Washington ESD unemployment after being fired - can I still get benefits?

Got let go from my warehouse job last week and wondering if you get fired from a job can you draw unemployment in Washington? My supervisor said it was due to 'performance issues' but honestly I think they just wanted to cut costs. I've been working there for almost 2 years and never had any written warnings or formal disciplinary action. Do I have a chance of getting approved for UI benefits or will Washington ESD automatically deny me because I was fired? Really stressed about this situation.

Yes, you can still get unemployment benefits even if you were fired, but it depends on WHY you were fired. Washington ESD will look at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were deliberately not doing your job.

That's a relief to hear. They never said I was being insubordinate or anything like that, just that my numbers weren't meeting targets.

0 coins

Definitely file anyway. The worst they can do is say no, but you might be surprised.

The key distinction Washington ESD makes is between being fired for misconduct vs. being fired for other reasons. Misconduct means you deliberately violated company policies or engaged in behavior that harmed the employer. Poor performance, lack of skills, or not meeting quotas typically don't qualify as misconduct.

So if they fired me for not hitting sales targets, that wouldn't be considered misconduct?

0 coins

Correct, as long as you were trying to do your job. If you were deliberately underperforming or refusing to work, that would be different.

What about attendance issues? I was late a few times but nothing crazy.

I went through this exact situation last year. Was fired for 'not being a good fit' after 6 months. Washington ESD approved my claim because my employer couldn't prove I did anything wrong. The adjudication process took about 3 weeks but I got approved.

0 coins

How did the adjudication process work? Do they interview you and your former employer?

Avery Davis

•

Yeah, they called me first to get my side of the story, then contacted my employer. Make sure you keep any documentation about your termination.

Been trying to reach Washington ESD for weeks about my own claim issues. Their phone system is absolutely impossible - either busy signal or you wait on hold for hours just to get disconnected. Anyone found a way to actually talk to someone there?

Try calling right when they open at 8am. That's usually the best time to get through.

I found this service called Claimyr that actually got me through to an Washington ESD agent in like 20 minutes. They handle all the calling and waiting for you. Check out claimyr.com - they even have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

Seriously? That sounds too good to be true. How much does it cost?

File your claim ASAP even if you're not sure about eligibility. Washington ESD will make the determination and you can always appeal if they deny you. Don't wait because there's usually a waiting period anyway.

0 coins

Good point. I was worried about filing if I might not qualify but I guess there's no harm in trying.

Exactly! And if you wait too long you might miss out on benefits you're entitled to.

What kind of documentation should you save when you get fired? I got canned 2 months ago and didn't think to keep anything.

0 coins

Termination letter, any emails about your performance, your employee handbook, timesheets, anything that shows what happened and why.

Damn, I didn't save any of that stuff. Think it'll hurt my case?

Rajan Walker

•

Not necessarily. Washington ESD will still investigate and get information from your employer directly.

The whole system is rigged against workers anyway. They'll find any excuse to deny your claim and make you jump through hoops. Been fighting Washington ESD for months over my disqualification.

0 coins

That sucks but don't discourage people from applying. Lots of us do get approved even after being fired.

If you're having trouble reaching them about your disqualification, that Claimyr service I mentioned earlier might help you get through to explain your situation to an actual person.

I was fired for being 10 minutes late three times in a month. Washington ESD still approved my claim because they said it wasn't 'willful misconduct.' Every case is different but don't assume you won't qualify.

0 coins

That gives me hope. My situation seems way less serious than chronic tardiness.

Were you in a probationary period? I heard that makes a difference.

Peyton Clarke

Nope, had been there for over a year. Washington ESD looks at the specific reason for termination, not how long you worked there.

0 coins

Quick question - do you have to do the job search requirements if your claim is still in adjudication for being fired?

0 coins

Yes, you still need to file your weekly claims and do job searches while your claim is being adjudicated. Don't skip that part.

0 coins

Thanks, wasn't sure about that part. Don't want to mess up my claim over something like that.

0 coins

Washington ESD denied my first claim when I got fired but I appealed and won. The hearing officer said my employer couldn't prove I did anything wrong. Don't give up if you get denied initially.

0 coins

How long did the appeal process take? And did you need a lawyer?

0 coins

About 6 weeks total. No lawyer needed - it was just a phone hearing where I explained my side. Much less scary than I thought it would be.

Same experience here. Appeals aren't as complicated as they sound.

My cousin got unemployment after being fired for 'attitude problems' which seems way more subjective than performance issues. You should definitely apply.

0 coins

That's encouraging. Sounds like Washington ESD really does look at each case individually.

0 coins

Yeah they're pretty fair about it as long as you weren't stealing or anything obvious like that.

BTW if you do need to call Washington ESD about your claim status, I used Claimyr last month and they actually got me through to talk about my adjudication. Way better than trying to call myself and getting nowhere.

Several people have mentioned that service now. Might be worth looking into if I run into problems.

Same here, worked great for me when I needed to ask about my job search requirements.

The bottom line is that being fired doesn't automatically disqualify you from unemployment benefits in Washington. File your claim and let Washington ESD make the determination. You've got nothing to lose by applying.

0 coins

Thanks everyone for all the advice. I'm going to file my claim today. Feeling much more confident about it now.

Good luck! Hope it works out for you.
