Stuck in ESD adjudication for 5 weeks - normal waiting time?

I'm seriously going crazy waiting for my unemployment claim to get through adjudication. It's been sitting there for 5 weeks now with zero updates. The ESD website just shows 'adjudication in progress' but doesn't give any timeline. I've already missed two rent payments and my landlord is getting impatient. Is this normal? How long did adjudication take for others? I worked at a restaurant that closed suddenly and my boss is disputing my claim saying I quit (which is completely untrue). Do employer disputes make adjudication take longer? Just trying to figure out if I should keep waiting or if something's wrong with my claim.

8 weeks?! That's insane. Did you do anything to speed it up or just wait it out?

When there's an employer dispute like you're describing, adjudication typically takes 6-10 weeks. The ESD claims specialist needs to gather evidence from both sides, which includes contacting your former employer for their version of events. Since restaurants often have high turnover and sometimes poor record-keeping, this can extend the timeline further. In your situation, I'd recommend: 1. Continue filing your weekly claims while waiting 2. Make sure your contact information is up-to-date in the system 3. Check your correspondence tab daily for any requests for information 4. Start documenting everything about your separation (dates, conversations, witnesses) If they're investigating a quit vs. layoff situation, they'll need clear evidence that the business closed rather than you voluntarily leaving.

Thank you so much for this detailed explanation. I've been filing weekly claims but didn't realize I should be checking the correspondence tab daily - will do that starting now. I have texts from coworkers about the closure announcement, so hopefully that helps my case.

Oh god, I'm having FLASHBACKS to my adjudication nightmare from January!!! It took TWELVE WEEKS and I almost got EVICTED waiting!!! The system is COMPLETELY BROKEN!!!! I called literally 47 times (counted them) and either got disconnected or was told "there's nothing we can do to speed it up" every single time. The worst part is they don't tell you ANYTHING during the waiting period. You're just stuck in this limbo wondering if you'll ever get your money. And then one day it magically resolves with no explanation. It's INSANE how they treat people!!!

Twelve weeks is absolutely terrifying. I'm already struggling at 5 weeks. Did you ever find out why yours took so long?

They just said they had a "high volume of claims" but I think that's just their excuse for EVERYTHING!!! I wish I had better news but the whole system is designed to make you give up. DON'T GIVE UP!!!

Adjudication timeframes vary widely depending on the complexity of your case and current ESD workload. The average is currently 6-8 weeks for cases involving employer disputes, but I've seen some resolve in as little as 3 weeks while others take 12+ weeks. Your specific situation (restaurant closure with employer claiming you quit) will require fact-finding from both parties. When employers dispute claims, ESD has to conduct a more thorough investigation. This typically includes: 1. Interviewing you about the separation 2. Contacting the employer for their statement 3. Reviewing any submitted documentation 4. Possibly contacting additional witnesses If you haven't received a fact-finding questionnaire yet, you should contact ESD to check on the status. Also, make sure to respond to any requests for information immediately - missing deadlines can further delay your claim.

Thanks for the breakdown. I did get a fact-finding questionnaire about 3 weeks ago and returned it right away with some supporting documentation (texts from coworkers about the closure). I guess I'm just in the waiting period now.

If you need to get through to ESD faster, I used Claimyr.com last month when my claim was stuck and it actually worked! They connected me to an ESD agent in about 20 minutes after I'd been trying for weeks on my own. I was able to speak directly with a claims specialist who gave me updates on my adjudication status and told me exactly what was happening. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. It was honestly such a relief to talk to a real person instead of getting the automated messages.

Good reminder! Yes, I've been keeping up with my 3 job search activities every week and logging them. Hopefully that won't be an issue.

Adjudication and appeals are totally different things right? I'm in adjudication too but my neighbor said I should file an appeal but I don't think that's right since I haven't been denied yet?

You're correct - they're completely different processes. Adjudication happens before a decision is made on your claim. Appeals happen after you receive a determination that you disagree with. You can't appeal while in adjudication because there's no decision to appeal yet.

Has anyone noticed that adjudication seems to take WAY LONGER now than it did during the pandemic? Back in 2021, my claim was processed in like 3 weeks even with an employer dispute. Now they're taking MONTHS for the exact same situations. It's like they're intentionally slowing everything down to make people give up!!!

There's actually a logical explanation for this. During the height of the pandemic, many standard verification procedures were temporarily suspended to process the unprecedented volume of claims quickly. Now that claims have returned to more normal levels, ESD has reinstated all of their standard verification and fact-finding processes, which do take longer but help prevent fraud and ensure accurate determinations.

Update: I finally got through to ESD on the phone! After dozens of calls over two days, I got a really helpful agent who looked up my claim. She said my adjudication is in the queue and appears to be moving normally, but restaurant industry claims often take longer because they have to verify seasonal employment patterns. She estimated another 2-3 weeks. Not great news but at least I have some kind of timeline now.
