volume' message or that one about 'maximum callers in queue' before it hangs up on me. I've tried calling at different hours (super early at 8:01am, midday, right before closing) but keep hitting the same wall. My doctor already submitted the medical extension paperwork, but nothing's showing up in my online account and my payments will stop if I don't get this sorted ASAP. Anyone found a reliable way to actually speak to a human being at EDD lately? This is so frustrating and my rent is due on the 1st!

I work as an employment counselor, and one thing many people don't realize is that SDI extension requests have very specific timing requirements. If you're within 7 days of your claim expiring, you actually qualify for expedited processing. When you do reach an agent (using any of the methods suggested here), be sure to specifically mention "I need expedited processing for my SDI extension as my claim expires in less than 7 days." This specific phrasing flags your account in their system. Also important to note: even if your payments temporarily stop while this gets sorted out, they will be backdated once the extension is approved, so you won't lose any benefits you're entitled to. It might cause short-term cash flow issues, but you will eventually receive all payments.

Thank you so much for this insider info! I had no idea about the expedited processing option. That makes me feel a bit better knowing payments would be backdated if there's a gap, although I'm still going to do everything possible to prevent that since my landlord isn't exactly flexible with late rent.

my frend said if u call and press 0 over and over it gets u 2 a person faster but idk if thats true lol

That actually doesn't work with the EDD system - pressing 0 repeatedly will usually just disconnect you. Their phone tree requires specific menu selections to route you properly. The method I shared above has been consistently more reliable.

EDD overpayment appeal denied because I missed interview call - Can Assemblymember help?

I'm in a total panic mode right now. I got hit with a $7,800 EDD overpayment notice back in January, immediately filed an appeal, and finally got scheduled for a phone interview last week. The problem? My 2-year-old knocked my phone into the toilet literally 20 minutes before the call (not making this up). By the time I got to my neighbor's house to use their phone, I had already missed the call by 15 minutes. I called EDD back immediately but kept getting the "we're experiencing high call volume" message. Yesterday I got the decision letter saying my appeal was DENIED because I "failed to appear for the scheduled interview." Now I'm supposed to pay back all that money plus a 30% penalty because of my toddler's phone fascination?? Has anyone successfully gotten help from their Assemblymember or State Senator with this kind of situation? I've heard they can sometimes intervene when EDD is being unreasonable. I live in Sacramento area if that helps. Any advice would be so appreciated - I'm a single parent and there's absolutely no way I can afford this.

Wait I'm confused about something - are you appealing an overpayment determination or a disqualification? Because those are handled differently. If it's an overpayment determination and you missed the interview, that's one thing. But if it's a disqualification and you missed the eligibility interview, that's totally different and they might be more willing to reschedule. The EDD systems are SO CONFUSING and they do this on purpose!

It's definitely an overpayment determination. They're saying I wasn't eligible for some weeks I received payment for last year, so now they want all that money back plus the penalty. Sorry if I wasn't clear!

Ugh that's the harder one to fight but still worth trying with the Assemblymember! The whole system is rigged I swear.

I had a problem with my certification and couldn't get through to anyone at EDD for weeks. My son told me to contact my assemblyman and they fixed everything in like 4 days! I was shocked how fast it was. The nice lady from their office even called me personally to tell me it was resolved. I think her name was Jennifer. Wish I had known about this years ago.
