Washington ESD federal unemployment tax due date - need help with timing
I'm really confused about when federal unemployment tax payments are due. My small business had to lay off 3 employees last year and I know I need to pay FUTA taxes but I can't figure out the exact deadlines. Washington ESD sent some notices but they're not clear about federal vs state requirements. Does anyone know when these federal unemployment taxes are actually due? I don't want to get hit with penalties.

Federal unemployment tax (FUTA) is due quarterly - January 31st, April 30th, July 31st, and October 31st for the previous quarter. But if you owe less than $500 you can pay annually by January 31st of the following year.

I had this same issue last year and couldn't get through to anyone at the IRS or Washington ESD to clarify. The key thing to remember is FUTA is 6% on the first $7,000 of each employee's wages, but you get a credit for state unemployment taxes paid. So it usually works out to 0.6% if you're current on your Washington state unemployment taxes.

You also need to file Form 940 annually by January 31st even if you don't owe anything. Don't forget the filing requirement!

I'm a CPA and see this confusion all the time. The January 31st deadline is firm for both filing Form 940 and paying any remaining FUTA tax. If you paid quarterly and your calculations were correct, you might not owe anything additional.

Just went through this myself. The Washington ESD website has some info but it's mostly about state taxes. The federal stuff is all on the IRS website under employer tax obligations.

Don't forget that if you're a new employer, you might qualify for the new employer FUTA credit which reduces your rate for the first few years.

One last tip - if you're cutting it close on the deadline, you can pay online through EFTPS (Electronic Federal Tax Payment System) and it counts as timely if submitted by 8 PM ET on the due date.
