What to say to get Washington ESD unemployment when you quit
I had to quit my job at a warehouse because my supervisor was creating a hostile work environment and making racist comments. I documented everything but HR wouldn't do anything about it. Now I need to file for unemployment but I'm worried Washington ESD will deny me since I quit voluntarily. What should I say on my application to explain the situation? I really need these benefits while I look for another job.

You need to be completely honest about why you quit. Washington ESD allows unemployment for 'good cause' quits, which includes hostile work environment and discrimination. Make sure you have documentation of the incidents and that you tried to resolve it through proper channels first.

•I kept screenshots of some texts and emails. Should I upload those when I file my claim?

•Yes, definitely include any documentation you have. The more evidence you can provide, the better your case will be during adjudication.

The key is proving you had 'good cause' under RCW 50.20.050. Document everything - the incidents, your attempts to resolve them, any witnesses. Washington ESD will review whether a reasonable person would have quit under those circumstances. If you have trouble reaching them by phone during the adjudication process, I found claimyr.com really helpful for getting through to speak with an actual agent. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Thanks, I'll check that out. The phone lines are always busy when I try to call.

•Is that service legit? Sounds too good to be true.

•It worked for me when I needed to check on my adjudication status. Much better than spending hours on hold.

DON'T LIE ON YOUR APPLICATION! They will find out and you'll be in worse trouble. Be honest about quitting but explain the circumstances clearly. Include dates, names of witnesses, and any steps you took to address the problem before quitting.

•I wasn't planning to lie, just wasn't sure how detailed to be in the application.

•Be as detailed as possible. I learned this the hard way when my first claim got denied for not providing enough information.

Washington ESD has specific criteria for voluntary quit claims. You'll need to show that you made reasonable efforts to preserve your employment before quitting. This includes reporting harassment to HR, requesting transfers, or other remedial actions.

•I did report it to HR multiple times but they said there wasn't enough evidence.

•That actually helps your case. Document those HR interactions and include them in your claim.

•What if HR never responded to complaints? I emailed them three times and got radio silence.

•Print those emails showing you tried to resolve it internally. That demonstrates good faith effort.

•That's not very encouraging...

•Don't listen to negativity. If you have legitimate good cause, Washington ESD will approve your claim.

My friend quit for similar reasons and got approved. The trick is being very specific about how the work environment affected your ability to do your job safely. Use phrases like 'constructive discharge' if applicable.

•What does constructive discharge mean exactly?

•It's when working conditions become so intolerable that a reasonable person would feel they have no choice but to quit.

•That sounds like exactly what happened to you OP based on your description.

When you file your claim, there's a section where you explain why you're no longer working. Be truthful and thorough. Mention specific incidents with dates if possible. Washington ESD takes discrimination and harassment seriously.

•Should I mention that other coworkers witnessed some of the incidents?

Ev Luca
•Absolutely. Witness statements can really strengthen your case during the adjudication process.

I used claimyr when I was dealing with my quit claim adjudication and it saved me so much time. The Washington ESD phone system is a nightmare but claimyr got me through to someone who could actually help explain what additional documentation I needed.

•It's worth it compared to spending days trying to get through on your own. Check their website for current info.

Whatever you do, don't just say you quit because you didn't like your job. You need to show it was necessary to quit to protect your health, safety, or legal rights. Sounds like you have a strong case with the discrimination angle.

•Yeah, it definitely affected my mental health. Should I mention that too?

Collins Angel
•Yes, if you can connect it to the hostile work environment. Consider getting documentation from a doctor if possible.

•Mental health effects from workplace harassment are totally valid reasons for quitting.

Make sure you apply as soon as possible after quitting. There's no waiting period for filing, and you want to get the process started. Even if it takes weeks to adjudicate, your benefit start date will be from when you first filed.

•I quit last Friday, so I should file this week?

Tate Jensen
•Yes, file immediately. The sooner you start the process, the sooner you could potentially receive benefits.

just went through this whole process myself. be prepared for them to contact your former employer during the investigation. My ex-boss tried to lie about what happened but I had documented everything so Washington ESD sided with me in the end.

•How long did the whole process take from filing to getting your first payment?

Adaline Wong
•about 8 weeks total but that included the appeal process because they initially denied me

•Did you have to attend a hearing for your appeal?

•yeah but it was over the phone. having all my documentation really helped during the hearing

The most important thing is to frame your quit as being forced by circumstances beyond your control. You didn't want to quit, but the employer's actions made it impossible to continue working there safely.

Fernanda Marquez
•That's exactly how I feel about it. I loved the actual work but couldn't deal with the harassment anymore.

Misterclamation Skyblue
•Perfect. That's the angle you want to emphasize in your application and any follow-up communications.

One more tip - if your claim gets denied initially, don't give up. The appeal process exists for a reason and many people win their appeals with proper documentation. I've seen it happen multiple times.

Also remember that even while your claim is being adjudicated, you should continue filing your weekly claims. If you're eventually approved, you'll get back pay for those weeks.
0 coins
Fernanda Marquez
•I didn't know that. So I should file weekly claims even before I know if I'm approved?
0 coins
Sophia Gabriel
•Yes, absolutely. Missing weekly claims can cost you benefits even if your initial claim is approved.

•This is super important advice. I missed filing for two weeks and lost those benefits permanently.

If you need to talk to Washington ESD during this process and can't get through normally, that claimyr service someone mentioned earlier is actually pretty good. I was skeptical at first but it really does work better than calling on your own.

•I'll definitely look into that if I have trouble reaching them. Thanks for confirming it's legitimate.
