Washington ESD unemployment benefits - is unemployment a public charge for immigration?

I'm on a green card and have been working in Washington for 3 years. Lost my job last month due to layoffs and really need to file for unemployment benefits with Washington ESD. But I'm worried about the public charge rule - will receiving UI benefits affect my immigration status or future citizenship application? I've been paying into the system this whole time through payroll taxes. Has anyone dealt with this situation before?

Mei Liu

Unemployment insurance is NOT considered a public charge for immigration purposes. You paid into the system through your payroll taxes, so you're entitled to these benefits. The public charge rule mainly applies to means-tested benefits like food stamps or Medicaid, not earned benefits like unemployment.

That's such a relief to hear! I was so worried about filing my claim but I really need the income right now.

0 coins

Yes, this is correct. UI benefits are considered earned benefits, not welfare. You should be fine to file your Washington ESD claim.

0 coins

You definitely should file for your unemployment benefits. The public charge rule specifically excludes unemployment compensation because it's an insurance program you contributed to. Just make sure you're actively job searching and meeting all the Washington ESD requirements for your weekly claims.

Good to know about the job search requirements. I've been looking but wasn't sure about the specific Washington ESD rules.

You need to make at least 3 job search contacts per week and keep a detailed log. Check the WorkSourceWA website for approved job search activities.

I was in the exact same situation 2 years ago. Filed for Washington ESD benefits on my green card and had zero issues with immigration. Actually got my citizenship approved last year with no questions about the UI benefits. You're overthinking this - file your claim!

0 coins

Wow, that's exactly what I needed to hear. Congratulations on your citizenship! Did you mention the unemployment on your N-400 application?

0 coins

Thanks! I did mention it in the additional information section just to be transparent, but the officer didn't even ask about it during the interview.

If you're having trouble getting through to Washington ESD to file your claim, I recently discovered this service called Claimyr (claimyr.com) that helps you actually reach a real person at unemployment offices. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me hours of busy signals.

0 coins

Thanks for the tip! I was dreading trying to call Washington ESD. Does this service actually work?

0 coins

It really does! Got through to an agent in about 20 minutes instead of the usual 2+ hours of trying. Worth checking out the demo to see if it fits your needs.

wait i thought all government benefits counted as public charge?? this is confusing

Mei Liu

No, that's a common misconception. Only certain means-tested benefits count. Unemployment is earned through your work history and payroll tax contributions.

0 coins

The key distinction is earned vs. means-tested benefits. UI, Social Security, and similar programs you pay into don't count as public charge.

My immigration lawyer specifically told me that unemployment benefits are fine to collect. The public charge rule targets people who might become dependent on government assistance, but UI is temporary and you earned it through your work.

0 coins

Did your lawyer give you any advice about documenting the job search efforts for both Washington ESD and immigration purposes?

0 coins

She said to keep detailed records of all job applications and interviews, which helps with both UI requirements and shows you're actively seeking work if immigration ever asks.

0 coins

Been on green card for 8 years, collected unemployment twice during that time. Never had any issues with renewals or anything. You're good to go - file that claim with Washington ESD ASAP!

0 coins

That's so reassuring! How long did it take for your first unemployment claim to get approved?

0 coins

First time took about 2 weeks, second time was faster since I already had everything set up in the system. Make sure all your employer info is accurate.

0 coins

The whole public charge thing is really misunderstood. Like others said, UI doesn't count. But even if it did, you have a green card already so the rules are different than for people applying for visas or green cards for the first time.

0 coins

Oh that's a good point about already having the green card vs applying for one. Thanks for clarifying that distinction!

I'm not an immigration expert but I know people always get scared about this stuff unnecessarily. You worked, you paid taxes, you lost your job through no fault of your own. That's exactly what unemployment insurance is for!

0 coins

You're right, I was definitely overthinking it. Sometimes the fear gets to you even when you know you're entitled to something.

0 coins

Totally understand the fear! Better to ask and get reassurance than to struggle financially when help is available.

For what it's worth, I've been helping people with Washington ESD claims for years and I've never seen anyone have immigration issues from collecting UI benefits. The bigger concern is making sure you meet all the eligibility requirements and don't get disqualified for something silly.

0 coins

What are the most common reasons people get disqualified? I want to make sure I avoid any mistakes.

0 coins

Usually it's failing to do the required job search activities, not reporting work or income properly, or missing deadlines for weekly claims. Just be diligent about following all the rules.

0 coins

UNEMPLOYMENT IS NOT PUBLIC CHARGE! Sorry for the caps but I see this question constantly and it drives me crazy how much misinformation is out there. You earned those benefits through your work history.

0 coins

Haha no worries about the caps - I appreciate the emphasis! It's hard to find clear information sometimes.

0 coins

If you're still worried, you could always consult with an immigration attorney, but honestly it seems like overkill for this situation. Everyone here is giving you the same advice - file your claim!

0 coins

Yeah, I think the consensus is pretty clear at this point. I'm going to file my Washington ESD claim this week.

0 coins

Just want to add that you should also make sure to report any freelance or gig work income when you file your weekly claims. Even small amounts need to be reported to Washington ESD or you could face penalties later.

0 coins

Good point! I do some occasional freelance work so I'll make sure to report that accurately.

0 coins

Yeah, they're pretty strict about that. Better to over-report than under-report when it comes to income.

0 coins

Another vote for filing your claim! I was worried about this exact same thing when I first got laid off. Turns out I worried for nothing and missed out on benefits I was entitled to for weeks.

0 coins

Oh no! How much did you lose by waiting? I don't want to make that same mistake.

0 coins

Probably around $2000 because I waited almost a month to file. Washington ESD doesn't backdate claims, so you lose that money forever.

0 coins

The key thing to remember is that public charge determinations look at whether someone is likely to become primarily dependent on government benefits. Temporary unemployment benefits while actively job searching doesn't fit that criteria at all.

0 coins

That makes a lot of sense when you put it that way. Thanks for the clear explanation!

0 coins

Just echoing what everyone else said - you're totally fine to collect unemployment. I've been through this with multiple green card holders and never seen any issues. Focus on your job search and don't stress about the immigration stuff.

0 coins

Thanks for the reassurance! I feel much better about moving forward with my claim now.

0 coins

One more thing - if you do have trouble getting through to Washington ESD on the phone, that Claimyr service someone mentioned earlier is legit. Used it myself when I had an issue with my weekly claim certification and it saved me a ton of time.

0 coins

Good to hear another confirmation about that service. I'll definitely check it out if I run into any issues.

0 coins

Yeah, sometimes you need to talk to an actual person to resolve certain issues, and that's nearly impossible with the regular phone system.

0 coins

Update us on how your claim goes! I'm always curious to hear how smooth the Washington ESD process is for different people.

0 coins

Will do! I'm planning to file online this weekend and I'll let you know how it goes. Thanks everyone for all the helpful advice!

0 coins

I went through this exact same worry when I lost my job last year! The anxiety about immigration consequences really got to me, but everyone here is absolutely right - unemployment insurance is completely separate from public charge considerations. The fact that you've been paying into the system through your payroll taxes means you've literally earned these benefits. I ended up filing my Washington ESD claim and had no issues whatsoever. The hardest part was actually getting through their phone system, but the online application worked fine for me. Don't let the fear keep you from getting the financial support you need while job hunting!
