Washington ESD unemployment eligibility - fired for performance issues
I got terminated from my warehouse job last month for not meeting productivity standards. My supervisor said I wasn't picking orders fast enough even though I was trying my best. The company documented everything over the past 6 months with write-ups and performance improvement plans. I'm wondering if I can still get unemployment benefits through Washington ESD since it wasn't like I was stealing or being insubordinate - just couldn't keep up with their pace. Has anyone been approved for UI after being fired for performance? I really need the income while I look for something else.

Yes, you can absolutely get unemployment if you were fired for performance issues that weren't your fault. Washington ESD distinguishes between misconduct (which disqualifies you) and just not being able to do the job well enough. Performance issues usually qualify for benefits unless they can prove you were deliberately not trying or violating company policies.

•That's reassuring. I was definitely trying but the quotas seemed impossible. Should I mention the performance improvement plans when I file my claim?

•Definitely mention everything - the PIPs, the write-ups, all of it. It shows you were making an effort to improve. Washington ESD will want to see that it was a capability issue, not willful misconduct.

I went through something similar when I got fired from a call center for not hitting my sales numbers. Filed with Washington ESD and got approved after they reviewed everything. The key is that you weren't fired for breaking rules or being dishonest.

•How long did it take for them to make a decision? I'm worried about the adjudication process taking forever.

•Mine took about 3 weeks. They contacted my former employer to verify the reason for termination, then approved my claim.

Just went through this exact situation! I used Claimyr.com to get through to Washington ESD when I had questions about my performance-related firing. The service helped me reach an actual agent who explained exactly what documentation I needed. There's a helpful video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole process so much less stressful than trying to call on my own.

•Never heard of that service before. Did it actually help you get approved faster?

•It didn't speed up the decision itself, but being able to actually talk to someone at Washington ESD helped me understand what they needed from me. No more sitting on hold for hours just to get disconnected.

•I'm always skeptical of these third-party services, but honestly the Washington ESD phone system is so broken that anything that works is worth it.

PERFORMANCE ISSUES ARE NOT MISCONDUCT! I can't stress this enough. I see so many people think they can't get benefits because they weren't perfect employees. Washington ESD specifically says that being unable to perform job duties due to lack of skill or ability is not disqualifying misconduct.

•This is so important. I almost didn't file because I thought getting fired meant automatic disqualification. Glad I did because I got approved.

•Exactly! The Washington ESD handbook is very clear about this distinction. Misconduct has to be willful or negligent behavior that violates the employer's interests.

File immediately, don't wait. Even if you're not sure about eligibility, it's better to file and let Washington ESD make the determination. You can always appeal if they deny you initially. The worst thing you can do is delay filing because you think you might not qualify.

•Good point. I was hesitating because I didn't want to waste their time if I wasn't eligible.

•That's their job to determine eligibility, not yours. File the claim and provide all the details about your termination honestly.

what counts as misconduct then? because ive been written up for being late a few times but its because of my car breaking down

•Chronic tardiness can be misconduct depending on the circumstances. If you have documented reasons like car trouble and you tried to communicate with your employer, that's different than just not caring about showing up on time.

•ok good because i always called when i was going to be late and my supervisor knew about my car issues

The documentation your employer has is actually going to help you. Those performance improvement plans and write-ups show they were trying to help you succeed, which means they probably didn't consider your performance willful misconduct either. Washington ESD will see that.

•I never thought of it that way. I was worried all that paperwork would hurt my case.

•Nope, it's actually evidence that you were trying to improve and they were giving you chances. That's the opposite of misconduct.

Been there done that. Got fired from Amazon fulfillment for not hitting rate targets. Washington ESD approved me no problem. They understand that some jobs have unrealistic expectations. Just be honest about everything when you file.

•That's exactly what I'm dealing with! These warehouse quotas are insane. Thanks for sharing your experience.

•Amazon warehouses are notorious for this. I know three people who got unemployment after being fired for rate issues there.

Make sure you have all your employment records organized before you file. Pay stubs, your termination letter, any performance reviews, etc. Washington ESD might ask for documentation during the adjudication process.

•I have most of that stuff. Should I upload it all when I file or wait until they ask?

Isabella Santos
•Upload what you can initially, but don't stress if you don't have everything right away. They'll tell you specifically what they need.

The waiting is the worst part honestly. I filed for performance issues and spent weeks stressed about whether I'd get approved. Ended up being fine but the uncertainty was brutal.

•That's what I'm worried about. Bills don't stop while you're waiting for a decision.

•True, but if you get approved they'll backdate the payments to when you first filed. So you won't lose that money.

I used Claimyr when I was going through my performance-related claim too. The agent I spoke with explained that Washington ESD gets tons of these cases and most get approved. Really put my mind at ease. The service is definitely worth it when you need actual answers instead of generic website info.

•How much does Claimyr cost? I'm already tight on money after getting fired.

•I can't remember the exact amount but it was reasonable compared to what I was spending on my phone bill trying to call Washington ESD constantly. Check their website for current pricing.

Whatever you do, don't lie or leave out details when you file. If Washington ESD finds out later that you weren't completely honest, that can cause way more problems than just being upfront about being fired for performance.

Connor Murphy
•Definitely planning to be completely honest. I figure they'll find out anyway when they contact my employer.

Omar Hassan
•Exactly. They always verify with the employer, so honesty is the only way to go.

Quick question - does it matter what industry you're in? I got fired from a restaurant for being too slow during rush periods.

Yara Haddad
•Industry doesn't matter. The same rules apply whether you're in food service, warehousing, retail, whatever. It's all about whether your performance issues constituted misconduct or not.

•Good to know. I was worried restaurant work might be treated differently.

File your weekly claims even while your initial claim is in adjudication! I made the mistake of not doing this thinking I should wait until I was approved. Delayed my payments by weeks.

Connor Murphy
•Good tip! I wouldn't have thought to do that. Thanks for the heads up.

•Yeah, they tell you to keep filing weekly claims regardless of your initial claim status. Learned that the hard way.

The whole system is designed to make you think you don't qualify when you actually do. I bet half the people who don't file after getting fired would actually be approved. Washington ESD should make this clearer on their website.

•So true. I almost talked myself out of filing because I thought being fired was an automatic no.

•The misconduct standard is way higher than most people think. You basically have to steal, lie, or deliberately sabotage your employer to be disqualified.

One more thing - if your employer tries to fight your claim by saying it was misconduct, you can appeal that decision. Had a friend whose employer lied about the reason for termination and she successfully appealed with documentation.
0 coins
Connor Murphy
•That's scary that employers would lie about stuff like that. Is there any way to prepare for that?
0 coins
Sean Doyle
•Keep copies of everything - emails, performance reviews, any documentation about your employment. If they lie, you'll have evidence to prove the truth.

Also remember that you have to actively look for work while collecting benefits. Start job searching immediately even if your claim is still pending. Washington ESD requires work search activities and they do check up on this.
0 coins
Connor Murphy
•How many jobs do you have to apply for per week? I've seen different numbers mentioned.
0 coins
Zara Rashid
•I think it's 3 work search activities per week, but check the current requirements on the Washington ESD website since they change sometimes.

Last thought - even if you get denied initially, don't give up. The appeal process exists for a reason and lots of people win their appeals. I've seen performance-related denials get overturned all the time when people provide better documentation or explanation.

•Good to know there's still hope even if the first decision doesn't go my way. Thanks everyone for all the advice and encouragement!

•You're going to be fine. Performance issues are one of the most common reasons people get approved for unemployment. Just file honestly and completely.

Actually one more tip - when I had questions during my claim process, I found Claimyr super helpful for getting through to Washington ESD agents. Way better than trying to call during their busy hours and getting hung up on constantly. The video demo they have really shows how much easier it makes the whole process.

•I'm definitely going to check that out if I run into issues. The horror stories about trying to reach Washington ESD by phone are enough to make anyone want an alternative.

•Yeah, I wasted so much time on hold before I found Claimyr. Being able to actually speak with someone who can answer your specific questions is huge when you're dealing with something this important.
