Are DACA recipients eligible for unemployment benefits in Washington ESD?

I've been working in Washington state for the past 3 years on my DACA work authorization and just got laid off from my job. I'm trying to figure out if I can apply for unemployment benefits through Washington ESD. I have a valid SSN and have been paying into the system, but I'm not sure if my immigration status affects my eligibility. Has anyone with DACA status successfully filed for UI benefits in Washington? I don't want to apply if it's going to cause problems or if I'm not eligible.

Yes, DACA recipients are eligible for unemployment benefits in Washington! As long as you have valid work authorization and have been paying into the UI system, you should be able to file a claim. The key requirement is that you were legally authorized to work when you earned your wages.

That's such a relief to hear! Do I need to provide any special documentation when I apply?

You'll need your work authorization document and SSN, but the application process is the same as for any other worker. Just make sure your DACA hasn't expired.

I applied last year with DACA status and had no issues. Washington ESD processed my claim normally. Just be prepared to wait a bit longer for adjudication since they might need to verify your work authorization status.

How long did your adjudication take? Mine is still showing pending after a week.

Mine took about 3 weeks total, but that was pretty typical for most claims at the time. Don't panic if it takes a while.

If you're having trouble getting through to Washington ESD to check on your claim status, I'd recommend trying Claimyr. It's a service that helps you actually reach a live agent - I found it at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ. Way better than sitting on hold for hours.

Is that legit? I've been trying to call Washington ESD for days with no luck.

Yeah it worked for me. They basically handle the waiting and callback process so you don't have to sit on the phone all day.

The main thing is making sure your work authorization is current when you apply. If your DACA expires while you're receiving benefits, that could complicate things, so keep track of your renewal dates.

Good point - mine expires in 8 months so I should be okay for now.

What happens if it expires while you're still collecting? Do benefits stop immediately?

You'd need to contact Washington ESD immediately if your work authorization expires. They'll probably suspend benefits until you can provide renewed documentation.

just applied with daca status last month, no problems at all. the system treats you like any other worker as long as you have valid SSN and work history

That's encouraging! Did you have to provide any extra documentation during the process?

Yuki Sato

•

nope, just filled out the regular application online. they might ask for work authorization later if they need to verify but nothing extra upfront

One important note - make sure you're available and able to work when you certify your weekly claims. The job search requirements apply to DACA recipients just like everyone else, so you'll need to be actively looking for work.

Are there any restrictions on what types of jobs I can search for with DACA status?

0 coins

Luca Ferrari

•

Not really - you can apply for any job you're qualified for as long as the employer is willing to hire someone with DACA work authorization.

Some employers are more familiar with DACA than others, but legally they can hire you just like any other authorized worker.

I was worried about this too when I first applied. Washington state is pretty good about not discriminating based on immigration status for benefits you've earned. If you've been paying in, you should be able to collect.

Did you have any issues during the application process?

None at all. The hardest part was just waiting for them to process everything, but that's normal for everyone.

Does anyone know if there are any federal programs that might affect DACA recipients collecting state unemployment? I heard something about public benefits affecting immigration status.

Unemployment benefits generally don't count as public benefits for immigration purposes since you've earned them through your work contributions. But it's always good to check with an immigration attorney if you're concerned.

Thanks, that makes sense. I was just being extra cautious.

The key thing is that Washington ESD looks at whether you were legally authorized to work when you earned the wages, not your overall immigration status. DACA gives you valid work authorization, so you should be fine.

That's exactly what I needed to hear. I've been paying into the system for years, so it makes sense that I should be able to use it.

One thing to keep in mind is that if you travel outside the US while collecting benefits, you need to report that to Washington ESD. DACA recipients need advance parole to travel, so just make sure you follow all the rules.

Good point - I wasn't planning to travel but that's important to know.

Yeah, any time you're not available for work or leave the state, you need to report it on your weekly claim.

If you run into any issues or need to speak with someone at Washington ESD about your specific situation, definitely consider using Claimyr to get through. The phone lines are always swamped and it's nearly impossible to reach anyone otherwise.

How much does that service cost? I'm already tight on money.

It's worth checking out their website for current info. When you're dealing with potential weeks of delayed benefits, sometimes it's worth it to get answers quickly.

been on DACA for 6 years and never had problems with any state benefits I earned through work. Washington is pretty straightforward about it - if you worked legally and paid in, you can collect

That's really reassuring. I was worried there might be some hidden complications.

Just to add one more thing - make sure you keep your contact information updated with Washington ESD, especially if you move. Sometimes they need to send additional documentation requests and you don't want to miss those.

Will do! Thanks for all the helpful advice everyone.

Also set up the online account if you haven't already. It makes managing your claim much easier than trying to call all the time.

Good luck with your claim! The process is basically the same for everyone once you get started. Just be patient with the adjudication if they need to verify anything.

Thank you! I'm feeling much more confident about applying now.

One last tip - when you're doing your job search activities, make sure to keep good records. Washington ESD might ask for your job search log during an audit, and you want to show you're actively looking for work within your authorized employment scope.
