If you're fired can you get unemployment benefits from Washington ESD?
So I got terminated from my job last week and I'm wondering if I can still file for unemployment benefits? I know Washington ESD has rules about being fired but I'm not sure what they are. My manager said it was due to attendance issues but I had some medical problems that caused me to miss work. Can I still get UI benefits or am I screwed? Really need to know if it's worth applying or if I'll just get denied.

You can definitely still apply for unemployment even if you were fired. Washington ESD looks at whether you were terminated for 'misconduct' or not. If it was just performance issues or attendance problems that weren't willful misconduct, you should still qualify for benefits. The key is whether your actions were deliberate violations of company policy.

Here's what Washington ESD considers misconduct: theft, violence, deliberate violation of company rules, excessive unexcused absences. If your absences were medical and you tried to follow proper procedures, that's not misconduct. Apply for benefits and let them make the determination.

Don't let your employer scare you into not applying. A lot of companies will try to make you think you can't get benefits if you're fired, but that's not true. Washington ESD makes the determination, not your former employer.

File your claim online at esd.wa.gov as soon as possible. Don't wait even if you think you might not qualify. The worst thing that happens is they deny you, but at least you'll have started the process.
