What does appeal resolved mean for unemployment Washington ESD claim?
I've been checking my Washington ESD account obsessively and today it finally changed from 'Appeal Pending' to 'Appeal Resolved' but I have no idea what this actually means. Does this mean I won or lost my appeal? My original claim was denied because they said I quit voluntarily but I was basically forced out due to unsafe working conditions. The appeal hearing was two weeks ago and the judge seemed understanding but I can't tell from this status if that's good or bad news. Has anyone else seen this status and what happened next?

Appeal resolved usually means the Administrative Law Judge has made their decision on your case. You should receive a written decision in the mail within 3-5 business days that will tell you whether your appeal was allowed or denied. The status change is just Washington ESD updating their system to reflect that the hearing process is complete.

•Thank you! I was so worried it meant something bad. Do you know if there's any way to find out the decision online before the letter arrives?

•Unfortunately no, Washington ESD doesn't post appeal decisions online. You'll have to wait for the mail. But the fact that they processed it relatively quickly is usually a good sign.

I had the same status change last month and it took forever to get my letter! Turns out I won my appeal but the anxiety of waiting was terrible. At least you know the judge has made their decision now.

•How long did it take for your letter to arrive? I'm checking the mailbox twice a day already lol

•It was about 6 days for me, but I think there was a weekend in there. The postal service has been slower lately too.

If you're having trouble getting through to Washington ESD to check on anything related to your appeal, I recently discovered this service called Claimyr that actually gets you connected to a real person. They have this demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. I used it when I needed to clarify something about my weekly claims and it was so much easier than trying to call the regular number.

•Is that legit? I've been burned by scam services before that promise to help with unemployment stuff.

•Yeah it's real, check out claimyr.com. They don't ask for any personal info, just help you get through to Washington ESD. Way better than sitting on hold for hours.

•Thanks for the tip! I might need this if I have questions about what happens next depending on the decision.

The appeal resolved status is actually just the first step. If you won your appeal, Washington ESD will need to process back pay and update your claim. If you lost, you have 30 days to file another appeal to the Board of Review. Either way, that letter will have all the details about your next steps.

•Oh wow, I didn't know there was another level of appeal. Hopefully I won't need it but good to know!

•The Board of Review appeals are much more limited though. They mainly look at whether the ALJ followed proper procedures, not the facts of your case.

Since you mentioned unsafe working conditions, that's actually considered good cause for leaving employment under Washington state law. If you documented the unsafe conditions and tried to address them with your employer first, you have a strong case for your appeal.

•I did document everything and sent emails to my supervisor about the safety issues. I brought all of that to the hearing so hopefully it helped.

•Good! Documentation is key in these cases. Sounds like you were well prepared.

Just curious - how long was the gap between your hearing and seeing 'appeal resolved'? I had my hearing last week and still showing 'appeal pending'.

Issac Nightingale
•It was exactly 2 weeks for me. The judge said she had 30 days to make a decision but it happened much faster than that.

•That's encouraging, thanks! Hopefully mine updates soon too.

The waiting is the worst part of this whole process. I remember refreshing my account constantly when I was going through my appeal. At least now you know a decision has been made!

Issac Nightingale
•Exactly! I was starting to worry the judge forgot about my case or something. At least now I know it's just a matter of waiting for the mail.

If your appeal is successful, make sure to keep filing your weekly claims even while waiting for the letter. You don't want to miss any weeks while they're processing your back pay.

•Wait, I should still be filing weekly claims? I thought I couldn't since my original claim was denied.

Savanna Franklin
•Yes! As long as you have an active appeal, you should continue filing. If you win, those weeks will be processed. If you don't file them now, you can't get paid for those weeks later.

•This is correct. Always keep filing your weekly claims during the appeal process, even if they show as 'not paid' status.

Quick question - did you have a lawyer for your hearing or represent yourself?

Issac Nightingale
•I represented myself. I looked into getting a lawyer but couldn't afford one and legal aid said they don't usually take unemployment cases unless there are other issues involved.

•Good for you! A lot of people successfully represent themselves in these hearings, especially when they have good documentation like you did.

The fact that the judge seemed understanding during your hearing is definitely a positive sign. ALJs are usually pretty good at asking follow-up questions if they need more information to make their decision.

•She did ask a lot of questions about the specific safety violations and what steps I took to report them. She seemed really interested in the timeline of events.

I had my appeal denied the first time but won on my Board of Review appeal. Don't give up hope if the first decision doesn't go your way - sometimes the higher level reviewers see things differently.

•Good to know there are options if things don't work out. Hopefully I won't need to go that route though!

•The Board of Review success rate is much lower though, so it's definitely better to win at the ALJ level if possible.

Whatever the decision, make sure you read it carefully. The letter will explain exactly why the judge ruled the way they did, and that information could be important if you need to take any follow-up actions.

Just as an update on that Claimyr service I mentioned earlier - I actually used it again yesterday to ask about appeal processing times and got through to someone at Washington ESD in about 10 minutes. Way better than the 2+ hour hold times I was dealing with before.

The waiting after seeing 'appeal resolved' is almost worse than waiting for the hearing itself! At least during the hearing wait you know what's coming next.

One thing to keep in mind - if your appeal is successful, it might take a few weeks for Washington ESD to actually process your back pay and get your regular weekly benefits flowing again. The decision letter will give you timeframes for when to expect payments.
0 coins
Issac Nightingale
•That's good to know so I can manage my expectations. At this point I just want to know if I won or lost!

Joy Olmedo
•The back pay processing can be slow but they do pay interest on delayed benefits, so you won't lose money due to their processing time.

Fingers crossed for you! Unsafe working conditions are definitely legitimate grounds for leaving a job. Sounds like you handled everything properly by documenting and reporting the issues first.

The whole unemployment appeal process is such a stressful experience. Even when you know you're in the right, there's always that anxiety about whether you'll be believed or if you presented your case well enough.

Issac Nightingale
•Exactly! I keep second-guessing whether I explained everything clearly during the hearing. I guess I'll know soon enough.

•That's totally normal. Most people feel that way after their hearing. The fact that the judge asked lots of questions and seemed engaged is actually a really good sign.

The "Appeal Resolved" status is actually a really positive development! It means the Administrative Law Judge has finished reviewing your case and made their decision. From what you've described about your situation with unsafe working conditions and having documentation, it sounds like you presented a strong case. The fact that you documented everything and tried to address the issues with your employer first before leaving shows you followed the proper steps. Most people who win their appeals based on unsafe working conditions have exactly the kind of evidence you mentioned. Try not to stress too much while waiting for the letter - the hardest part is behind you now!
